PCH MUNICIPAL CODE DEPT- H CITY AT CITY Mc CITY PROPERTY AND LOST AND UNCLAIMED PROPERTY SECTIONS OF THE CARLSBAD RECOMMENDED ACTION: Introduce Ordinance No. ,d)S - 1 sL( , amending the disposal of surplus City property and I( unclaimed property sections of the Carlsbad Municipal Code. ITEM EXPLANATION In December 1976, the City Council amended the Carlsbad Municipal Code by the add Chapter 3.29 and 3.30. These chapters provide procedures for the disposal of surplus City p and lost and unclaimed property that is in the custody of the Police Department. DISPOSAL OF SURPLUS CITY PROPERTY The City Council adopted Resolution No. 88-1 37 in April 1988, authorizing the City to partic the San Diego County’s Cooperative Auctions. Most of the City’s surplus vehicles, equipm miscellaneous items are sold at the City-County Auctions that are held three-four times Disposing of surplus City property in this manner has proven to be very satisfactory and continue to participate in these auctions. However, periodically, the City receives reques public or private organizations to purchase an item(s) of surplus City property. At the prese if an item has an estimated market value of one thousand dollars or more, the City Counc adopt a resolution declaring the item(s) surplus and authorizing the disposal of the property. to expedite the sale of surplus items, it is recommended the dollar amount be increased. The thousand dollar market value limit has not been increased in fourteen years and has I quite restrictive. The proposed amendment to Section 3.29.040 would increase the authorit City Manager to dispose of surplus property when the market value is leks than twenty-five th dollars. This will make the dollar amount for disposing of surplus City property consistent City Manager’s authority to award contracts up to a limit of twenty-five thousand dollars. DISPOSAL OF LOST AND UNCLAIMED PROPERTY Currently, the Police Department is required to hold lost and unclaimed property, except k animals and perishable property, four months. The proposed amendment would require I unclaimed property, including bicycles, to be held by the Police Department for three montk and unclaimed animals shall be turned over immediately to the San Diego Animal Re department, and lost and unclaimed perishable property shall be held only twenty-four hoL The above recommended amendments to the Carlsbad Municipal Code will expedite the dis surplus and lost and unclaimed property.
