RECOMMENDED ACTION:
Hold the public hearing concerning the establishment of sewer service fee
establishment of funds, pre-treatment fees, and full cost recovery for sewer later
installations as recommended in City of Carlsbad Wastewater Revenue Progra
September, 1990.
Introduce Ordinance No. 0s - 1.13 adjusting sewer service fee assessment method
Adopt Resolution No. ?I -a% setting sewer service fees to be effective June 1, 1993
ITEM EXPLANATION:
The Sewer Enterprise Fund is dependent on sewer service fees and Lateral Installatic
fees for its support. No general fund revenues are dedicated to the operation and/
maintenance of the sewer system,
Since 1985, Sewer Operating Costs have increased 90°h, while operating revenues ha.
increased only 42%. This increase has been absorbed within the existing rate structu
with deficits occurring in ETs 1988-89, 89-90 and 90-91, which were subsidized '
sewer operating reserves.
On December 19, 1989, the City Council authorized a sewer rate study. The objecti
of the Study was to examine the financial position of the Sewer Enterprise Fund,
value the assets of the Fund and to recommend fair and equitable sewer rat
consistent with regulatory guidelines. Rates were to be determined on a cost of servi
basis so that customers pay charges in proportion to the services used.
The Sewer Rate Study, prepared by James M. Montgomery, Consulting Enginee:
Incorporated, was accepted by Council on December 18, 1990, and directed staff
prepare the required ordinances for Council consideration at a noticed Public Heark
Staff recommends City Council approve a monthly residential sewer rate of $11.!
which includes depreciation of 100% of historic asset value. This is a 58% increa
over present rates. This proposed rate is comparable with current sewer servi
charges in other cities (see Exhibit 3 and 4). Staff further recommends that the Ci
Council approve the recommendations concerning the establishment of funds, PI
treatment fees and full cost recovery for sewer lateral installation.

When the Waste Water Revenue Program was first presented to the City Council il
December, 1990, Council directed staff to investigate the feasibility of establishin;
senior citizen or "lifeline" rates. Staffs research has indicated that, according to Federa
income users. Thus, lifeline rates based on age are not permitted. Further, staff doe
not recommend the implementation of a lifeline reduced charge for low incom
residents because such a system would be cumbersome and costly to administer an1
would require that all other users proportionally subsidize the revenue loss. (Se
Exhibit 5).
ENVIRONMENTAL IMPACT:
The City of Carlsbad Planning Department has found that pursuant to Section 1527
of Division 6 of Title 14 of the California Code of Regulations, the restructuring of th
sewer fees to meet operating expenses is exempt from the provisions of the Californi
Environmental Quality Act.
FISCAL IMPACT:
Current sewer service rates do not provide sufficient revenues to pay for operating an
depreciation expenses. The proposed increase in sewer service rates will provide a
additional $1.2 million in annual revenue to the Sewer Enterprise Fund. The new rate
will generate sufficient revenues to cover current operating expenses and fund th
replacement of existing sewer lines and equipment.
Fees for services are set by the City Council to recover all or part of the cost (
providing certain services to individuals or organizations benefitting from the servicc
and not on ability to pay.

"SUSPENDED SOLIDS" or "SS" means solids that either float on
the surface of, or are in suspension in water, sewage or other
liquids; and are largely removable by laboratory filtering and as
determined by the appropriate procedure in Standard Methods.
"GROUP I RESIDENTIAL DISCHARGER" means any single or
multiple family residential dwelling.
"GROUP II COMMERCIAL DISCHARGERS" means any commercial
discharger whose annual wastewater discharge consist of
biochemical oxygen demand plus suspended solids (added
together) equaling 400 milligrams per liter or less. Typically, this
will include car washes, retail stores, hospitals, laundromats,
professional offices, softwater services, warehouses and theaters.
"GROUP III COMMERCIAL DISCHARGERS" means any
commercial discharger whose annual average wastewater
discharge of biochemical oxygen demand plus suspended solids
(added together) of more than 400 milligrams per liter and less
motels (without restaurants), repair and service stations,
manufacturing, and lumber yards.
"GROUP lV COMMERCIAL DISCHARGER" means any commercial
discharger whose annual average wastewater discharge consists
of biochemical oxygen demand plus suspended solids (added
together) equaling 1000 milligrams per liter or more. Typically,
this will include bakeries, hotels-motels (with restaurants),
restaurants and supermarkets.
"GROUP V INSXITUTIONAL DISCHARGERS" means schools,
Social Service Halls, membership organizations and other users
who are determined equivalent by the Director.
"GROUP VI LARGE VOLUME DISCHARGERS" means users whose
wastewater discharge quantity amount to more than 25,000
gallons per day on an average annual basis.
"INDUSIWAL PRETREATMENT CLASS I CUSTOMERS" means
any user subject to federal categorized pretreatment standards
and requires quarterly inspection and annual permits.
"INDUSIWAL PRETREATMENT (=LASS II CUSTOMERS" means
any non-categorical users discharging wastewater which may
cause pass-through or interference with the system, or contain
components as determined to be regulated and requires semi-
annual inspections and permits every two years.

Group I residential dischargers shall be charged a flat raIe amounr per
billing period. The flat rate amounts for multiple family housing shall be
administered according to the number of residential units per water meter.
All other discharger groups shall be charged a unit rate per hundred cubic
feet (HCF) of water usage or a minimum charge whichever is greater. Each
discharger group shall have a separate unit rate per hundred cubic feet of water
usage or minimum charge, whichever is greater. Each Group VI large volume
discharger shall have a separate unit rate per hundred cubic feet of water usage
or a minimum charge, whichever is greater. The City of Carlsbad Fee
Resolution shall stipulate the unit rates and minimum charges based on
wastewater quality and quantity.
Schools shall be charged on the basis of average daily attendance (ADA)

the Carlsbad Municipal Code shall pay a fee to the City for inspection and
control. The Encina Administrative Agency (EAA) shall determine the minimum
number of inspections per year for each permittee as necessary for the proper
enforcement of this chapter. The inspection fee shall be included with the
sewer service charge in an amount specified in the Carlsbad fee resolution
according to the rninimum number of inspections determined by the EAA and
applied throughout the twelve month year. The same enforcement provisions
shall apply to the collection of such fees pursuant to this chapter.

is amended by the addition of Section 13.12.090 to read as follows:

13.12.090 ADJUSTMENT OF CHARGES
(A) FILING FOR AN ADJUSI'MENT OF mGES

WHEREAS, the City Council of the City of Carlsbad has the authority tc

Six (6) classes of customers will be categorized by quality of wastewater. These are Grol
I - Residential; Group 11 - Low Strength Commercial; Group 111 - Medium Streng
Commercial; Group IV - High Strength Commercial; Group V - Institutional and Group V
Large Volume Users.
Low strength users are those whose combined strength expressed in terms of biochemic
oxygen demand (BOD) and suspended solids (SS) is less than 400 milligrams per Lit
(mg/L). This group includes car washes, offices, retail stores, laundromats, warehousc
hospitals and convalescent homes, and indoor theaters.
Medium strength users are those whose combined strength is at least 400 mg/L but 1c
than 1000 rng/L. This group includes hotels/motels without restaurants or kitchel
service stations, shopping centers, commercial laundries and industrial users.
High strength users are those whose strength is 1000 mg/L or greater and includ
restaurants, bakeries, food processors, supermarkets, mortuaries and hotels WI
restaurants.
Institutional users are schools and membership organizations like churches and SOC
service clubs.
Large volume users are customers who use in excess of 25,000 Gallons Per Day (GPI

INDUSTRIAL PRETREATMENT FEES
The City of Carlsbad is assessed by Encina Administrative Agency (EAA) for costs incurre
in administering the pretreatment program.
Customers with pretreatment facilities are grouped into classes depending upon the numb€
of inspections required during a year. Class I facilities require quarterly inspections an
an annual permit while Class 111 customers require annual inspections and a three-ye:
permit.
Class I $3,000 per year $250 per month
Class I1 $1,800 per year $150 per month
Class 111 $300 per year $25 per month
The City Council, from time to time, will review and adjust fees to recover costs for the:
services.
SEWER LATERAL INSTALLATION
To ensure actual costs for such services are recovered, a deposit of $2,500 per later;
installation shall be required.

At the public hearing on wastewater rates, the issue of providing lower rates to certai
sections of society was raised by Councilwoman Kulchin. Staff was directed to investigat
the feasibility of establishing special or lifeline rates for senior citizens. This memorandux

It should be emphasized that differentiation is based on income alone and not on the bas:
of age. This deviation allows reduced charges for users based on income alone. The Cit
may therefore enact legislation to provide relief to "low income" users. The EPA definitio
of low income residential users is any residence with a household income below th
Federal poverty level as defined in 45 CFR 1060.2, or any residence designated as 101
income under State law or regulation. The City may establish its own definition of lov

income subject to approval by the State Water Resources Control Board which administe~

guidelines established by the State Department of Ecomomic Opportunity.
The lower charge rate for low income residential users must be defined as a unifon
percentage of the user charge rate charged other residential users. The amount of any co:
reductions afforded to the low income users must be proportionately absorbed by all otht
user classes.
