ITEM EXPLANATION: This ordinance amends Carlsbad Municipal Code Chapter 11.32.070 to ex€ enforcement personnel and thereby allows police bicycle patrol officers to enfOrCc codes on the seawall while riding police patrol bicycles. NS-152 AN ORDINANCE OF THE CITY COUNCIL OF THE AN URGENCY ORDINANCE AMENDING TITLE 11, CHAPTER 11.32 OF THE CARLSBAD MUNICIPAL CODE BY THE AMENDMENT OF SECTION 11.32.070 TO ALLOW LAW ENFORCEMENT BICYCLES ON THE SEAWALL CITY OF CARLSBAD, CALIFORNIA, ADOPTED AS The City Council of the City of Carlsbad, California does ordain as follows: SECTION: 1: That Title 11, Chapter 11.32 of the Carlsbad Municipal Code is amended by the amendment of Section 11.32.070 to read as follows: "The Carlsbad seawall sidewalk at the base of the bluff adjacent ' Carlsbad State Beach between Tamarack Avenue and Pine Street shall be limited to pedestrians only. No person shall skate or use ride any rollerskate, coaster, skateboard, bicycle, toy vehicle or E other form of transportation on the Carlsbad seawall sidewalk. Law enforcement personnel shall be exempt from the provision of I this section when in the performance of their duties." 19 20 21 22 23 24 25 26 27 28 1 DECLARATION OF URGENCY: This ordinance is hereby declare to be an emergency ordinance adopted as an urgency measure to protect the public health, safety and welfare and shall take effec immediately upon its adoption. This is necessary due to the start of the Police Department Bicycle Patrol Program on May 25, 1991.
