ITEM EXPLANATION: CALTRANS has approved the Project Study Report (PSR) for th Costa Avenue and Interstate 5 Interchange. The completion approval of this report represents a major step forward in development of the proposed La Costa Avenue/I-5 Interch project. The completed PSR will allow the City to proceed witF remaining preliminary engineering and design tasks leading to identification of a design concept for final construction plans specifications. The attached cooperative agreement between City and CALTRANS defines the responsibilities of each agency the remaining desiqn and development tasks. In accordance CALTRANS’ established procedures, the City is required to der with the State the sum of $300,000 for CALTRANSI review development/coordination costs. The City will take the lead the implementation of the project and be responsible for remaining phases. CALTRANS will provide review for compliance State design standards and regulations. This cooperative agree is identical to one previously approved by the City Council foi Palomar Airport Road and Interstate 5 Interchange. As the jurisdictional boundary between the City of Carlsbad City of Encinitas traverses the proposed La Costa A\ Interchange area, City staff has discussed with the CiQ Encinitas staff a joint City development of the project. S recommends a continuation of the dialogue between the two Agencies regarding joint development and financial participatic the ultimate design and construction of the project. As the City Council authorizes staff to proceed with construction of the 1-5 interchanges, it is important to unders how funding for these projects will ultimately be secured. Costa Avenue Interchange. First, the 1990-91 Capital Improve Program schedules the construction of the La Costa Av Interchange for fiscal year 1992-93. The interchange woulc constructed using a combination of Bridge and Thoroughfare Ben District fees and TransNet funds. In addition, the staf: working on the creation of a Mello-Roos District which w guarantee the funding of three 1-5 Interchanges. The Mello- District anticipates the construction of the La Costa Av Interchange in fiscal year 1992-93 as shown in the CIP. No fun for design or construction is expected to be available prior t 1992-93. RECITALS 1. Within thirty (30) days of written notification from STA' CITY shall deposit with STATE, cash in the amount of $300,0 which figure represents the estimated cost of STAT oversight of environmental, design and right-of- activities. Such funds .shall be subject to release retention pursuant to Article 2 of Section 111. 5. Personnel who prepared the PS&E will be available to STA at no cost to STATE, through completion of construction PROJECT to discuss problems which may arise dur construction and/or to make design revisions for contr change orders. 6. Not to use funds from any federal aid program for design PROJECT. 7. To make written application to STATE for necess encroachment permits authorizing entry onto STATE'S right way to perform surveying and other investigative activit required for preparation of the PR, ED and/or PS&E. 8. To identify and locate all high and low risk undergro facilities within the project area, and protect or otherw provide for such utilities, all in accordance with STAT Manual on High and Low Risk Underground Facilities Wit Highway Rights of Way. If any existing public and/or private utilities conflict b the construction of project, CITY will make all necess arrangements with the owners of such utilities for tt' protection, relocation, or removal. CITY will inspect protection, relocation, or removal: and if there are costs such protection, relocation, or removal which STATE anc CITY must legally pay, CITY will bear the cost of E protection, relocation, or removal, plus cost of engineel overhead and inspection. To comply with the terms and conditions of the High Encroachment Permits, existing California Law, includ Statutory and Case Law, and all existing property rights w determining liability for utility relocation costs. 13. To perform all right-of-way activities, including emin domain activities, if necessary, at no cost to STATE, accordance with procedures acceptable to STATE, and compliance with all applicable State and Federal laws regulations, subject to STATE oversight, to assure that completed work is acceptable for incorporation into the St Highway right of way. To utilize the services of a qualified local public agency all right-of-way acquisition-related matters in accorda with STATE procedures as contained in R/W Procedural Handbo Volume 9. Qualified public agency employees shall adminis any contract for right of way services. 14. 15. To utilize Generic Forms as contained in Right of Procedures Handbook, Volume 9. If outside consultants employed, the consultant contract shall contain a provis requiring the use of said forms by the consultant. 16. To provide, pursuant to Article 2 of Section 111, oversil of PROJECT and to provide prompt reviews and approvals, appropriate, of submittals by CITY, and to cooperate in timt processing of the PROJECT. 2. To provide, pursuant to Article 2 of Section 111, oversit of all right-of-way activities undertaken by CITY, or designee, pursuant to this Agreement. 3. To issue, at no cost to CITY, upon proper written applicat by CITY, an encroachment permit to CITY authorizing entry o STATE'S right of way to perform survey and other investigat activities required for preparation of the PR, ED and/or PS SECTION I11 IT IS MUTUALLY AGREED: 1. All obligations of STATE under the terms of this Agreement subject to the appropriation of resources by the Legislat and the allocation of resources by the Califor Transportation Commission. 2. If a construction contract for PROJECT is awarded within f (5) years from the execution date of this Agreement, ST Section I, without deduction, within thirty (30) days awarding the contract. In the event a construction contr for PROJECT is not awarded within said five (5) years an1 time extension has not been granted by STATE, STATE w deduct all oversight costs to date, free of interest, return any unused deposit to CITY within thirty (30) d after said five-year or five-year plus extension period expired. If costs of STATE oversight exceed said depos STATE will bill CITY for any additional amount due ST within thirty (30) days after said five-year or five-year p extension period has expired and CITY will pay said amo within thirty (30) days after receipt of such billing. ST shall not return deducted funds, whether or not PROJECT ultimately constructed. The parties hereto will carry out the PROJECT in accorda with the Scope of Work, attached and made a part of t Agreement, which outlines the specific responsibilities of parties hereto. The attached Scope of Work may in the fut be modified to reflect changes in the responsibilities of respective parties. Such modifications shall be concur with by CITY'S Director of Public Works or other offic designated by CITY and STATE'S District Director District 11, or his designee, and become a part of t Agreement as a supplement to this Agreement after execut by the respective officials of the parties. Prior to award of a construction contract, CITY may termin PROJECT and this Agreement in writing, provided CITY F 9. 5 0 e STATE for all PROJECT oversight costs incurred by STATE pr to termination. STATE will deduct all oversight costs date, free of interest, and return any unused deposit to C within thirty (30) days of written notice of termination Agreement.
