If Council desires to designate any or all of its members to file an argument concerning either measure, additional resolutions listed below would need to be adopted. Additionally, if the City Council desires the City Attorney to prepare an impartial analysis of either measure, additional Resolutions listed below would need to be adopted. ITEM EXPLANATION At the meeting of June 26, 1990, Council adopted Resolution No. 90-197, calling and giving notice of a General Municipal Election to be held in the city on November 6, 1990 for the purpose of electing municipal officers. Council also adopted Resolution No. 90-198, requesting the Board of Supervisors to consolidate the election with the statewide election being held that day and provide specific services in the conduct of the city's election. At the meeting of July 24, 1990, Council directed staff to return with documents that would place the questions before the voters concerning making the offices of City Treasurer and City Clerk appointive. The attached Resolution No. ^-J2?7 will amend the previously adopted resolutions, and place those questions before the voters at the General Municipal Election to be held on November 6, 1990. Section 4OT5 of the California Elections Code provides that the legislative body may file a written argument concerning ballot measures. In order to do that, Council must adopt the appropriate resolution designating which members are authorized to file that argument. Those names will then appear with the argument when printed in the sample ballot. If Council desires to designate any or all of their members to file a written argument concerning the appointive City Treasurer ballot measure, Resolution No. 4fi*3f* , attached, needs to be adopted with instructions on which names to be inserted in the blanks. Resolution No. ^-«J?1V needs to be adopted if Council desires to designate members to file an argument concerning the appointive City Clerk measure. Page 2 of AB # In addition, Section 5011 of the California Elections Code provides that the legislative body may direct the City Attorney to prepare an impartial analysis showing the effect of a measure on the existing law and the operation of the measure. Therefore, if Council desires the City Attorney's Office to prepare an impartial analysis of the measures, Resolution Nos. ft?- A fiL> and %'3£3 need to be adopted. The filing deadline for arguments and the impartial analysis has been established as August 27, 1990. EXHIBITS 1. WHEREAS, pursuant to the requirements of the laws of the State of California relating to General Law Cities, there has been called and ordered to be held in the City of Carlsbad, California, on Tuesday, November 6, 1990, a General Municipal Election for the purpose of electing a Mayor for the term of four years, two members of the City Council for the term of four years, a City Clerk for the term of four years, and a City Treasurer for the term of four years; and WHEREAS, the City Council also desires to submit to the voters at the election a question relating to making the office of City Treasurer appointive and a question relating to making the office of City Clerk appointive; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: SECTION 1. That the above recitations are true and correct. SECTION 2. That the City Council, pursuant to its right and authority, does order submitted to the voters at the General Municipal Election the following questions: SHALL THE OFFICE OF CITY TREASURER BE APPOINTIVE? That Resolution No. 90-198 is hereby amended to request the Board of Supervisors of the County of San Diego to authorize the Registrar of Voters to include these measures in the provision of specified services relating to the conduct of the election of the City of Carlsbad. SECTION 6. That the City Clerk shall certify to the passage and adoption of this Resolution and enter it into the book of original resolutions. YES NO NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Carlsbad, California, does declare, determine and order as follows: SECTION 1. That the above recitations are true and correct. SECTION 2. That the City Council authorizes Claude A.
