MTG. 3/5/91 ZONE 18 - LOCAL FACILITIES MANAGEMENT PLAN CITY 1 DEPT. GM CITY I RECOMMENDED ACTION: The Planning Commission and staff are recommending that the City Council adc Resolution No. Ct I - 7 I’ approving the Negative Declaration issued by the Planni Director and adopt Resolution No. C;I -7 c approving the Local Faciliti Management Plan for Zone 18. ITEM EXPLANATION Zone 18 is the twelfth property owner-initiated and privately prepared Lo( Facilities Management Plan to be heard by the City Council. On December * 1990, the Planning Commission unanimously approved this plan as described the minutes from the Planning Commission meeting attached as Exhibit 5. There is one existing dwelling unit in the Zone and no approved projects. 1 projected residential buildout of the Zone is 2,091 dwelling units, which is fully compliance with Proposition E and the Citywide Facilities and Improvements PI; The Plan is a regulatory document which analyzes all eleven public facilities determine whether they conform with the adopted performance standarc Several facilities are identified as requiring upgrading in order to accommodi future development in the zone. Therefore, specific conditions of approval h; been included in the Plan to guarantee that all of the public facility standards i continue to be met through buildout of the Zone. The conditions state that, prior to the first final map or issuance of a grading per1 or building permit, whichever occurs first in Zone 18, a Financing Plan must approved by the City guaranteeing funding for construction of all public faci improvements identified in the Local Facilities Management Plan. Until t financing mechanism has been approved by the City, no development will OQ within Zone 18. The complete wording of the conditions is included in the Pla Executive Summary which is attached as Exhibit 3. Two new conditions which should be highlighted are General Conditions 10 i 1 1. Condition No. 10 states that participation in the proposed Mello-Roos Distr or an alternative acceptable to the City Council, is necessary in order to find i development in the zone to be consistent with the General Plan. Condition No. requires participation in the financial guarantee for Palomar Airport Road Eas Subsequent to the Planning Commission’s hearing of the plan, it was determir that the Executive Summary should be revised. The new Executive Summary I been included in place of the previous version. The revision makes no substan changes in the plan and is intended only to clarify the facilities requireme placed on the zone. a e I Page Two of Agenda Bill No. 11 i T 5 7 ENVIRONMENTAL REVIEW A Negative Declaration was issued by the Planning Director on September 2 1990, indicating that the Local Facilities Management Plan for Zone 18 is nl anticipated to have any adverse impacts on the environment. The Negath Declaration was recommended for approval by the Planning Commission c December 19, 1990. The Local Facilities Management Plan for Zone 18 will not cause any significa environmental impacts. The Plan is a public facilities planning document th implements Carlsbad’s General Plan. The Plan makes generalized projections i to the demand for and supply of public facilities and outlines the provision adequate public facilities concurrent with the estimated demands. The PI recognizes that further environmental review pursuant to the Califorr Environmental Quality Act will be required prior to the development of any put= or private project that is generally discussed in this plan. FISCAL IMPACT Staff time has been utilized in the preparation of this Plan. These costs will recovered through the processing fee established by the City Council. It anticipated that further staff time will be necessary to monitor this Plan and otk zone plans on a yearly basis. Executive Summary The purpose of this document is to provide a plan for supplying the public facilitie that will be needed to accommodate development within the Zone 18 area of th City of Carlsbad, in accordance with the City’s Growth Management Program. Th plan has been prepared in accordance with Chapter 21.90 of the Carlsbal Municipal Code and the Citywide Facilities and Improvements Plan of 1986. Development Assumptions The first step in developing such a plan is to estimate the amount of developmer both residential and nonresidential, that will be allowed in the zone. The types ( land uses assumed for the zone are those shown in the Carrillo Ranch Master PI2 and the Carlsbad General Plan. Exhibit 7 on page 32 shows the location of tP various land uses within the zone. To determine the developable acreage, the followii constrained lands were deducted: Major Power Line Easements Future Right-of-way for Circulation Element Roads Railroad Right-of-way Slopes Greater Than 40% Riparian Woodland Wetlands Floodways Permanent Bodies of Water Future School Sites Other Environmental Features 1 , 4 0 0 fi In addition, it is assumed that slopes of 25% to 40% may be developed at half thi usual density. Using this methodology it was estimated that approximately 2,09 dwelling units could be constructed within Zone 18. The actual number of unit that are ultimately constructed in the zone may vary. However, the estimate i useful and valid for purposes of this plan and is consistent with all applicabl requirements of the Growth Management Program, particularly Proposition El For nonresidential development, it is assumed that building coverage would b 30% of the net developable acreage. This method yields an ultimate nonresidentii development estimate of approximately 2,702,463 sq. ft. Again, this is only i estimate or assumption for facility planning purposes. Actual nonresidenti development may vary. The plan includes phasing schedules which indicate the property owner proposed amount of development for each year from 1991 to 201 4. The proper owners are not required to adhere to this phasing, and it is intended for facili planning purposes only. The phasing schedules (Exhibits 14 through 18) al: include the projections for other zones with adopted Local Facilities Manageme Plans. The schedules are used to determine approximate threshold years f constructing or upgrading various public facilities to maintain compliance with tl Performance Standards in the Growth Management Program. The threshold yea arrived at in this way are only projections for facility planning purposes. The actL thresholds must be monitored as development takes place in this zone. Facilitii may be needed sooner or later than the threshold years shown in this pla depending upon the actual timing of development. Zone 18 Requirements for Public Facilities The development assumptions outlined above are used to estimate the dema for public facilities generated by development in Zone 18 based on the elev adopted Performance Standards in the Growth Management Program. T following table (Exhibit 2) shows the current status of each facility with respect the Performance Standard, given the existing amount of development in the zo Because there is currently a limited amount of developed land in Zone 18 . public facility demands are presently minimal, and all eleven Performar Standards are currently being met. In order to assure compliance with the Performance Standards as developml occurs in the zone, the Plan contains specific conditions of approval which ( listed in the following two exhibits. Exhibit 4 contains the General Conditions wh 2 I e e 4 4 are applicable to all zones of the City. Exhibit 5 contains Special Conditions fo Zone 18. The Special Conditions state each facility which must be providec whether it must be financed or constructed, and when it must be provided. The following is a list of the public facilities required to serve development in Zonl 18. This chart shows whether the facility would otherwise be provided as i condition of approval of a development project or whether a special fundin! mechanism is needed. Ci Administrative Facilities. Special funding mechanism is required. At tht present time, a Mello-Roos Community Facilities District is proposed. Library. Special funding mechanism is required. Condition of approval of development project. 3 I e 0 Financinq for Facilities Section 21.90.1 1 O(3) of the Municipal Code requires that Local Facilitie Management Plans contain a discussion of various methods of funding the facilitis and improvements identified in the plan. This plan for Zone 18 provides a generi discussion of the estimated costs for each facility and one or more possibli methods of funding. However, the City is considering a Mello-Roos Cornmunit Facilities District (CFD) for some Citywide facilities, and this District is not yc formed. Other proposed funding mechanisms require agreements or financinl instruments which have not yet been identified. Therefore, the financing discussio in this plan must be considered preliminary and not fully meeting the requirement of Section 21.90.1 lO(3). In order to allow orderly and appropriate planning activities to continue for Zon 18, and to permit the property owners to exercise certain property rights while th planning effort takes place, it is recommended that this Local Facilitie Management Plan be approved subject to the condition that a Financing Plar which fully meets the requirements of Section 21.90.1 1 O(3) be submitted by thf property owners and approved by the City prior to finaling any subdivision mal or issuance of any grading permit or building permit, whichever occurs first withir Zone 18. In addition, General Condition No. 10 states that participation in th( proposed Citywide CFD, or an alternative acceptable to the City Council, i! necessary in order to make the finding of consistency with the Public Facilitie: Element. All development within Zone 18 shall conform to the provisions of Section 21.90 of t Carlsbad Municipal Code and to the provisions and conditions of this Local Facilit Management Plan. All development within Zone 18 shall be required to pay a public facilities fee pursua to the standards adopted by the City Council on July 28, 1987, and as amended frc time to time and all other applicable fees. Development in Zone 18 shall also necessary to enable facilities to meet the adopted performance standard. The City of Carlsbad shall monitor all facilities in Zone 18 pursuant to Subsectia 21.90.130(c), (d) and (e) of the Carlsbad Municipal Code. All development in Zone 18 shall be in conformance with the adopted Citywide Faciliti and Improvements Plan as adopted by City Council Resolution 8797 on September 2 1986. Periodic amendment to the Zone 18 Local Facilities Management Plan is anticipated incorporate newly acquired data, to amend conditions and upgrade standards determined through the required monitoring program. Amendment to this Plan may 1 initiated by action of the Planning Commission, City Council or property owners at a time. If a public facility or service is found not to be in conformance with an adopt performance standard during the yearly monitoring, or at any other time, the matter w be immediately brought before the City Council. If the City Council determines that non-conformance does exist then no future building or development permits shall t issued unless an amendment to the CFIP or the LFMP for this zone is approved by tl City Council which addresses those facility shortfalls and brings those facilities in conformance with the adopted performance standards. After adoption of this Plan by the City Council, no building permits will be allowc unless the performance standards are complied with. Approval of this LFMP does not constitute prior environmental review for projec within Zone 18. All future projects within Zone 18 shall undergo environmental revie per Title 19 of the Carlsbad Municipal Code. If the Mello-Roos Community Facilities District is not formed, or the Community Facilities District is formed but the Zone 18 properties are nc participants within that district, the required General Plan Consistency finding cannc be made. No discretionary approvals, Building Permits, Grading Permits, Final Map or development permits will be issued or approved unless an alternate financin mechanism is provided by the developer and approved by the City Council to financ the facilities legally applicable to Zone 18 that would have beedor are included i the Community Facilities District. For purposes of this condition, the Mello-Roc District will be considered to be formed following an affirmative vote of the properf owners plus a 30 day period as prescribed by law to provide for any protest regardin formation of the District. Prior to the first discretionary action, approval of the first development permit c issuance of a grading permit or building permit, whichever occurs first for any projei within Zone 18, the property owner(s) shall provide a financial guarantee for thl construction of Palomar Airport Road East. This guarantee may be in the form c participation in any existing Assessment District or Mello-Roos Community Facilit District formed to finance the construction of the road segment, participation in th existing forward funding agreement as applied to Zone 5 property owners, or a alternate financing plan acceptable to the Finance Director and City Attorney. WASTEWATER TREATMENT CAPACITY The following actions shall be pursued jointly by each sewer district to ensure adequ wastewater treatment capacity through the year 2000: A. Monitor Encina treatment plant flows on a monthly basis to determine actual flow ra and to have an early warning of capacity problems. PARKS A. Prior to the recordation of a final map within Zone 18, a parks agreement between City of Carlsbad and Zone 18 property owners shall be entered into and shall include following provisions: 1. The secured dedication of 8.5 acres of park land with the execution of t agreement at a location to be determined acceptable to the City. Provide a plan which establishes acceptable access to these park sites subjecl the approval of the Planning Director and the City Engineer. The Parks Agreement must be consistent with the requirements af the Cit Growth Management Program. If any reimbursements and/or park-in-lieu fee credits are to be given, the Pa Agreement shall provide a mechanism to do so. 2. 3. 4. B. The inten plan is ro establish parameters and thresholds that assure public facilities are available when ne derermined by the Civs adopted performance standards, TO accomplish this purpose occa locations and costs of public facility improvements are estimated for informational purposes. Traditionally, the developer in maximizing their capital return passes such fees on to the home tenant. This results in higher priced housing which affects the availability of low and moderate housing. However, as real estate value is determined primarily by location, without other incentives, it is unreasonable to assume the subject property would be developed with eithe moderate income housing due to its proximity to the Pacific Ocean and the La Costa Area. Commissioner Erwin inquired if Mr, Hofman had read the letter the Commission had received from Carrillo Ranch dated December 4, 1990. Mr. Hofman stated that he had not seen the letter and a copy was given to him. Brian Hunter, Senior Planner, stated that the letter from the Friends of Carrillo Ranch regarding relocation of two pillars near the entrance to the ranch refers to City-omed property. After reading the Carrillo Ranch letter, Mr. Hofman stated that the issues in the letter are ones which have to be addressed at the time of development and have no bearing on the LFMP for Zone 18. Commissioner Schlehuber requested Steve Jantz, Associate Engineer, to discuss the "F" intersection at Palomar Road and the "E" intersection at El Fuerte. Mr. Jantz replied that the City currently has an action plan to improve the intersections at Palomar Road and El Fuerte during the latter part of 1991. Before development can proceed in Zone 18, these intersections must be corrected. William Dougherty, 2600 La Golondrina, Carlsbad, addressed Zone 18 which shows that the riparian area is much larger than what is shown in the zone plan and extends beyond the gates to the Carrillo Ranch. In addition, a vernal pool whirh exists in Zone 18 is not indicated in the staff report. The riparian area extends from the lower dam up to the Willow Woods. The planned Melrose improvement would run through the center of the wooded area and will require 40 ft. of fill for the road bed. Mr. Dougherty believes that a bridge will be needed to enable some type of trail through the area and to avoid a high animal kill. He is also concerned that the proposed school site is located in a floodplain which is forbidden by state law. Further, he believes the Melrose extension will be an eyesore from the Carrillo Ranch because it will be elevated 120 ft.
