RECOMMENDED ACTION:
Council approve and authorize signatures for Caltrans Maintenance Contracts EMA 11 -
and EMA 11-8156.
ITEM EXPLANATION:
For a period in excess of five (5) years, the City has participated in an agreement wit
California Department of Transportation (Caltrans) for the maintenance and operati
five (5) Caltrans owned and maintained traffic signals as well as a number of safety SI
lights located at various ramps and underpasses on 1-5. The cost to the City is calcu
on a benefit share basis approved by the City's Engineering Department at the time c
construction. A complete benefit share breakdown is contained in existing Agreement
11 -5020. This agreement is similar to agreements other cities throughout California ~
when the cities adjoin Caltrans properties.
In researching the existing Agreement EMA 11-5020 between the City and Caltrar
traffic signal maintenance, Staff could find no evidence that the agreement was app~
by the City Council. At this time, the Agreement is presented for City Council appro'
rectify this apparent oversight and to ratify the existing maintenance relationship bet
Caltrans and the City. The cost is approximately $19,000.00 per year for this Agree]
This amount is budgeted in the FY 90-91 traffic signal budget.

In addition, staff is requesting approval of a separate agreement, EMA 11-8156, T
provides for Caltrans to assume maintenance and coordination responsibility for thc
(2) signals at El Camino Real & Plaza Drive and El Camino Real & Marron Road, whic
currently maintained by the City. This Agreement will allow Caltrans to coordinate
two signals with other Caltrans signals at the Highway 78/E1 Camino Real interchaq
provide for improved traffic management in that area. The City Traffic Engineer co
with this recommendation (see Exhibit "B").
This contract will differ from the other contract in that the City will continue to pay e
costs for these two signals. There will be a flat rate fee of $150.00 per signal per n
($3,600 annually) for Caltrans to assume all maintenance and coordinatic

FISCAL IMPACT:
There will be no added cost to the approved FY 90-91 traffic signal budget.

AGREEMENT FOR SHARING COST OF
STATE HIGHWAY ELECTRICAL FACILITIES WITH CITY OF CARLSBAD
This AGREEMENT, made and executed in duplicate this 2nd day of
January, 1990, by and between the State of California, acting b
and through the Department of Transportation, hereinafter referr
to as 'ISTATEtt and the CITY of , hereinafter referred to as
"CITY It .
WITNESSETH:
AGREEMENT:
This Agreement shall supersede any previous Agreement and/or
Amendments thereto for sharing State-incurred costs in the CITY
with the CITY.
ELECTRICAL FACILITIES
Electrical facilities include flashing beacons, traffic signal
traffic-signal systems, safety lighting, and sign lighting on t
State Highway System.
The cost of operating and maintaining flashing beacons, traffic
signals, traffic-signal systems, safety lighting, and sign lighti
now in place at the intersection of any State Highway Route and 2
City street shall be shared as shown on Exhibit A.
Basis for billing:
It is agreed that monthly billings for flashing beacons, trafj
signals, and traffic-signal systems shall be based on actual
intersection costs which are as follows:

It is agreed that monthly billings for utility-owned and maintail
lighting will be based on calculated unit costs derived from
utility company billings.
Exhibit A will be amended as necessary by written concurrence
both parties to reflect changes to the system.
This Agreement shall become effective January 2, 1990, and sha
remain in full force and effect until amended or terminated,

also be terminated by either party upon thirty (30) days' noti

As you know, the El Camino Real corridor in the vicinity of Plaza Camino Real and SR-:
experiences heavy traffic congestion in peak travel periods. This is due to a combinatic
of factors such as large traffic volumes, closely spaced intersections and many drivewa
having direct access to El Camino Real.
One operational technique to help improve the movement of traffic along El Camino RE
would be to coordinate the traffic signals near the Plaza Camino Real shopping cent(
There are six intersections that would represent a coordinated traffic signal system. The
intersections are Camino Towne and Vista Way in Oceanside, both ON/OFF ramp locatio
at SR-78, and Plaza Drive and Marron Road in Carlsbad,
Maximization of traffic signal coordination from the Marron Road intersection a
continuing northerly to the Camino Towne intersection in Oceanside will improve traf:
progression, reduce delays and pollutants and result in saving of energy costs due to few
. stopped vehicles at the intersections. To a limited extent, traffic signal coordination h
taken place at these six intersections in the past and continuing today.
Caltrans has installed a C7 local intersection control program in the traffic sigr
controllers at the two Oceanside intersections and two ON/OFF ramp locations. A Caltra
C5 program is in the Plaza Drive controller and a Type 176 program is in the Marron Ro
traffic signal controller. As you might expect, these three programs are not compatible a:
coordination of all six intersections is not possible.
Maintaining the two traffic signal locations in Carlsbad will enable Caltrans to install
Caltrans C7 local intersection control program in each of the two Carlsbad controllt
located on El Camino Red. Consequently, the six intersections would each have the (
program, thereby enabling the existing hardwire interconnect to be utilized.
With the six intersections interconnected, the master controller located at the SR-'
westbound on-ramp would be able to communicate with all six intersections. This WOI
enable all internal controller clocks to be updated simultaneously and any program chang
to be made from one location. In addition, a clock correction pulse could be programm
to occur a midnight or at each time a timing plan change occurs during the day, resulti
in more accurate clocks. The C7 program has the ability to backward offset seek
addition to forward offset seeking, which results in less time to get in step from o
program change to another and is easier to optimize timing of the signal system.

Caltrans is testing a new C8 program that would be installed at the six intersections onc
the program receives final acceptance. This program provides remote capability to
computer located in a centralized signal operations center. From this office locatio
Caltrans would be able to communicate with the master controller serving the El Camir
corridor.
Traffic signal technicians for Caltrans live in North County and their response time
problems would be no longer than the traffic signal contract service now used by the Ci

AGREEMENT
Agreement No. 11-8156
The City of Carlsbad, a municipal corporation of the State
of California, hereinafter referred to as llCITYfl, and the State
' of California, Department of Transportation, District 11,
hereinafter referred to as flSTATE1l, do enter into the following
agreement:
WHEREAS, CITY pursuant to Section 131 of the Streets and
Highways Code has requested STATE to maintain traffic control
signal systems on the City Street System as shown on Exhibit rlA1l
attached hereto, and by this reference made a part hereof: and
WHEREAS, STATE does have qualified personnel available to
perform said maintenance of said traffic control systems within
the City: and
WHEREAS, STATE and CITY will mutually benefit from said
maintenance by providing safety to the traveling public; and
WHEREAS, CITY and STATE to mutually desire to cooperate and
to specify herein the conditions and the maintenance to be done:
NOW, THEREFORE, IT IS AGREED AS FOLLOWS: .

SECTION I
For and in consideration of the covenants and conditions tc
be kept and performed by STATE as set forth herein, CITY agrees:
(a) That the degree or extent of maintenance work to be
performed ad the standards therefor shall be in accordance with
the provisions of Section 27 of the Streets and Highways Code ant
the provisions of this Agreement or as may be prescribed from
. time to time by the District Director. l1DISTRICT DIRECTORf1, as
used herein, means the District Director of the Department of
Transportation assigned to the territory in which the CITY is
located, or his authorized representative.
(b) To reimburse STATE for the actual cost of said
maintenance, including Assessment for indirect charges to be mad1
at rates which 'are in effect at the time said costs arise.
(c) That said maintenance will be provided when requested
by CITY.
(d) That said maintenance will be done as the work load of
STATE'S forces permits and if said work load becomes too great,
this Agreement may be terminated sixty calendar days after CITY
receives written notice from STATE.
(e) To indemnify and save STATE, its officers, agents and
employees harmless from any and all liability for injuries to
persons or damage to property caused or resulting in any manner
from STATE'S performance under this Agreement, except for
injuries to person or damage to property caused or resulting

from the sole negligence or willful misconduct of STATE, its
officers, agents and employees.
SECTION I1
For and in consideration of the covenants and conditions
to be kept and performed by CITY as set forth herein, STATE
agrees :
(a) To maintain traffic control signal systems at locations
shows in Exhibit I1A1I in accordance with the provisions of
Section 27 of the Streets and Highways Code when requested by
CITY .
(b) To bill CITY quarterly for actual costs required to
maintain said traffic control systems, including assessments for
indirect charges to be made at rates which are in effect at the
time said costs arise.
IN WITNESS WHEREOF, the parties hereto have caused this
Agreement to be executed by their respective officers, duly
authorized: the provisions of which Agreement are effective
September 15, 1990.
