WHEREAS, on April 3, 1991 the Carlsbad Pla
Commission held a duly noticed public hearing to consic
proposed Conditional Negative Declaration, Local Coastal
Amendment (LCPA 90-2) and General Plan Amendment (GPA 90-1)
for development of a 121,388 square foot Price Club discount 2
on approximately 26 acres of land generally located on the
side of Palomar Airport Road east of Paseo Del Norte. A
conclusion of the hearing the Commission adopted Resolutions
3205, 3207 and 3206 recommending to the City Council tha
Conditional Negative Declaration, Local Coastal Plan Amer
(LCPA 90-2) and General Plan Amendment (GPA 90-1) be approvec
WHEREAS, the City Council of the City of Carlsbad, (

Also proposed is a graded pad for a future 15,OOO square foot office building and a s,o(
square foot retail building. The proposal requires a General Plan and Local Coastal Pla
Amendment from Planned Industrial (PI) to Extensive Regional Retail (RRE) on 23.t
acres. A zone change from Planned Industrial, Qualified Development Overlay Zone (PA
Q) to General Commercial, Qualified Development Overlay Zone (C-2-Q) on 23.65 acr
is also required. Additional permits necessary for the use are .a Site Development Plz
Conditional Use Permit, Hillside Development Permit and a Minor Subdivision to crea
four parcels out of the entire 62 acre property.
The City of Carlsbad has conducted an environmental review of the above described proje
pursuant to the Guidelines for Implementation of the California Environmental Quality P
and the Environmental Protection Ordinance of the City of Carlsbad. As a result of si
review, a Conditional Negative Declaration (declaration that the project will not haw
significant impact on the environment) is hereby issued for the subject project. Justificati

The easement documents shall be worded such that the grant is not effective

Attached is an analysis of the Conditional Negative Declaration prepared for the proposed
Price Club Project by the City of Carlsbad Department of Community Planning.
As a property owner and resident of the Southwest Quadrent of the City of Carlsbad, 1
believe that the Conditional Negative Declaration fails to meet the requirements of the
California Environmental Quality Act. In addition to the deficiencies apparent in thc
Conditional Negative Declaration, the mitigations proposed in the Conditions fail tc
adequately or feasibly reduce or eliminate the potential impacts below a level oi
significance as required by CEQA.
This project clearly requires the preparation of a Notice of Preparation for a1
Environmental Impact Report pursuant to the requirements of CEQA.

ANAzlysrs OF THE DEEWIENCIES OP THE CONDITIONAL NEGATIVE
DECLARATION PREPARED FOR THE PRICE CLUB
The Conditional Negative Declaration prepared by the City of Carlsbad Department o
Community Planning does not meet the requirements of the California Environmenta!
Quality Act Section 15070 and California Subdivision Code 21080. The document in i6
present form is based upon an inadequate initial study and upon inaccurate anc
unsubstantiated conclusions and conjectures by the C3ty of Carlsbad Department o
Community Planning, Department of Engineering (traffic), the City Cowxcil and Plannin;
Commission.
Court decisions hold that a negative declaration cannot be based on the "presumed" succes
of mitigation measures that have not been formulated at the time of project approval. TJrh
assumption and contention of Staff that the completion of the Palomar Airport Roa
improvements in the "near future" lacks validity, since there is no actual Written agreemei
with CalTrans at this time to determine the actual starting time, seismic requirements am
financial responsibilities for completion of the roadway improvements indicated to mitigal
the significant impacts anticipated to result from Price Club Traffic and erdsthg traffic. (1
the present time, the City and CalTrans have not entered the final design phase for tl
bridge - this phase (according to CalTrans officials) is approximately 3 - 6 months am
The City and CalTrans have not reached an agreement regarding the seismic engineerii
requirements for the bridge at this time, including the responsible parties to pay for tl
additional engineering specs - CalTrans indicates that they will not pay for the costs 81
that the pmject may be held up until the issue is resolved, The City of CarIsbad traf
engineering staff indicate that the fnnds in the Me110 ROOS may not be adequate to pay f
the additional bridge requirements.
CEQA requires that where the significance of potential impacts are not clear, and tht
exists "serious public controversy" an EIR must be prepared (Section 15064). The Trai
Study prepared for the Price Club project indicates that the Price Club wouId bel
operation at approXimateZy the Sitme time that "half-widfh" improvements to the bxidg'
project are completed. The time tables of both carlsbad Staff and CaITrans indicate t
this will not occur. There is inadequate documenfation to determine the significance of
interim @e., construction related impacts from both the Bridge Construction and PJ
Club Construction and operation to assess the potential impacts) period. Furthermc
CEQA requires that where feasible, mitigations for short-term impacts must
implemented, In this instance, there is inadequate documentation to support Stars

contentfon that the significant impacts will exist only for a short and foreseeable time
periud. Furthermore, there have been no mitigations proposed for short-term impacts.
The contention of successful mitkation from the closing of the Price Club during a two
hour period daily is not substantiated by any environmental documentation.
The California Environmental Quality Act has specific requirements regarding the use o Naitigated'l or 'kOfi&tional'' negative dedaratkms, Under Section 21092.4 of fie Californiz
Subdivision Code, a lead agency reviewing all projects of "statewide, regional, or areawid
significance" must always consult with certain public and state agencies. This particular1
includes '"transportation agencies". Furthermore, the lead agencies must supply thes
agencies with all "environmental documents pertahhg the project." The Urban System
traffic study prenared €or the amfect was not submitted to the State Clearing House fa
distribution to State Amncies, and there fs no documentation indicating that the Studv ha
been reviewed bv the Local CalTrans offrcials.
The Price Club Project mends the City of Carlsbad General Plan, which is also the Luc
Coastal Plan pursuant to the California Coastal Initiative requirements. CEQA court cas'
indicate that where a general plan amendment to change a land use designation, the agen
must compare the newly authorized land use with the conditions that actually exist, ai
not the conditions hyp0thet;Cally permitted under the existing general plan, The City
Carlsbad Department of Community Planning indicates that the Pdce Club pm3ect
consistent with the approved land use for the site. The approved land use for the s
lacks the intensive commercial use of the Price CIub and would require furtl
discretionary and environmental review for impIementation. Further, implementation
the approved project €or the site would occur over a more phased implementati
schedule. The City of Carlsbad General Plan delineates the proposed project site as
"the sphere of influence" of the airport safety area which does not permit intens
commercial uses for the protection of public health and safety. There is no envlmnmen
information contafned in the ConditionaI Nepative Declaration to sumort Sta
conclusions that there is not a threat to public health and safetv from such B proiecl

The location of the proposed Price Club project is adjacent to Palomar Airport Road which
has been designated as a "scenic" roadway, pursuant to the State of California Scenic
Highway program. There is no discussion of the scenic roadway impacts potentialIy
anticipated to occur from the intensity and size of this proposed project, The visual
impact analysrs appears to be biased and incomplete. There is no documentation thar
supports that this project complies with the intent and goals of the scenic road programc
The City Council and Planning commission of the City of Carlsbad have indicated concern
regarding potential noise impact to surrounding residential neighborhoods of the proposec
project from the daily operations of the proposed project, The City Council has directet
mitigations be included in the Conditional Negative Declaration for noise impacts. Then
has not been a noise studv conducted to indicate the significance or potential for nofs
imaacts. Furthermore, the mitimitiom proaosed for noise fmpacts lack anv documentatioi
that they are feasible mitigations and that thev accomplish mitiPation of potential impactr

Declarations or Mitigated Negative Declarations are not permitted where simificar
unmitierated or unrnitinable imaacts exist (Sections 15082,15375. & 15063).
The City Council and the Planning Commission of the City of Caxlsbad have add4
additional mitigations to the Conditional Negative Declaration, after the public revit
period. The public has not had a chance to review the final language and additior
mitigations included by the Council and Commission to assess their validity. T

The Conditional Negative Declaration does not discuss alternative sites for the project that
were previously proposed, or other sites in the City of Carlsbad that might reduce the
impacts and not require amending the General Plan (Local Coastal Plan) and other actions
required to allow implementation of this project CEQA interpretation in recent
Court cases, lncludjng Goleta n(a) 19901 require statemeats supporting the concept thaf
the initial study reviewed the issue of whether alternative sites or projects for the subjecl
site were examined to determine whether or not the proposed project reduces or increases
the potential impacts to an area. The Conditional Negative Declaration contains littli
discussion of this requirement and what is contained in the document is inadeauate €01
a Negative Declaration determination, (NOTE: the two previous sites of Price CluI
locations within the City do not fulfill this requirement, since there was fnadequat
documentation of the Alternative requirements with either site, and that both site wer
arbitrarily processed by the Price Club, even though they did not meet General Plai
retphrnents for the type of development proposed by the Price Club.)
If it is the wish of the City Council to go forward with the revised Conditional Negatii
Declaration, it must be recirculated for public comment for a minimum of 30 (thirty) day
The Council is mandated by the California Environmental Quality Act to hold ne
hearings on the Conditional Mitigated Negative DecIaration prior to approval.
It is the opinion of this Califorrtia Registered Environmental Assessor that the use of
Conditional Mitigated Negative Declaration is improper for the Price Club Project. TI
California Environmental Quality Act dearly mandates that an Notice of Preparation f
an Environmental Impact Report be prepared for this project. After the preparation
an 1EnVirOnment.a~ Impact Report and its circulation, the City Council as the Lead Agen
must hold public hearings to determine the adequacy to the document, prior to appro\

We are re-submitting herewith for entry into the record of the above-
captioned proceedings a written transcript of our oral testimony
delivered May 7, 1991, during the public hearing on Council Agenda
Bill 11,143, "Price Club Discount Store Project."
My name is Anne Mauch. I live on Ridgecrest Drive in the Northwest Quadrant. I've been a Carlsbad resident for eight- and-a-half years and a member of Price Club for most of that time
I am also on the Board of PROJECT FUTURE, a non-profit citizen: organization, and I would like to confirm that you have received a letter from our attorney and planning consultant to be entered into the record of this public hearing. If not,
I have copies for you at the conclusion of my remarks. Have you received the letter? Have not? [Negative indications from mayor, city attorney, and city manager] You haven't?
I would like to extend my sympathies to the Price Company for
being bounced around from site to site in their effort to
locate in the City of Carlsbad. They should have been able to get reliable guidance the first time they went to the Planning Department.
Guideline Seven of the General Plan directs the city to
"endeavor to maintain suitable and adequate sites for commer-
cial facilities which are determined to be income producing
developments." guideline. This is #1 of the planning failures I will document
tonight .
Planning Failure #2. General Plan--repeated throughout the nearly two-hundred-page document--is "TO preserve and enhance the environment, charactei and image of the city as a desirable residential, beach, and open space oriented community." A Price Club on this site is
contrary to that goal.
Planning Failures 3 and 4: the General Plan urges protection of both existing neighborhoods and the downtown commercial core,

Planning Failure #5, The site is in the airport corridor,
which the Safety Element of the General Plan classifies as
"high risk" for hazardous transport accidents and recommends
for low human occupancy uses only. The staff report passes the buck to SANDAG, which obliges with a letter saying, in effect, "Never mind, it'll be okay,"
In this context it may be noteworthy that the General Plan
classifies discount stores of 75,000 square feet or more as Intensive, not Extensive, Regional Commercial. Yet the pro- posal tonight is for Extensive Regional Commercial, which the General Plan defines as high-ticket, low-volume sales and
low human occupancy, such as car dealerships.
Failure #6. The site is in the Palomar Airport Road Scenic Corridor, which the General Plan singles out for special
visual protection to "enhance the character of the community and contribute to community pride and prestige."
The staff report treats this as a minor technicality and says landscaped setbacks and a three-foot berm will be enough to distract the eye from a thousand cars in an asphalt parking lot and a thirty-foot high, 120,000 'square foot warehouse building.
Planning Failure #7, The site, a former flower field, is also protected by the Mello I1 segment of the Local Coastal
Plan, The staff says sweeping and vacuuming the dirt/grease/ oil every week is good enough protection. The Local Coastal Plan also calls for preserving the contours of coastal slopes. Yet the staff report makes no bones about the additional grading necessary to @reate a flat pad big enough for the Price Coub. Failure #8.
Failure #9, the Hillside Ordinance. The staff report says,
"This project is in conformance with the design standards of
the Hillside Development Regulations," Yet those same regula- tions have a sketch of a building that could well pass for the
Price Club, and the illustration is labelled "NOT ACCEPTABLE"
in bold type. [Illustration attached]
The most sensational failure, #lo, is the failure of the growth management plan to prevent the traffic disaster that will be a permanent legacy of a Price Club on this busiest of all Carlsbad prime arterials. The staff report shrugs off responsibility for the 1-5 interchange failure "Because the timing of the interchange improvements are out of the hands of the city." It deals with the other two failed intersec- tions in the zone by saying financing has been arranged to

correct the problem.
The Growth Managment Ordinance is specific on the point, how- ever. It says, "If the performance standards are not met, no further building or development approvals"--including General Plan amendments and zone changes--"shall be issued until the
performance standard is met." Met, not financed, Section
21,90.130(c).
Price Club water usage is only secondarily a planning failure. It is primarily a public policy failure,
night, the water board/council proposed new and drastic cut-
backs for residents. All residents, regardless of the size of
their house or property, will be restricted to 20% less than the average household use: that is, to thirteen units(9,724
gallons) per household per month. Meanwhile, the city council/
water board is seriously considering approval of a Price Club
that will use 13,000 gallons PER DAY,
Obviously, the reason we are here tonight is that the planning
system in the City of Carlsbad is not working. The 1-5/Palomar
Airport Road location of the Price Club is contrary to virtual11
every long term planning precept applicable to that site.
FUTURE asks the council to stop this planning travesty once and for all. We ask the council to proceed with the compre-
hensive General Plan review you promised the public last month. The first policy of the current General Plan says "The goals of the general plan reflect the desires of the community," We ask the council to give Carlsbad residents the opportunity to turn these empty words into a new and potent reality.
