RECOMMENDED ACTION:
Both the County Health Services Department and City staff
are recommending that the City Council direct the City
Attorney to prepare documents DENYING an appeal of a
finding of substandard rental housing at 3244 Harding
Street.
ITEM EXPLANATION:
Chapter 6.02 of the Carlsbad Municipal Code adopts the County code by reference on matters relating to health and sanitation. The County Health Services Department, on behalf of the City, enforces various health codes.
On May 30, 1990, Daniel and Ann Ongais, owners of the
property located at 3244 Harding Street, were notified by the County Health Services Department of numerous health and safety code violations. The owners were given 30 days to make the needed repairs. To date, the owners have made some improvements but the property is still substandard.
California Revenue and Taxation Code Section 17274 and
24436.5 requires that substandard rental units which do not comply with the State Housing Law or local codes
dealing with health, safety or building be reported to thE Franchise Tax Board if the owners do not comply within si% months of the initial notification. The Franchise Tax Board may disallow any State Income Tax deductions for interest, depreciation or taxes on the units that are not in compliance with codes. appeal the notification within ten days.
On October 30, 1990, the owners were notified by the County of impending notification of sub-standard housing to the Franchise Tax Board.
On November 21, 1990, Thomas F. Engle, attorney for the
owners, appealed the notice of sub-standard housing.
In considering this appeal, the Council needs to know some
history of the property. There are 10 units at the site. Since 1982, repeated notices of code violations have been sent to the owners. At times, violations have been corrected. compliance with health and safety codes in resolving this matter. Because the property is in substandard condition, with numerous health and safety code violations which
create a danger to the health, safety and welfare of the man, woman and children who occupy the apartments, staff is recommending denial of the appeal.

address inspected on May 14, 1990 have been declared substandard and cons1

As you will recall, staff made a presentation to the City Council on January 15,
regarding substandard conditions on the above referenced property. At that me
the Ongias' were given 90 days to bring the units into compliance. A recent inspl
was performed by both City and County staff and both agencies are satisfied wi
Ongais' progress in bringing the units up to standard.
As a result of recent progress, both County Health and the Carlsbad Building Depar
have agreed to permit occupancy of all units on the property, with the exception o
"1/2'' and "K". County Health will notify the owners that they have until March 15,
to complete all work on the two remaining units. We would not expect this issue
brought back to the City Council for any further action.

Health Services fee schedule and request the following action by Council.
On August 7, 1990, the County Board of Supervisors adopted Ordinanc which revises the fee schedule for environmental health service
level to recover current County costs in providing health servicc
attaching a copy of the new ordinance for your information.
Since your Municipal Code Sections 6.02.040 and 6.03.020 sets environmental health service fees at the same level as establisk County, no action is required by your City Council.
Our Administrative Services Manager, Steve Allee, will be happy to
questions concerning the new fee schedule. at 338-2595.
