U-lH-Rb DEPT. ft(L TITLE: REQUEST FOR CARLSBAD LITTLE LEAGUE (ACTION) d>\ty*r RECOMMENDED ACTION: Approve the Little League Association request to purchase and install an electronic Scoreboard at Calavera Hills Community Park field number three (3) under the provisions as outlined in the existing agreement for the installation of scoreboards at Chase field. ITEM EXPLANATION; Mr. Paul J. Sulli, President of the Carlsbad American Little League, is requesting the Parks and Recreation Commission to approve the installation of an electronic Scoreboard at Calavera Hills Community Park field three (3). The League has secured funding for the purchase of this Scoreboard and the cost of installation will be assumed by them. He is requesting the same conditions regarding installation and use of this amenity be as outlined and included within the existing agreement for the scoreboards which were purchased and installed for Chase fields. The attached Exhibit 2 defines the conditions of installation and use for the scoreboards at Chase field which was previously approved by this Commission. Mr. Sulli will be available to address and/or answer any questions the Commission may have regarding this issue. EXHIBITS; 1. Letter, November 8, 1990 2. If given permission, the leagues would follow the same guidelines that were established upon the installation of the scoreboards at Chase and Pine fields, i.e. the usage by the city parks and recreation department for softball or high school games and or tournaments not conflicting with Little League scheduled games. WITNESSETH WHEREAS, the C.N.L.L. and the C.A.L.L. are the owners of the Fairplay Scoreboard; and WHEREAS, City desires the use of said electric scoreboards to operate youth or adult recreation programs, NOW, THEREFORE, it is understood and agreed by and between the parties hereto as follows, to wit: 1. ADMINISTRATION. This agreement shall be administered on behalf of the City by the Parks and Recreation Director, or his designated representative. 2. USE. The C.N.L.L. and the C.A.L.L. shall make available to the City, the electric scoreboards located on Chase Field No. 1 and Chase Field No. 3, and at Pine Field. The City will schedule the Scoreboard for the public's use. C.N.L.L. and C.A.L.L. will have priority use during their youth baseball season. 3. SERVICES/EQUIPMENT PROVIDED BY CITY. The City will assume all utility costs associated with the scoreboards. The City agrees to provide and pay for an independent remote control panel for the Scoreboard which will be available for the public's use. A $250 refundable security deposit will be required. EXHIBIT 2 36 USE AGREEMENT PAGE 2 4. SERVICES PROVIDED BY C.N.L.L. AND C.A.L.L. The C.N.L.L. and C.A.L.I . will assume all maintenance and repair costs for the electric scoreboards. If damage to the scoreboards necessitating repairs occurs during public use as a result of City rental, the City will be responsible for such repairs. If any such repairs are required, it is the responsibility of C.N.L.L. and C.A.L.L. to inform the City that the scoreboards are inoperative. 5. REVENUE. City shall have the right to charge and collect fees for the use of the Scoreboard. Such revenue shall belong to the City and shall be used to defray the cost of equipment repair and replacement of the City's remote control unit. STATEMENT OF POLICY Risk Management Review All proposed special events to be held in the City, whether sponsored, or co-sponsored by the City or sponsored by outside organizations, shall be reviewed in advance by the City Risk Manager. It shall be the responsibility of the City Risk Manager to identify and advise the City Manager of any special hazards involved in the event or any special safety measures which may be required, where appropriate, the City Risk Manager may recommend that the Event be disallowed based on liability exposures inherent in the event. Liability Insurance Except for "Low Hazard" non-profit events as defined below, or where a special waiver has been granted by City Council, no special events shall be authorized involving the use of City owned facilities or permits issued under the Municipal Code without submission, ten (10) days before the event, of evidence of public liability insurance in a form acceptable to the City Manager. Said liability insurance shall name the City of Carlsbad, its officers and employees as additional insureds, and be provided by an insurance company rated not less than A:XI by Best's rating guide. The highest rating available is A+:XV. Evidence of said insurance may be in the form of a certified copy of the policy or by delivery to the City of a Certificate of Insurance signed by an authorized agent of the insurance company. The certificate must indicate that the City is an additional insured and state, without modification, that the City shall receive ten (10) days written notice of cancellation. Certified accounts indicating a net worth of $2 million or two times the amount of liability insurance limits required, whichever is higher. 2. An executed agreement holding the City, its officers and employees harmless for any claims arising from the event. Insurance Limits Required As a general rule, the City shall require liability insurance limits of $1 million Combined Single Limits. Exceptions to this rule may be made based on the exposure classifications delineated in Appendix "A" to this policy: 1. Where events fall within the "Low Hazard" classification, a complete waiver of insurance may be granted where the event is sponsored by an individual or non-profit organization for non-profit purposes. Events sponsored for profit or by businesses shall provide a minimum limit of $500,000 Combined Single Limits. 2. "Moderate Hazard" events shall require the standard limit of $1 million Combined Single Limits. 3. Events falling within the "High Hazard" classification shall be subject to special review by the City Risk Manager, and the required limits shall be established by the City Manager. Depending on the scope of liability, limits will normally fall between $2 million and $5 million.
