ITEM EXPLANATION:
Carlsbad Tract 85-17 is a 26 lot subdivision located on the north side of I
Airport Road at the intersection with College Boulevard. The Applicant is rer
that the tentative map be extended a second time, until July 13, 1991.
The tentative map was originally approved on November 12, 1986, per Resoli
8873. A 20 month extension of time was granted on February 2, 1989, per RE
NO. 89-51.
Staff reviewed the existing project and recommends approval of time exten:
eight new conditions as contained in the resolution approving the extensio
map. These conditions are necessary to bring the project into compliance wit1
policies, standards, ordinances and the requirement of the Growth Man:
Program.
A brief listing of the eight conditions listed as A through H in the Resol
Approval is as follows:
A. Requires applicant to sign new Public Facilities Fee Agreement in conf
with City Council Policy 17.
Revises a previous project condition to make it conform with nc
standards.
Makes project subject to all new fees in effect at date of extension.
Requires developer to agree to pay proposed revised drainage area fc
established by City Council.
Requires developer to participate in the guarantee of the cost of ir
Palomar Airport Road from El Camino Real to the east City limits in acc
with the Zone 5 local facilities plan requirement.

The tentative map for CT85-17 will expire on July 13,1990. We are currently in th process of having grading plans, improvement plans, and the final subdivision mi
prepared far the project by our engineering consultant, Bodas Engineering, ~nc. 1 will not be able to finalize our subdivision map priorto the expiration date of the tentative map, and hereby request a one-year extension of the tentative map.
We believe this time frame will allow the recordation of the final subdivision maF and we will make every effort to achieve that end.

RESOLUTION NO. 90-405
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD CALIFORNIA, APPROVING AN EXTENSION OF
CONDITIONS.
TIME FOR TENTATIVE MAP NO. 85-1 7 SUBJECT TO CERTAIN
WHEREAS, Section 66473.5 of the Subdivision Map Act provides that a 1
subdivision map may not be approved unless it is consistent with all applicable gen
specific plans; and
WHEREAS, the City Council of the City of Carlsbad on the 12th day of Nc
1986, adopted Resolution No. 8873 approving, with conditions, Tentative Map CT 85
WHEREAS, the City Council of the City of Carlsbad on the 2nd day of Februar
adopted Resolution No. 89-51 extending Tentative Map CT 85-17, for a period of 20
to July 13,1990; and
WHEREAS, Tentative Map CT 85-17 is now inconsistent with the General PI2
City of Carlsbad because the City Council has found that public facilities are inadequ
WHEREAS, said Tentative Subdivision Map will expire on July 13, 1990,
Applicant has requested an extension of lime which cannot be approved unl
subdivision can be brought into conformity with the General Plan; and
WHEREAS, the addition of certain conditions of approval to the subdivision 1

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Car

That the above recitations are true and correct.
That Tentative Map CT 85-1 7 hereby extends for 16 months from July .
to November 13, 1991, subject to execution and fulfillment of all the condition:
Resolution No. 8873, Resolution No. 89-51 and the following additional conditions:
This approval is expressly conditioned on the payment by the Applic
Public Facilities Fee as required by City Council Policy No. 17, dated f
24, 1982, and effective April 2, 1982, on file with the City CI
incorporated herein by reference, and according to the agreement exel
the Applicant for payment of said fee. If said fee is not paid as promi
application will not be consistent with the General Plan and the projec
proceed and this approval shall be void.
Condition No. 4 of Resolution No. 89-51 shall be altered as follows:
All proposed office buildings must be subject to an acoustical study tc

notice shall be provided to purchaser, leasees and renters o
properties/buildings.
This project is subject to all fees in effect at the time of the extension
Prior to approval of the final map the developer shall enter into an ag
with the City to pay any drainage area fees established as a resu~
forthcoming Master Drainage Plan Update and the Sewer Connect,
Study.
Prior to recordation of a final map for CT 85-17, the property owner(
provide a financial guarantee for the construction of Palomar Airport ROi

District or Mello-Roos Community Facility District formed to finar
construction of the road segment, participation in a forward funding agr
as applied to the other Zone 5 property owners, or an alternate financi
