HD.125 CITY ATTYU^ CITY MGR. *^V RECOMMENDED ACTION: Consider the proposed policy as recommended by the Parks and Recreation Commission regarding sponsorship of City recreation programs and take appropriate action. ITEM EXPLANATION; At the July 24, 1990 City Council meeting, the matter of sponsorship of City recreational programs by alcohol beverage companies was referred to the Parks and Recreation Commission for further analysis and recommendation. The Council felt that the City may be sending youth by accepting such donations in light of with the D.A.R.E. program. a mixed message to our the City's involvement Staff has surveyed eight (8) cities in San Diego and Orange Counties and have found that none of the governing agencies have a written policy with regards to the acceptance of donations for sponsorships of City activities from alcohol distribution companies. However, five (5) of the eight (8) cities surveyed do accept donations and/or sponsorships from alcoholic distributing companies. Based on the growing concern to provide our youth with wholesome and healthy recreational programs, staff recommended to the Parks and Recreation Commission that a positive approach be taken to restrict alcoholic distributing companies from making donations of any kind for City youth sponsored recreation programs and events. On September 17, 1990 after a staff presentation and discussion by the Parks and Recreation Commission, the Commission felt they should take a pro active rather than reactive position and not single out only alcoholic beverage companies in dealing with the policy. Consequently, it was proposed that staffs policy suggestion should be further expanded and the following recommendation was approved (5-1): "In order to provide wholesome recreational opportunities, the City of Carlsbad will neither solicit nor accept donations for youth programs; open to anyone under the age of 21 years that may be detrimental to the health, safety or well being of the youth involved. This exclusion will include but not be limited to alcohol beverage or distribution companies, tobacco product companies and businesses engaged in the sale or manufacture of drug paraphernalia, pornographic materials or firearms." AB# Page 2 FISCAL IMPACT; The Parks and Recreation receives approximately $3,000 per year in donations from alcoholic beverage companies for adult targeted programs. The incorporation of this policy will have a minimal effect in the departments ability in conducting youth and teen programs. Staff conducted a survey, prepared a report and recommendations which were presented on August 20, 1990 to the Parks and Recreation Commission. The Commission referred the matter back to staff for additional input from the City Attorney's office. Staff met with the Assistant City Attorney and discussed the issue, concerns, proposed policy. Attached is a copy of the Recreation Superintendent's report to the Director, dated September llth with the proposed policy. (EXHIBIT 1) FISCAL IMPACT: The fiscal impact of the proposed policy is a net loss of $3,000 per year. Staff is confident that they can solicit new sponsorships for recreation programs from non- alcohol related sponsors and find the same amount of support. EXHIBIT: 1. Memorandum to Parks and Recreation Director, with Proposed Policy, dated September 6, 1990 13 SEPTEMBER 6, 1990 TO: PARKS AND RECREATION DIRECTOR FROM: Recreation Superintendent PROPOSED POLICY ON SPONSORSHIP OF RECREATION PROGRAMS BACKGROUND: At the July 24, 1990 City Council meeting, the matter of sponsorship of recreation programs by alcohol beverage companies was referred to the Parks and Recreation Commission for their report and recommendation. Ken Price, Principal Recreation Supervisor conducted a survey which showed none of the eight cities contacted has a written policy on sponsorship. He prepared the report and recommendation that was presented at the August 20th Parks and Recreation Commission meeting. The Commission referred the matter back to staff for additional input from the City Attorney's office. RECOMMENDED ACTION: Staff recommends that a policy be proposed to the Parks and Recreation Commission to neither solicit nor accept donations of any type from an alcohol beverage or distribution company for youth recreation programs, open to anyone under the age of 21 years old. A draft copy of the proposed policy is attached. (EXHIBIT 1) FISCAL IMPACT: The fiscal impact of the proposed policy would be a net loss of $3,000. Staff is confident that the $3,000 loss can be replaced by new, non-alcohol related sponsors, resulting in a zero impact. If replacement sponsors were not found, the fiscal impact could result in an increase in the participant's fee. For example, the entry fee for "Bodyboard Classic" may be $15 instead of $10; the $5 increase provides for liability insurance previously paid with funds from the alcohol beverage sponsorship. DISCUSSION: The Department received $3,000 total in donations this year from Mark Stein Beverage Company, an alcohol distribution company. For the past seven years, this company has sponsored the Triathlon, Boogie Board and Bodysurfing Contests, supplying equipment such as display flags, fencing material, as well as snacks, money and alcohol. For the 1990 Body Board and Surfing Contest, they donated $1,000 which pays for participant liability insurance. In addition, they contributed $500 to the Parks Division for Coastal Clean-Up. 14 EXHIBIT 1 MEMORANDUM TO PARKS AND RECREATION DIRECTOR SEPTEMBER 6, 1990 PAGE 2 DISCUSSION, continued The City does not have a written policy on sponsorship of recreation programs. In March, 1984, the Department proposed and the Commission adopted a broad policy statement, titled "Sponsorship of City Youth Activities". Recently, the City Attorney's Office reviewed the Department Policy No. 23 and suggested the wording "products that are objectionable to youth" is too vague and subjective to be an effective policy statement. A copy of Department Policy No.23 is provided as reference material. (EXHIBIT 2) I met with the Assistant City Attorney and discussed several items of concern including discrimination and first amendment rights, as well as the proposed policy and alternative. He assured us the City can legally adopt a policy pertaining to soliciting/accepting donations. CONCLUSION: The Department will continue to seek sponsorships and donations as a means of reducing program costs to the City and participants. Alcoholic beverage industries have traditionally supported athletic events, however, the Department is confident that alternative sources of sponsorship can be found. LYNN CHASE Ijc EXHIBIT 1. COMMUNITY YOUTH RECREATION ACTIVITIES Sponsors are the responsibility of the individual league officials. The matter is to be resolved by the parents, league officers, and those participating in the activity.
