RECOMMENDED ACTION:
Staff recommends Council adopt Resolution No. , accepting the bid pr
of Printmasters of Carlsbad and approving an Agreement with said compa
letterhead/envelope/business card printing on recycled paper for the period of or.
commencing January 1, 1991 through December 31, 1991 with the option to renew 1
one(1) year periods.

ITEM EXPLANATION
The City letterhead/envelope/business card printing proposal requested bids for virgin
as recycled paper. Currently, recycled paper has been used only for mass r~
regarding the City's Recycling Program. While the present Classic Laid pa
approximately fifteen hundred dollars less than the Environmental (Recycled) paper, tl
Manager's Office has made the decision to use recycled paper in the future for I
letterhead, envelopes and business cards. This action is part of the City's effort to e
the market and stimulate production of recycled products.
In accordance with Section 3.28.1 20 of the Municipal Code, Notice to Bidders was puk
and Request for Bids was made of nine vendors. From the four responsive bids, Printr
of Carlsbad, 5631 Palmer Way #K, Carlsbad CA 92008, was selected as the lowest
responsive bidder for the printing of letterhead/enveIopes/business cards on recycled
FISCAL IMPACT
Based upon the combined usage of City Departments and the Arts Program, the esti
costs this year will exceed $1 5,000. Departmental budgets contain sufficient funds ai
available in their respective accounts for the letterhead/envelope/business card purcb

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, APPROVING THE BID PROPOSAL
BEWEEN THE CITY OF CARLSBAD AND PRINTMASTERS OF
CARLSBAD FOR ANNUAL LElTERHEAD/ENVELOPE/BUSINESS
CARD PRINTING SERVICES
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
California, as follows:
1. That the bid of PRINTMASTERS OF CARLSBAD, 5631 Palmer Way #K, '
CA 92008, regarding the annual letterhead/envelope/business card printing on recycl
is hereby approved.
2. That an Agreement between the City of Carlsbad and Printmasters of Ca
printing services for the period of one year commencing January 1, 1991 through Dect
1991 with the option to renew for two one (1) year periods, a copy of which is attache

3. That the Mayor of the City of Carlsbad is hereby authorized and dii

AGREEMENT
This AGREEMENT, made and entered into this day of ,1991
and between the CITY OF CARLSBAD California, a municipal corporation, hereinafter referrel
as "City" and PRINTMASTERS OF CARLSBAD, hereinafter referred to as "Contractor."
Witnesseth
WHEREAS, the City does find that the proposal tendered by the Contractor for anr
printing of letterhead/envelopes/business cards on recycled paper was a responsive propc
and of high standards;
WHEREAS, the City does further find and determine that it would be in the best inter€
of the City that said proposal be accepted and the contract be awarded to the Contractor;
NOW, THEREFORE, for and in consideration of the mutual covenants and promises
the parties hereto and upon the express terms and conditions thereinafter set forth, it is agrc
by and between them, and each with the other, as follows;
1. This Agreement shall consist of and include the following document attact
hereto, as Exhibit "A', Bid Proposal.
2. The Contractor agrees to furnish all labor and materials for the printing

time of signing this Agreement.

6. The Contractor shall comply with all federal, state, county and city statutc
ordinances and regulations, including worker’s compensation and the Immigration Refo
Control Act of 1986.
7. This Agreement shall be for a period of one (1) year commencing on January
1991 and ending on December 31, 1991. At the end of one (1) year, the City has the right to
bid or renew the Agreement for two (2) additional one (1) year periods,
8. The Contractor shall also take and maintain during the life of this Agreeme
worker’s compensation insurance covering all of Contractor’s employees in a com pa
satisfactory to the City and shall furnish to the City a certificate issued by such company pr
to the beginning of this Contract.
9. It is expressly understood and agreed that the Contractor herein named in tl
furnishing of all labor and materials provided in this Agreement, is acting as an independe
Contractor and not as an agent, servant or employee of the City.
10. This Agreement of any part thereof shall not be assigned by Contractor withc
prior written consent of the City.
11. This Agreement may be amended or modified only by written agreement signc
by both parties, and failure on the part of either party to enforce any provision of this Agreeme
shall not be construed as a waiver of the right to compel enforcement of such provision
provisions.
12. The Contractor shall be aware of the requirements of the Immigration Reform ar
Control Act of 1986 and shall comply with Phose requirements, including but not limited ‘
verifying the eligibility for employment of all agents, employees, sub-contractors and consultan
that are included in this Agreement.

13. Once each year, after the first six (6) months of this Agreement, upon writte
request by the Contractor and approval of the Purchasing Officer, said prices shall be subjec
to change in accordance with the Consumer Price Index, San Diego as published by the U.:
Department of Labor, based on one-half of the percentage change in the index from the fir!
month of this Agreement to each succeeding anniversary thereof.
14. This Agreement may be terminated by either party by giving thirty (30) days writtc
notice to the other, and this Agreement shall terminate forthwith thirty (30) days following the da
such notice is given.
