HD? DEPT.~’ R MTG. 10/2/90 MASTER AUTOMATIC AID AGREEMENT CITY ATTY. CITY MGR. FOR FIRE AND RESCUE RESPONSE RECOMMENDED ACTION: approving a master automatic aid agreement with the No Adopt Resolution No. 1 Regional Zone Fire Agencies and the City of Carlsbad to provide automatic aid for fire and rest responses. ITEM EXPLANATION : The City of Carlsbad has individual automatic aid agreements with Oceanside, Encinitas, Ranc Santa Fe, and San Marcos Fire Departments. In an effort to consolidate the agreeements generalized master agreement has been proposed for all fire agencies in the north county. A lis\ participants in the North Regional Mutual Aid Zone is attached to the agreement marked Exhibit A The provisions in the existing agreements will not change operationally, however, updating I implementation will be streamlined by the consolidation into one master agreement. T agreement does not conflict with existing mutual aid agreements, but will supercede exist automatic aid agreements. Automatic Aid is used on a daily basis, as opposed to Mutual Aid, which is employed on lagre-sc emergencies such as the recent wildland fire along Del Dios Highway and the wildland fires Yosemite and Northern California. c&) ---37-3 Under an automatic Aid Agreement, the closest available unit of a neighboring jurisdiction substituted in the initial dispatch assignment for one of the home jurisdiction units. I 0 RESOLUTION NO, 9 0 - 3 7 3 CALIFORNIA, APPROVING AN AGREEMENT BETWEEN THE FOR AUTO MATIC AID FOR FI RE AND RESCUE RES PONSES A RESOLUTION OF THE CITY COUNCIL OFTHE CITY OF CARLSBAD, NORTH REGIONALZONE FIRE AGENCIES AND THE CITY OF CARLSBAD BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. That an automatic aid agreement for fire and rescue responses between the Cit Carlsbad and the North Regional Zone Fire Agencies is hereby approved. 2. That the Mayor is hereby authorized and directed to execute said agreement for an behalf of the City of Carlsbad. LEWIS, hayor 0 0 NORTn REGIONAL ZONE MASTER AUTOMATIC AI0 AGREEMENT FOR FIRE AND RESCUE RESPONSES WHEREAS, certain cities, districts, and others located in San Diego County maintain as part of their service, an organized and equipped fire department charged with the duty of fire protection and rescue within the limits of said jurisdidions, herein referred to as the "parties"; and WHEREAS, it would be to the benefit of the parties that the fire suppression and rescue services of each of their fire departments be, in some circumstances, extended outside of the limits of each party hereto; and into the limits of the other parties; and WHEREAS, the parties desire that in some circumstances the fire departments of the other parties will respond to fire suppression and rescue incidents within the limits of their jurisdictions; and WHEREAS, it is the desire of the parties that EMT-P advance life support services are not included within the scope of this agreement, NOW THEREFORE, BE IT RESOLVED: 1. The parties to this agreement, as set forth in Exhibit A, have agreed to respond to emergency alarms outside of their geographical limits, and into the geographical limit of the other parties in accordance with the terms and conditions hereinafter set forth. 2. Alarms, which deal with emergency responses shall adhere as closely as possible to the nearest unit concept regardless of jurisdiction. 3. The details as to the method of operations, procedures, and other planning as may be necessary to effectuate the boundary drops and type of units and responses shall be covered by The Operational Plan between the chiefs of the respective fire departments of the parties hereto. 4. There shall be an operational committee which shall consist of the chiefs or their designee of the respective fire departments of the parties hereto, for the purpose of implementing the provisions of this agreement relating to operational procedure. Each party shall furnish the others in writing the name and rank of all participating officers. 5. The duties of incident commander shall be assumed by the first arriving fire offir from a participating agency who is at the scene of the incident, EQZUI ton the incident occurs. There shall be an orderly transfer of command when an officer from the jurisdiction in which the incident occurs arrives at the scene if said officer chooses to assume incident command. 6. Liability and Indemnification: Pursuant to Section 895.4 of the Government Code, all parties agree that each will assume the full liability imposed upon it or any of its officers, agents or employees for injury caused by a negligent or wrongful act or omission occurring in the performance of this agreement, and each party agrees to indemnify and hold harmless the other party for any loss, cost of expense that may be imposed upon such other party by virtue of Section 895.2 and 895.6 of the Government Code. .. 1 e e 7. Each party to this agreement shall maintain proper workers' compensation insurance covering its own employees without cost to the other parties, and each party shall payroll its own personnel without cost to the other parties. Any service performed by Marine Corps personnel, in connection with this agreement, shall constitute service rendered in the line of duty. The performance of such service by any other individual shall not constitute such individual as an officer or employee of the United States. 8. The assurance of automatic aid herein set forth shall constitute the sole consideration for the performance hereof. It is, therefore, understood and agreed that no money payments shall be made between the parties, that no charges shall be assessed by any party against any other party, and that each party shall be fully responsible for all of its costs in connection with the performance of this contract, except for replenishing chemical agents used for Pafly. fire suppression by the responding parties, which shall be paid for by requesting 9. Nothing in this agreement shall limit either party from participating in separated agreements with other fire jurisdictions and shall have no effect upon the existing San Diego County Mutual Aid Agreement. 10. This agreement shall become effective upon the execution by the parties hereto and shall continue until terminated by mutual agreement of the parties or until a party shall give sixty (60) days written notice of intention to terminate to each of the other parties hereto.
