HR CITY RECOMMENDED ACTION: Adopt Resolution No. 9r-65 , authorizing the destruction of Human Resources Department employment applications and employment lists. ITEM EXPLANATION: The Human Resources Department of the City requests authority to destro) applications and employment lists dated prior to March 1, 1989. The Human Resources Department as a result of continuing recruitment, accumulates several thousand applications per year. These applications are filed and stored by year and position. Maintaining these records is noi economical nor necessary. In order to destroy these records the Human Resources Department needs City Council approval and written consent of the City Attorney. Government Code, Section 34090; Title 2 of the California Code of Regulations, Section 7287; and Title 29, Chapter 14, Code of Federal Regulations, Section 1602.3, Local Government Recordkeeping. This request coincides with the practices of other cities and the county. FISCAL IMPACT: Fiscal impact is negligible as the files are destroyed by employees. The reduction of file space requirements provides some cost savings. EXHIBITS: 1. 2. This action is required by State of California City Attorney memorandum to the Human Resources Director. WHEREAS, the maintenance of accumulated obsolete employment applications and employment lists is uneconomical; and WHEREAS, once expired these applications and lists cannot be used; and WHEREAS, all employment applications and employment lists produced prior to March 1, 1989, are of no further use; and WHEREAS, this authorization is in compliance with the State of California Government Code, Section 34090; Title 2 of the California Code of Regulations, Section 7287; and Title 29, Chapter 14, Code of Federal Regulations, Section 1602.3, Local Government Recordkeeping . NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. The above recitations are true and correct. 2. Box 2056 Carlsbad, California 92008 RE: INRE: CHRISTMAN Dear Mr. Irving: The City Council is tentatively scheduled to hear the recommendations of the Personnel Board in the matter of the Christman hearing on March 5, 1991. At that time, the City Council will review the findings an recommendations of the Personnel Board pursuant to Carlsbad Municipal Code Section 2.44.027. The City Council shall review the findings and recommendations of the Personnel Board and may then affirm, revoke or modify that action. The action of the City Council shall be final. (Personnel Rules, XVI, Section 6). The City Council will be provided with a transcript of the hearing before the Personnel Board, and its written recommendations and all evidence and arguments adduced in connection with the hearing. No new evidence will be allowed nor should additional arguments be necessary since thos have been made before the Personnel Board. If you feel additional arguments are necessary, please let me know the reason therefor and submit them in writing to this office at least eleven (1 1) days prior to < Council consideration of this item. I will make them part of the Council package if appropriate.
