ENG:MP CITY M RECOMMENDED ACTION: Adopt Resolution No. ?//gfl approving an agreement with the San Clara County Traffic Authority for the sale of available City Carlsbad Combined Road Plan Apportionment (CRP) funds. ITEM EXPLANATION: The City's current balance of Combined Road Plan Apportionme (CRP) funds totaling $138,449.00 is presently available for 0th qualified uses. These funds, formally referred to as Federal A Urban (FAU) funds, are annual entitlements fromthe Federal Highw Administration administered to local agencies through the State California, Department of Transportation (CALTRANS). The City allocation of CRP funds for the period through 1992 were utili2 to fund the construction of improvements to Carlsbad Boulevar south of the Agua Hedionda bridge to Tierra del Oro. This proje was completed in early 1990. Because of the difficulty, complexity, and administrative costs . utilizing CRP funds through CALTRANS for otherwise qualific projects, many agencies with small fund balances are making the: funds available to other agencies with large projects which mal the use of CRP funds more attractive. In 1989, the City ( Carlsbad purchased CRP funds from the City of Vista at a discoui of 80% and utilized the CRP funds for the Carlsbad Boulevai improvement project. The City does not have any current qualific projects to be able to utilize the $138,449.00 fund balance of C1 funds. CALTRANS, District 11 in San Diego, has indicatc previously that the Santa Clara County Traffic Authority has bec in the market for some time purchasing available CRP funds from ad agencies in the State to apply to the Authority's on-goir transportation improvement projects. The attached agreemer reflects the proposed purchase of Carlsbad' s available CRP fur balance by the Authority at the discount rate of 80%. Func received from the Authority totaling $110,759.00 are unrestrictc and may be utilized by Carlsbad for any highway construction c maintenance project. Staff recommends approval of the attachc agreement. FISCAL IMPACT: The proposed agreement between the City of Carlsbad and the Sant Clara County Traffic Authority includesthe Authority's purchase c $138,449.00 of Carlsbad CRP funds for $110,759.00 of Authorit unrestricted funds. In 1989, Carlsbad purchased Vista CRP funds a a discount rate of 80%. In some respect, the proposed curren exchange of CRP funds could be viewed as a pass-through at a equivalent discount rate of the Vista funds purchased by Carlsba in 1989. ABSENT : None. 20 21 22 23 24 25 26 27 28 1. 0 m -4 AGREEMENT FOR ASSIGNMENT OF COMBINED ROAD PLAN APPORTIONMENT (CRP) BETWEEN THE CITY OF CARLSBAD AND THE SANTA (=LARA COUNTY TRAFFIC AUTHORITY This agreement is made and entered into thiseay of * ,1991 by and between the City of Carlsbad, hereinafter referred to as "City", and he Santa Clari County Traffic Authority, hereinafter referred to as ttAuthority". WITNESSETH: WHEREAS, City wishes to assign $138,449.00 of its approved allocation o Combined Road Plan Apportionment (CEU?) funds to Authority in exchange for eightJ percent (80%) of that amount in funds that may be used for any transportation-relate( purpose; and WHEREAS, the Authority wishes to accept said assignment for use on i transportation project which qualifies for CEU? funding; and WHEREAS, the CRP funds are discounted to Authority because of expenditurc restrictions and increased administrative costs associated with using said funds; and WHEREAS, Title 23, Section 104 of the United States Code provides apportionmen for Federal-aid Systems; and WHEREAS, Section 137 of the 1987 Surface Transportation and Uniform Relocatior Assistance Act established the Combined Road Plan Demonstration Program (CRP); and WHEREAS, the State of California, Department of Transportation (CALTRANS) elected to participate in said CRP Program as per agreement with the Federal Highwaj Administration (FHWA) dated February 30, 1989; and 0 e ".- WHEREAS, said CW agreement combines all Urban, Secondary, and Non-primarq bridge funds into a single CRP fund pool; and WHEREAS, Chapter 647, State Statutes, 1990, authorizes the enactment of the CW and its operating policy and procedures; and WHEREAS, said operating policy and procedures allow CRP funds to be transferred between local agencies with the approval of the appropriate local officials; and WHEREAS, the Authority and City consider this assignment and exchange as fair and equitable treatment under the CRP program. NOW, THEREFORE, it is mutually agreed between the parties to this agreement as follows: 1. 2. City agrees to transfer $138,449.00 of its CRP fund apportionment to Authority. Authority agrees to transfer $110,759.00 to City within thirty (30) calendar days of notification of the actual transfer of the funds in Item 1 above by the State of California Department of Transportation (CALTRANS).
