CITY DECISION APPROVING MAJOR SITE DEVELOPMENT CITY PLAN AMENDMENT SDP 80-3(A) AND SPECIAL USE RECOMMENDED ACTION: That the City Attorney be directed to return with documents DENYING the appeal ar UPHOLDING the Planning Commissions’s conditions in approving SDP 80-3(A) and SUP 90- ITEM EXPLANATION On September 19, 1990, the Planning Commission approved Major Site Development P1: Amendment 80-3(A) and Special Use Permit 90-2 to allow for the expansion of Dank Cablevision. There are two components to the proposed expansion: (1) the modification of tl existing site to add office space and construct a customer payment drive thru area, and (2) tl construction of a freestanding building consisting of 20,980 square feet of warehouse space ov a subterranean garage for 50 cars on the lot north of the existing Cablevision site. The applicant is appealing the Planning Commission decision based on two conditions of appro\ Commission Resolution Number 3097 are being appealed. On the existing Cablevision site the is a driveway to El Camino Real which was constructed without City approval and does not me City standards. Condition number 45 requires access rights onto El Camino Real to be waive and condition number 59 requires the removal of the driveway and the construction of standa curb, gutter and sidewalk. The applicant maintains that the driveway access onto El Camino Rc would be for trucks on a low frequency basis (one truck per day). All other traffic generated patrons, employees and service vehicles would not use the right turn exit driveway. Staf concerns center on the safety issue of a truck pulling out onto a prime arterial (El Camino Rei from an access point that was constructed without City approval that does not meet the Cit standards for access onto a prime arterial roadway. The applicant feels the elimination of the two conditions can be justified because: (1) t driveway would be used on a low frequency basis, (2) it is an existing condition, (3) the lot to developed has access to El Camino Real which will be deleted, (4) the intersection at Farad and El Camino Real is signalized to allow for safe access onto El Camino Real from the subjc driveway, (5) the BO foot building setback from El Camino Real allows adequate visibility, and ( the water district office south of Faraday has two drives onto El Camino Real. This last itc number (6) needs clarification. The water district had two access points onto El Camino Re One of them is a private street that leads to the water district’s entrance driveway and the Co Waste Management operations. This private street also acts as a secondary access route to t City’s Safety Center. The other access point was a driveway which was eliminated during t water district’s recent renovations. The Planning Commission heard the applicant’s request to modify the proposed conditions approval during the September 19, 1990 public hearing. The Planning Commission unanimou agreed with staff that the proposed conditions of approval were appropriate. The project area is in the M-Q 2 on the east side of El Camino Real north of Faraday Avenue. The Ger Plan Designation is Planned Industrial and it is located within Local Facil Management Zone 5. I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolution No. 2 APPROVING the Negative Declaration issued by the Planning Director, and &lJ Planning Commission Resolution No's. 3097 and 3098 APPROVING SDP 80-3(A) and 90-2, based on the findings and subject to the conditions contained therein. 11. PROECT DESCRIPTION AND BACKGROUND On June 25, 1980, the Planning Commission approved Site Development Plan 80- allow for the development of an office building and television studio facility at the SUI site. The applicant is now proposing to expand this use by 1) modifying the existing and adding office space and 2) constructing a freestanding building on the lot adjace the site on the north. These two sites will be integrated as shown by the project's site design on Exhibit "A". This project requires a Major Site Development Plan Amend] to the existing approval. The 1 component involves the addition of 705 square feet of office area to the exis Cablevision structure. As shown on Exhibit "A', the project also involves the remova the existing parking spaces to allow for the development of the adjacent lot an circulation island to allow for two customer drive-thru lanes adjacent to the proposed of space addition. The purpose of the drive-thru lanes is to allow Cablevision customer make payments faster and more efficiently. Many customers drop off their payments do not require any involved interaction with Cablevision staff, The drive thru will a1 these customers to get on and off the site efficiently. The circular island will feai enriched concrete paving around it. Other existing uses with the existing structure incl executive and administrative offices, customer services, minor vehicle mainten2 facilities and taping studios. The second component of the proposed use expansion will involve the construction 1 freestanding building with two floors of warehouse (totaling 20,980 square feet) OVI subterranean garage for 50 cars. Associated landscaping, parking spaces and emplc amenities are also proposed. The new structure's primary use will include warehousing/storage of cable, converter boxes and other miscellaneous materials use the services of Cablevision customers. In addition, technician dispatch rooms will provided and the 50 car subterranean garage will be for Cablevision employees. 111. PlanninR Issues 1. ' SDP 80-3(A)/SUP 90-2 e a DANIELS CABLEVISION EXPANSION SEPTEMBER 19, 1990 PAGE 3 DISCUSSION SPEClAL USE PERMIT AND EL CAMINO REAL CORRIDOR, DEVELOPMENT STAND, The proposed project has frontage on El Camino Real which has the El Carnino Overlay Zone Designation and is subject to the Scenic Preservation Overlay Zone, Ck 21.40 of the Zoning Ordinance. This chapter requires a Special Use Permit to be proc which will ensure compliance with adopted corridor standards; in this case the El Ca Real Corridor Development Standards. As such, most of this project's develop standards are outlined in the El Camino Real Corridor Development standards for At and are reviewed below as applicable. DesiRn Theme/Land Use The proposed project is consistent with the desired design theme of a first business/research/service complex within the Area 4 segment of El Camino Real. existing Cablevision structure is noted for contributing to the diversity of architec styles in the immediate area while adding to the common ''campus'' look, The proposed warehouse/parking structure will be similar in architectural style and to the existing Cablevision structure. In addition, since the proposed project i, expansion of an existing use, it is consistent with the required design theme/land u: the corridor standards. Sidewalks The construction of curb, gutter and sidewalk to City Standards will be a reqt improvement for the expansion portion of the project along the El Camino Real front Signage The project will be conditioned to comply with the specific signage criteria outlined ir corridor standards as well as the City's Sign Ordinance. Buildina HeiEht The project's proposed freestanding structure complies with the City's adopted builc height formula. Given the 10 foot elevational difference between the high and low pc of the area adjacent to the pad, a 10 foot bonus is allowed in addition to 35 feet to the end of the structure. The proposed building height averages 35 feet to the to] mechanical screening as shown on Exhibit "F". The low (north) end of the pad h, building height of 39 feet and the high (south) end of the pad has a building height 01 feet as measured to the top of the roof. e m ' SDP 80-3(A)/SUP 90-2 DANIELS CABLEVISION EXPANSION SEPTEMBER 19, 1990 PAGE 4 GradinE The project complies with grading standards since no cut or fill of 15 feet or great( proposed within the setbacks. The proposed grading allows for the construction of freestanding structure with subterranean parking while complying with building he limitations and maintaining the general topography of the site. Approximate grac quantities involve 2,500 cubic yards of cut, 500 cubic yards of fill with the balanc 2,000 cubic yards to be exported. Setback from El Camino Real The proposed freestanding structure will maintain the requi.red 30 foot setback from El Camino Real right-of-way. As shown on Exhibit "A", no screen walls or parking i encroaches closer than 25 feet to the right of way. The parking area does not encrc into the 25 foot setback area with parking overhang. Roof Ea u i nm c n t The project is proposing a mechanical screening for the roof top and the project wil conditioned to not introduce any roof top equipment without appropriate screening fi El Camino Real. Landscaping As shown on Exhibit "G", the project is consistent with the landscaping requirements of corridor standards by proposing London Plain trees as theme trees and Eucalyptus Cajeput trees as support trees. This will allow for a uniform and compatible extensio the existing landscaping along El Camino Real adjacent to the existing Cablevision struc to the south. M-O ZONING DESIGNATION The subject property has a zoning designation of M-Q; an industrial zone with a Quali Overlay Zone. The proposed use expansion is allowed within the zone, however, mos the project's development standards come from the El Camino Real Corridor Standard discussed earlier. The Q Overlay requires a Site Development Plan, of which the requ findings are discussed in the next section. The M Zone does require employee eating ai and required parking which apply to this proposal. Overall, the project exceeds the employee eating area requirement. Given a total of 18, square feet of office space and the proposed 20,980 square feet of warehouse space, a t of 2,356 square feet of employee eating area must be provided, of which at least 60% n be outside. SITE DEVELOPMENT PLAN Since this project involves a Major Amendment to an existing Site Development 1 (SDP), four findings must be made per the Qualified Development Overlay Zone of Zoning Ordinance. All four findings can be made for the project as proposed and reviewed below. 1. The use is properly related to the site, surroundings and environmental setting: single family residence was recently demolished on the subject site given General Plan Designation of Planned Industrial and as an expansion to the exis Cablevision use, the project is compatible with its surroundings. To the north of site is the Gateway Center with primarily retail and office uses. To the east is Faraday Business Park, to the south is the existing Cablevision structure and to elements and objectives of the General Plan. Specifically, the project is consis with the Land Use, Circulation and Scenic Highways Elements. A deta discussion of General Plan consistency follows in the next section. The project - not be detrimental to existing or future permitted uses since it involves expansion of an existing use which will maintain architectural harmony promote the desired ''campus" look of the area. In addition, the internal circulal of the site has been designed to be functional and will integrate well with adjac existing uses. The site for the proposed use expansion is adequate in size and shape to allow the development of the freestanding building with subterranean parking, surf parking, landscaped setbacks, compliance with all development standards i modification of the existing Cablevision site as shown on Exhibit "A". All of the features necessary to adjust the proposed use to existing and fut pe-tted uses will be provided and maintained. El Camino Real, a prime arterial, and Far; Avenue, a secondary arterial, are capable of serving this use expansion whit projected to generate approximately 120 average daily trips, CONSISTENCY WITH THE GENERAL PLAN Land Use Element The proposed use is consistent with various industrial guidelines as outlined in the 1 Use Element. Specifically, the proposed project is consistent with the guidelines #4, 9 12. Guideline #4 requires that industrial uses "provide for industrial sites that are 1; enough and level enough to permit ample space for on-site parking, appropi landscaping, and loading facilities as well as areas for expansion". The existing Cablevi use, by acquiring and developing the lot adjacent to the north, will satisfy this guide by being able to expand its operations while allowing for compliance with developn standards, providing ample onsite parking, appropriate landscaping and loading facili Guideline #9 requires that "the physical development of industrial areas should recog the need for compatibility among the industrial establishments involved and incompat uses should not be permitted". The proposed use expansion fulfills this guideline by bt highly compatible with existing uses and architecture. Development of the subject sit proposed is consistent with the Planned Industrial General Plan Designation and is no incompatible use. Guideline #12 requires that "the development of an industrial area should adequa provide for internal traffic, utilities, and other operational needs, and each indus, establishment within the area should fully provide for its individual needs (emplc parking, loading, storage) ." The proposed project complies with this guideline by provic a functional internal traffic system and addressing the warehouse/storage needs of Cablevision use. In addition, customer and employee parking, enhanced customer sew and loading facilities are proposed to increase the operating efficiency of this use. Circulation Element The project is consistent with the Circulation Element. Specifically, it is consistent v Policy C.3.3 which states that "the Circulation Element should be coordinated with development of the scenic route program (addressed specifically in the Scenic Highn Element) for the preservation and enhancement of the scenic qualities of selec corridors." By implementing the development standards of the El Camino Real Coni Standards, the project contributes to the preservation and enhancement of the SCE qualities of El Camino Real. e ' SDP 80-3(A)/SUP 90-2 DANIELS CABLEVISION EXPANSION SEPTEMBER 19, 1990 PAGE 7 Scenic Highways Element By implementing the El Camino Real Corridor Development Standards, the projec consistent with the Scenic Highways Element. MCCLELLAN-PALOMAR AIRPORT LAND USE PLAN The project site is within the designated airport influence area. The project has underj conformance review with the airport land use plan by SANDAG. The site is located out the flight activity zone. Given the proposed use and the project's location around thl decibel contour line, the proposal is compatible and consistent with the airp comprehensive land use plan. Donald Mueller, Laguna Niguel, an architect representing Daniels Cablevision, addressed the Commission and stated that he concurs with the staff report and the proposed conditions with the exception of Condition t45 and 1/59. Both references regard vehicular access to the project via El Camino Real. The company deals with the public on a daily basis and they would enter the parking area off Faraday Avenue. However, a right-turn exit is needed to El Camino Real to accommodate gasoline trucks (every two mos.), 18 wheeler trucks (weekly), and garbage trucks (weekly). The area is gated to prevent persons from entering off El Camino Real. proposes to bring this exit up to City standards similar to the Water District to the south. Cablevision Commissioner Erwin inquired if the satellite antennae is being used. Mr. Mueller replied that it is used and must be readjusted daily to bring in certain signals. Commissioner Erwin inquired if there are any plans to move the antennae from its present location. Mr. Mueller is not aware of any plans to relocate the satellite dish. Commissioner Hall asked Mr. Mueller to point out on the map where the fuel tanks are located. Commissioner Holmes inquired about how wide the driveway to El Camino Real would need to be. ft. is needed. Commissioner Schlehuber stated that there are major engineering reasons why limited access is allowed along a busy roadway such as El Camino Real. He wondered if it is possible for the gasoline trucks to detach one of the trailers in order to gain access to the storage tanks from the easterly direction. Mr. Mueller does not know if that can be done. Commissioner Hall stated that gasoline trailers cannot be detached. He feels that even with the exit to El Camino Real, there will be a turning radius problem in the vicinity of the gasoline storage tanks. Mr. Mueller believes there is enough room to navigate the vehicles. Chairman Schranun inquired if the service vehicles would also exit from that gate. Mr. Mueller replied that there is an easement road to the east of the parking lot and service vehicles would exit in that direction. Chairman Schramm noted that when she visited the Cablevision site, the gate was unlocked so she was able to walk through. Joanie Odum, General Manager of Daniels Cablevision, addressed the Commission and stated that the exit is needed for safety reasons because 18 wheelers and trash vehicles do not want to back up. gasoline tankers because they save approximately $1,500 per load due to the evaporation of about 200 gallons. She also mentioned that in earlier planning meetings with staff about the proposed project, they made no mention of eliminating this exit. Commissioner Erwin inquired if Cablevision has any interest in relocating the satellite dish away from the front of the building. Ms. Odum replied that she has not done any research on this and was not prepared to discuss it. She stated that the antenna is fully operational and must be moved daily to pick up the necessary signals. Commissioner Erwin commented that he tends to support staff's position regarding the prime arterial status on El Camino Real. There being no other persons desiring to address the Commission on this topic, Chairman Schramm declared the public testimony closed and opened the item for discussion among the Commission members. Commissioner Schlehuber could not support the exit to El Camino Real. Commissioner Hall feels the applicant is trying to accomplish acreage to accomplish everything they need to do. Bob Wojcik, Principal Civil Engineer, commented that staff did not review the access for double tanked trucks but rather for a 40 ft. delivery truck. The problem with the right turn exit to El Camino Real is that there is no way to police it. Staff would prefer no exit because El Camino Real is a high speed arterial. pull out into a high speed arterial. Commissioner Hall inquired when the exit proposal for double tanked trucks was first made to staff. Bob Wojcik replied that it was late in the design process, after most of the details were worked out. However, direct access to El Camino Real was noted by staff as an issue right from the start of the project review.
