CITY ATTY CITY MGR. o COto oo RECOMMENDED ACTION: Review, discuss, and make appropriate comments for the endorsement of the Carrillo Ranch Trust Brochure. ITEM EXPLANATION; In April 1990, City Council established an Ordinance which created a Carrillo Ranch Trust Fund (Exhibit 1). In an effort to promote gifts and donations to this fund, Mrs. Joan Kindle with review from City staff has created a brochure (Exhibit 2) for distribution to potential donors. The Commission is requested to review and make appropriate comments which might enhance the brochure. FISCAL IMPACT; The cost to publish the attached brochure is estimated at one hundred dollars ($100.00). The donations from brochure distribution is unknown. EXHIBITS; 1. 2. HD-X^KK P.JTY ATTY riTY MGR. RECOMMENDED ACTION: If Council concurs, introduce Ordinance No. amending Section 2.36.090 of the Carlsbad Municipal Code to establish a Carrillo Ranch trust fund. ITEM EXPLANATION Mrs. Joan Kindle, Volunteer Curator for the Carrillo Ranch, has asked for a Carrillo Ranch trust. She believes a trust fund will help get more donations of artifacts or cash from private foundations, corporate entities, service organizations, and private citizens. Staff supports Mrs. Kindle in identifying and documenting the location of Carrillo memorabilia, and acquiring small artifacts such as photographs and autobiographical documentation. However, large donations which would create a need for storage facilities or obligate the City may be premature until the master plan is approved establishing the future use of the ranch. We recommended that the Parks and Recreation Commission administratively establish an account with the Finance Department. Significant memorabilia requiring immediate action would go to the City Council. The Commission, by a 6-1 vote, adopted the staff recommendation and asked for a subcommittee of the Historic Preservation and Parks and Recreation Commissions and Mrs. Kindle to discuss the time line for the planning and development of Carrillo Ranch and the possibility of advancing the current 1993/94 schedule. Mrs. Kindle does not want to wait. She disagrees with the Commission and is asking for a trust fund so she can begin active solicitation of donations. The Council has included a reference to a trust in this year's goals and objectives, so staff has prepared an ordinance to implement Mrs. Kindle's request. A recommendation from the Commission and Council approval will be required to accept major gifts. Any concerns about a premature committment of the park to a particular use can be addressed at that time. If Council concurs, your action is to introduce Ordinance No. , which amends Section 2.36.090 to add subsection (d) to establish a Carrillo Ranch trust fund. FISCAL IMPACT The fiscal impact resulting from the solicitation of cash purposes associated with Carrillo Ranch cannot be estimated donations for at this time. EXHIBITS 1. Ordinance No. 2. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING TIILE 2, CHAI'IKR 2.36 OF THE CARLSBAD MUNICIPAL CODE BY THE AMENDMENT OF SECTION 2.36.090 TO ADD SUBSECTION 2.36.090(d) ESTABLISHING A CARRILLO RANCH TRUST FUND. The City Council of the City of Carlsbad, California does ordain as follows: SECTION I: That Title 2, Chapter 2.36 of the Carlsbad Municipal Code is amended by the addition of Section 2.36.090(d) to read as follows: (d) Carrillo Ranch Trust. A special trust fund is hereby established to receive and hold donations of money, artifacts, and memorabilia for the Carrillo Ranch. Proposed donations shall be referred to the Parks and Recreation Commission for a recommendation before acceptance. Donations of five hundred dollars or less may be accepted by the City Manager. Donations over five hundred dollars ($500) may be accepted by the City Council. All donations accepted in the trust must be used exclusively for purposes relating to the development, operation, and maintenance of the Carrillo Ranch. EFFECTIVE DATE: This ordinance shall be effective thirty days after its adoption, and the City Clerk shall certify to the adoption of this ordinance and cause it to be published at least once in the Carlsbad Journal within fifteen days after its adoption.
