THIS LETTER CONCERNS THE PROJECT TO
CONVERT OVERHEAD LINES TO UNDERGROUND ON
CARLSBAD BOULEVARD 20A CONVERSION
Our Construction Department has reviewed the final underground electric order for this project and analyzed their construction time requirements. They estimate 75 working days to complete the project as outlined below:
Trench and Substructures ................................ 45 working days (includes conduit, splice boxes and equipment pads)
Cable, transformers and services overhead removals ............. 20 working days
Overhead removals .................................... 10 working days
NET CONSTRUCTION TIME: .............................. 75 working days
Based on the proposed schedule, we have tentatively scheduled our crews to start construction April 1, 1991. The 15 week construction time frame would establish July 5, 1991 as the completion
date for our portion of the project. With the information available at this time, I would recommend May 10, 1991 as the customer-ready date. This is also the date at which time all traffic signals should be converted and street lights installed and ready to receive service.
Please call Denise Richards of Pacific Bell at 586-3812 to confirm the date she will be ready to remove the overhead poles. That date should be established as the pole removal date.
The final estimated cost for our portion of the project is $71 8,684. Please update your records. We will file a complete report on the project when the work is finished.

SYSTEM IN UNDERGROUND UTILITY DISTRICT NO. 11
OF CARLSBAD, CALIFORNIA, SETTING THE TIME TO
WHEREAS, on May 22, 1990, the City Council of the City of
Carlsbad adopted Resolution No. 90-150 establishing Underground
Utility District No. 11; and
WHEREAS, Section 11.08.030 of City Code requires that property
owners be notified of the time to be ready to connect to the
underground system by subsequent resolution; and
WHEREAS, the underground system is to be completed by June 10,
1991, and overhead poles are to be removed by July 15, 1991.
NOW, THEREFORE, BE IT RESOLVED as follows:
1. That the date on which affected property owners must be
ready to connect to underground service is May 10, 1991.
2. That a certified copy of this resolution be recorded in
the County Recorder's Office and also mailed to each affected
property owner.

CONNECI'ION TO UNDERGROUND UTILITIES
Please be advised that the date by which you must be ready to connect to the underground
utilities is May 10, 1991. These utilities include electric, telephone and cable television.
The hiring of a contractor, obtaining a permit and paying the cost of connection to private
property is the responsibility of the property owner.
You should have received notice of this connection date several weeks ago from San Diego
Gas & Electric Company.
If you have any technical questions about how to connect and location of service, please
call Al Manzano, SDG&E, at 581-7114. If you have any processing or general questions,
please call Richard Allen, City of Carlsbad, at 438-1161, extension 4389.

UNDERGROUND UTILITY DISTRICT NO. 11
This letter is to notify you that at a public hearing held by the City Council on May 22, 1990, the City
Council approved the formation of Underground Utility District No. 11. This district, which includes
property for which you are listed as owner, contains portions of Carlsbad Boulevard and Cannon Road
and all of Tierra del Oro Street and Shore Drive. A boundary map is attached.
The City Code requires that you be notified by sending you a copy of the approved Resolution and a
copy of the pertinent City Code, both of which are attached. In summary, the pertinent facts are:

The district has been formed and utility agencies have been notified to begin design work.
The schedule is currently not certain but design work must be completed before construction can
begin. The best estimate at this time is that construction may begin in December 1990.
It is the property owner’s responsibility to provide the appropriate underground services from the
street right-of-way to the building at the owner’s expense.
Please note that once design is completed, Council must pass another resolution specibng a date
of connection and you will be notified again prior to start of construction of the actual time to
connect to the underground system.

DESIGNATING A CERTAIN PART OF SAID CITY AS UNDERGROUND UTILITY DISTRICT NO. 11 AND MAKING ORDERS IN REGARD THERETO
WHEREAS, on April 17, 1990, the City Council of the City
Carlsbad adopted Resolution No. 90-110 expressing its intent
initiate proceedings pursuant to Chapter 11.08 of the Carlsb
Municipal Code and calling a public hearing to determine wheth
or not the public health, safety or welfare requires the formati
of an underground utility district in a portion of Carlsbad; ant
WHEREAS, pursuant to Resolution No. 90-110, a public heari
was held on May 22, 1990, at the hour of 6:OO p.m., in the Counc
Chambers in the City Hall, Carlsbad, California, to ascerta
whether the public health, safety or welfare requires the removt
of poles, overhead wires and associated overhead structures and tl
underground installation of wires and facilities for supplyii
electric, communication or similar or associated service, with
that certain area of the City described as follows:

reference herein.
WHEREAS, said hearing was also held to determine whether (
not the City should continue proceedings to create and implemei
an underground utility district to accomplish said removal ar
installation; and

WHEREAS, notice of said hearing, in the manner and for tt,
time required by law, was given to all affected utility companie
and to property owners as shown on the last equalized assessmen
roll; and

WHEREAS, said hearing has been duly and regularly held, ar
all persons interested have been given an opportunity to be heard
NOW, THEREFORE, BE IT RESOLVED by the City Council of the Cit
of Carlsbad, as follows:
1. That the above recitations are true and correct.
2. That the City Council of the City of Carlsbac
California, hereby finds and determines that the public healtp
safety and welfare require the removal of poles, overhead wires ar
associated structures, and the underground installation of wire
and facilities for supplying electric, communication or similar c
associated service in the above-described area.
3. That said area is hereby declared to be an undergroun
utility district, and is designated as Underground Utility Distric
No. 11 of the City of Carlsbad.
4. That the City Council finds that said District is in th
public interest for one of the following reasons:
A. It will eliminate an unusually heavy concentratic
of overhead electric facilities.
The streets in the District are extensively used k

The streets adjoin or pass through a civic or publi

associated service by means of electrical mate-

11.08.030 Designation of underground utility
districts by resolution.
If after the public hearing the city council
determines that the city or a public utility has
agreed to pay over fifty percent of all costs of
conversion, excluding costs of users’ connections
to underground eiectric or communication fad-
ities and that the public health, safety and welfare
requiressuch removal and underground installa-
tion, the city council may by resolution deciare
the area an underground utility district and order
the work. Such resolution shall include a descrip-
tion of the area comprising such disuict and shaU
provide that the council shall fix by subsequent
resolution, the time within which such removal
and underground installation shall be accom-
plished, having due regard for the avadability of
labor, materials and equipment necessary for
such removal and for the installation of such
utility districts by resolution.
11.08.010 Definitions.
Whenever in this chapter the words or phrases
hereinafter in this section defined are used, they
shall have the respective meanings assigned to
them in the following definitions:
(1) “Commission” means the Public Utilities
Commission of the state of California;
(2) “Poles, overhead wires and associated
overhead structures” mean poles, towers, sup-
ports, wires, conductors, guys, stubs, platforms,
crossarms, braces, transformers, insulators, cut-
outs, switches, communication circuits,
appliances, attachments and appurtenances
located aboveground within a district and used
or useful in supplying electric, communication
or similar or associated service;
(3) “Underground utility district” or “dis-
trict” means that area in the city within which
poles, overhead Wires, and associated overhead
structures are prohibited as such area is described
in a resolution adopted pursuant to the provi-
sions of %on 11.08.030;

11.08.080 Responsibiiity of utility

(d) The notice to provide the required under-
ground facilities may be gven either by personal
senice or by mail. In case of service by mail on
either of such persons, the notice must be depos-
ited in the United States mad in a sealed envelope
with postage prepaid, addressed to the person in
possession of such premises at such premises,
and the notice must be addressed to the owner
thereofas such omerjs name appears, and muSt
be addressed to such owner’s last known address
as the same appears on the last equalized assess-

been sent within forty-eight hours after the mail-

owner or occupant of such premises, the city

a card not less than eight inches by ten inches in
size, to be posted in a conspicuous place on the
premises.
(e) The notice given by the city engineer to
provide the requved underground facliities shall

11.08.090 Responsibility of property ownen.
(a) Every person owning, operating, leasing,
occupying or renting a building or structure
within a district shall construct and provide that
portion of the service connection on his property
between the facilities referred to in Section
11.08.080 and the termination facility on or
withn said building or strumre being served, all
in accordance with applicable rules, regulations
and tariffs of the respve utility or utilities on
file with the commission.
(b) In the event any person owning, operat-
ing, leasing, occupying or renting said property
under its appiicable m1es, rqu1ations and tariffs merit roil, and when no address appears, to

notice, the city engineer will provide such
required underground facilities, in which case
the cost and expense thereof will be assessed
awnst the property benefited and become a lien
upon such property.
(f) If upon the expiration of the thirty day
period, the required underground facdities have
not been provided, the city engineer shall forth-
with pro,-- to do the work; provided, however,
if such premises are unoccupied and no electric
or communications services =e being furnished
ing the required underground facilities, have the
authority to order the disconnection and

to the property. Upon completion of the work by
the city engineer, he shall file a written report
with the city council setting forth the fact that the
required underground facilities have been pro-
vided and the cost thereof, together with a legal
description of the property against which such
cost is to be assessed. The council shall thereupon
fix a time and place for hearing protests against
the assessment of the Cost of such work upon
such premies, which said time shall not be 1%
than ten days thereafter.
(g) The city engineer shall forthwith, upon the
time for hearing such protests having been fixed
give a notice in writing to the person in posses-
sion of Such Premises, and a notice in writing
thereof to the owner thereof, in the manner here-
inabove provided for the giving of the notice to
provide the required underground facilities, of
the time and place that the council will pass upon
such report and will hear protests against such
assessment. Such notice shall ais0 set forth the
amount of the proposed assessment.
(h) Upon the ciate and hour set for the hearing
of protests, the council shall hear and consider
the report and all protests, if there be any, and
then proceed to affirm, modify or reject the
assessment.
(i) If any assessment is not paid within five
days after its confirmation by the cound, the
amount of the assessment shall become a lien
upon the Property against which the =SSment
is made by the city engineer, and the city
engineer is directed to turn Over to the assessor
and tax COlleCtOr a notice Of lien On each Of the
properties on which the assessment has not been

bill for taxes levied against the premises upon
which said assessment was not paid. The assess-
ment shall be due and payable at the same time as
the property taxes are due and payable. and if not
paid when due and payable,shall bear interest at

11.08.100 Responsibiiity of City.
The city shall remove at its own expense all
city-owned equipment from all poles required to
be removed under this chapter in ample time to
enable the owner or user of such poles to remove
the same Within the time specified in the reSOh-
tion enacted pursuant to Secton 11.08.030. (Ord.

11.08.1 10 Extension of time.
In the event that any act required by this chap
ter or by a resolution adopted pursuant to
Section 11.08.030 cannot be performed within
the time provided on account of shortage of
materials, war, restraint by public authorities,
strikes. labor disturbances, civil disobedience, or
any other circumstances beyond the control of
the actor, then the time within which such act
will be accomplished shall be extended for a
period equivalent to the time of such limitation.
