RECOMMENDED ACTION:
Adopt Resolution No.% * 133 establishing the value of land in each park quadrar
for the purpose of computing fees in-lieu of land dedication for park purposes
fTEM EXPLANATION:
Chapter 20.44 of the Carlsbad Municipal Code establishes the rules for t€
dedication of land for recreation purposes as allowed by the Subdivision Map Ac
Under this chapter, the City may require that, “as a condition of approval of
final map or parcel map, the subdivider shall dedicate land, pay a fee in lif
thereof, or both, at the option of the City, for park purposes ...If The dedicatic
of land is based on a formula that specifies that “three acres of property for ea( one thousand persons residing within this City shall be devoted to local parks a1
recreation purposes.” The code also contains the standard number of people p
dwelling unit type used to calculate the dedication requirement.
As an example, let‘s assume that a developer is going to build 100 single-fam
detached houses. The code indicates that the City assumes that 3 people will li
in each house, giving a population increase of 300 people. Since we requ
three acres per 1000 population, we can compute the amount of land tl
development would be required to dedicate (or pay fees in lieu of dedication)

The developer must dedicate .9 acres of land or pay a fee to the City equal to
value of .9 acres of land so the City can acquire land elsewhere to meet the p

It becomes clear that in cases where the City does not desire the dedicatior
land, it is necessary to collect the appropriate fee to ensure that sufficient fu
will be available to purchase land at a future date. Section 20.44.080 provi
the method by which the Council may set the value of land for the purpose:

The Code allows the Council to set the value of park land to the current ma
value for similar land in each quadrant of the City. The market value mal

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, ESTABLISHING THE VALUE OF
PARKLAND IN EACH QUADRANT OF THE CITY FOR USE IN
CALCULATION OF PARK-IN-LIEU FEES
WHEREAS, Section 20.44.080 of the Carlsbad Municipal Code establish
the procedure for determining the value of park property used in computing par
in-lieu fees, and
WHEREAS, the City Council may from time to time revise said propel
values through the procedures described in the above section of the MuniciI
Code, and
WHEREAS, the City has determined the values of property within the fc
quadrants of the City as required in Section 20.44.080 of the Municipal Cod
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
Carlsbad, California, as follows:
1. That the above recitations are true and correct.
2. The property values for the purpose of computing park fees for pi
