Cm ClTY M RECOMMENDED ACTION: TITLE: Adopt Resolution No. q’-’48approving the Operating Agreement with the Carlsbad Mi Water District, Adopt Resolution No?/- 14 ‘? setting classification, compensation and bent ns-\5q existing Carlsbad Municipal Water District employees, Introduce Ordinance No. District management positions to the Carlsbad Municipal Code and Introduce Or1 Nd! ’5 -%a amending the duties of the City Manager, City Attorney and Purchasing Offi ITEM EXPLANATION This agenda item is a companion to the items on the Carlsbad Municipal Water District For background information please see that agenda bill. Terms for creation of the Carlsbad Municipal Water District as a subsidiary of the Carlsbad state that no employee shall be adversely impacted by the change in the organ relationship. The existing level of salary and benefits will be maintained. In an effort to ( similar work rules and provide effective administration and operations, all current employ the District will become City employees. Therefore, all District classifications, compense benefits need to be formalized and integrated into the City’s structure. Resolution No. adds the listing of District classifications and salary ranges to tk structure and ensures the retention of the benefits held by the District employees at it: level. The list of benefits to be retained is an excerpt from the District’s Administrative January 1, 1990, and is referenced as Exhibit B in the Resolution. This list of benefit Yi-JV of the classifications being- approved (Exhibit C) are on file in the City Clerk’s office. adds the existing District management classifications to th Ordinance No. Municipal Code. Another amendment to the Municipal Code will be accomplished adoption of Ordinance N~?~”~%hich adds the District responsibilities to the City I City Attorney and Purchasing Officer’s duties. FISCAL IMPACT There are no additional expenses generated by this action. All salary and benefit cost: by the District are specifically budgeted. Some additional expenses will be realized by t departments that are receiving employees previously funded by the District. RAUTEmRANZ, city ClerL I I 0 0 AGREEMENT FOR PERFORMANCE OF OPERATIONAL RESPONSIBILIT BETWEEN THE CARLSBAD MUNICIPAL WATER DISTRICT AND THI CITY OF CAiRLSBAD This agreement for the performance of operational responsibilities (hereafter "01 agreement") was entered into this 25th day of June, 1991, between the Carlsbad Municip: District (District) and the City of Carlsbad (City) with respect to the following facts: WHEREAS, the District has become a subsidiary of the City effective January and WHEREAS, this action consolidated the water resource planning efforts for the service area, and provided for a number of operational efficiencies; and WHEREAS, the District and the City wish eo create an integrated water service OF and WHEREAS, the District and City desire to enter into an agreement calling for to provide the administrative services necessary to carry out the functions of the Dismc City water related activities be reassigned to the District; and WHEREAS, it is the intent of the parties to cooperate fully in completing an executing any documents in order to carry out their desires and to fulfill the purposes agreement. NOW, THEREFORE, it is agreed between the parties: 1. The District appoints the City as its agent to assume responsibility for the perf( of existing District functions including but not limited to the following items: a. The term of this agreement shall commence upon its approval by the rl legislative bodies of the City and District and shall continue unless terminated as provid paragraph. In" order for this agreement to be terminated, one legislative body shall give the other legislative body at least ninety (90) days before any anniversary date. It is 1 of the parties that the minimum time for termination of this agreement shall be one (1) ninety (90) days. The ewing benefits will remain at their ant level as specified in the I subsidiary district agreement between the City of Carlsbad and the District. - ARTICLE 4. WORKING HOURS, EMPLOYEE BENEFITS Sec. 4.1 Overtime. Employees of the District shall be o call twenty four (24) hours a day during the coursj of their employment, and upon instructions of th General Manager, shall work during any emergenc affecting operations of the District. All employees are required to obtain and maintain telephone at their residence, and the telephon number shall be listed in District personnel files Overtime shall be defined as work performed befor or after the regularly scheduled work day or wor week. Work in addition to the regularly schedule1 work day shall be paid at the rate of time and one half of an employee's pay. In addition, all hour worked on Sundays and Holidays shall be paid a double time. 1. Standby. Two employees shall be on standby a. all times. Each such employee shall remain o standby for a one-week period and shall receivl $100 per week for the standby period. The employe( shall be compensated in the normal manner for an: work performed. Standby call shall not be regardec as call back work. 2. Call Back. Call back is work required of ai employee who, following completion of thc employee's work day and departure from the employee's work site, is ordered to report back tc duty to perform necessary work. To qualify fo. this call back provision, an employee must leavc the place from which the employee is called an( actually report to a work site and/or the office. An employee who is called back as defined above shall receive a minimum of two hours time at the rate of time and one-half pay for regular overtime or double time on Sundays or holidays. In lieu o pay, compensatory time may be accumulated to i maximum of forty hours per fiscal year. AI employee not using the compensatory time shall be paid for the time prior to the end of the fisca. year on June 30. Overtime work in conjunction with regular schedule( work day, either beginning earlier or working pas- normal scheduled work day, is not call back work. Sec. 4.2 Vacation leaves. Vacation time is intended tc provide a rest and change for the employee. Fo this reason, all employees are encouraged to takc I 0 @ at least five (5) consecutive work days of theii employment. At the discretion of the General Manager as tc setting the period of time to be taken for an! vacation leave, all full-time employees will bc granted such leave with pay under the followinc conditions: (a) Earninqs Rates. After completion of one yea] of employment, each employees shall be grantec vacation time of 80 hours. The employee the] begins earning vacation at the rate of 3.08 hour: per pay period. After the completion of fivt continuous years of employment, an employee shal: be granted vacation time at the rate of 4.62 hour: per pay period. Vacatioi time accumulation as of January 1 each year may bc permitted as follows: Employees with less than 5 years service --- 160 hours Employees with 5 but less than 10 years service --- 2 4 0 hours Employees with 10 but less than 20 years service--- 3 2 0 hours Employees with 20 or more years of service --- 400 hours Effective January 1, 1987, and each January : mentioned hours will be eliminated. (c) Schedulinq. Prior to January 1 each year employees shall schedule their vacation times foi the next year with their supervisors. The vacatioi schedules will be consolidated into one summar] schedule which the General Manager shall approve. Pay for vacation leave shall be at the monthly rate currently paid the employee at the time the vacation is taken. Service shall be deemed to be continuous if employment by the District has not been interrupted for a period ir excess of 30 days, or where the District has terminated an employee due to lack of work and later rehired the employee. (e) In computing the amount of vacation leave due an employee, holidays, vacation time, and sick leave shall be included as total service and the period of time to be granted to an employee shall be in addition to Saturdays, Sundays and Holidays within or at the beginning or end of such leave. Sec. 4.3 Sick Leave. Sick leave is defined as the necessary absence from work of an employee because of illness, injury or exposure to contagious disease suffered by the employee, or the serious disability of the employee while on a scheduled vacation, OY absence authorized for medical or dental care. Employees shall be entitled to sick leave with pay under the following conditions: (a) Each full time employee shall be entitled tc 96 hours sick leave per one year of employment. (b) Sick leave may be accumulated for an unlimited period. Additional sick leave may be granted at the discretion of the Board of Commissioners and approval thereof. (c) Abuse of sick leave privileges shall be grounds for discipline or dismissal. (d) In computing the amount of sick leave time due an employee, holidays, vacation time and sick leave shall be included as total sewice and the period of time to be granted to an employee shall be in addition to Saturdays, Sundays, and holidays within or at the beginning or end of such leave. (e) An employee has the option of selling back tc the District 100% of any accumulated sick leave iI: excess of 250 hours. (f) The Board of Commissioners, at its discretion, may purchase any accumulated sick leave from ar employee. I) e Sec. 4.4 Jury Duty. All employees are eligible for jury duty leave with pay when required by any leqally constituted court to appear for examination or jury service. In order to qualify for paid jury duty leave, employees are required to furnish proof of attendance in a manner prescribed by the General Manager. An amount equal to the per diem or fees paid by the court to the employee will be deducted from the employee's pay. No deduction will be made for the value of mileage allowances, meals or lodgings furnished by the court. In the absence of proof of attendance, an employee will be required to use such other leave as is prescribed by the General Manager. Sec. 4.5 Bereavement Leave At such time as there is a death in an employee's immediate family, the General Manager is authorized to grant up to a maximum of 3 days leave with pay, subject to employee's written request for such compensation. Written request shall contain the following information: ... Name of deceased ... Relationship to employee ... Date of funeral and services ... Place where funeral or services will be held ... Date of employee's return to work Such paid leave, if approved, is not to be charges against employee's vacation leave. All Bereavement Leaves must have prior approval of the General Manager. Employee is eligible for Bereavement Leave for abortion or miscarriage. Immediate family is defined as: Spouse, child, parent, brother, sister, grandparents, mother-in- law or father-in-law, brother-in-law, sister-in- law. Two (2) days of sick leave time may be used in conjunction with Bereavement Leave. Employee must have the necessary hours accumulated in order to qualify for this additional time off. Prior approval of the General Manager is necessary. -1 0 e Sec. 4.6 Leave Without Pay or Leave of Absence 1. Leave necessitated by illness or injury: Leave without pay or leave of absence when necessitated by illness or injury may be granted by the General Manager to a staff member or employee of the District only after exhaustion of all accumulated sick disability and vacation leave for a period not to exceed six (6) months and in accordance with the monthly guidelines as established in (3) below. Unless specifically authorized by the Board of Commissioners for a longer period, a staff member or employee of the District who, due to illness OL injury, has taken leave without pay in excess of thirty (30) consecutive calendar days, shall be required to provide a Physician's Statement attesting to his/her fitness based upon the normal duties pursuant to his/her job description before returning to work. 2. Leave necessitated by pregnancy, childbirth, miscarriage or related medical condition: An employee affected by pregnancy, childbirth, or related medical conditions may take an unpaid leave of absence of absence for a reasonable time, not tc exceed four months. A reasonable time is that period during which the female employee is disabled on account of conditions. This time does not include time for maternity or child care leave. An employee affected by pregnancy, childbirth, 01 related medical conditions must give the District reasonable notice of the date the leave of absence will begin and the estimated length of leave. Reasonable notice is that time prior to taking leave when the employee knows the estimated date the leave of absence will begin. If the employee returns within four months, shE will be reinstated to her former position, unlesE the job ceases to exist because of legitimate business reasons or the District was unable tc leave the position unfilled or fill it witt pregnancy, childbirth or related medical temporary employees. If the employee is not returned to her original jok -, 0 e she will be given a substantially similar job, unless there is no substantially similar positior available or the substantially similar position is available, but filling the available position with the returning employee would substantiallq undermine the District's ability to operate safe11 and efficiently. When the leave of absence exceeds four months, ther the provisions of Section 4.6 (1) and (3) governinc leave without pay or leave of absence becomE applicable to that employee. If the employee is temporarily disabled because of pregnancy, childbirth or related condition, but is able to work in a less strenuous or hazardous position, the General Manager may transfer that employee, upon request, to a less strenuous 01 hazardous position, unless the General Manager finds denial of the request necessary for the safe and efficient operation of the District. BENEFITS An employee who requests a leave of absence because of pregnancy, childbirth or related medical conditions, shall use accrued sick leave and vacation leave, as permitted by Sections 4.2 and 4.3. The Manager shall not extend leave under this policy to any employee more than one time during any single calendar year. 4. Military Leave: A. Active Military Duty 1. Eligibility Any District employee who is a member of the reserve corps of the armed forces of the United States, National Guard or thc Naval Militia is entitled to a militarq leave of absence while engaged in militarl duty ordered for purposes for activc military training, encampment, naval cruises, special exercises or likc activity. This leave ordinarily may not exceed 180 calendar days, including time involved in going to and returning fron duty, and reinstatement rights will be granted as required by state and federal law. 2. Active Duty During Emergency Regardless of the employee's length 01 active military leave during a state oj extreme emergency as declared by thc - service, any District employee may takc -3 0 0 Governor of California or otherwise provided by law. During such active emergency military leave, the employee will receive his or her regular pay for the first (30) days of the leave. B. Military Training Leave Any District employee who is a member of the State Military Reserve is entitled to a temporary leave of absence without pay while engaged in military duty for purposes of military training, drills, unit training assemblies or similar inactive duty training, for up to 15 calendar days annually, including time involved in going to and returning from that duty. Sec. 4.7 Holidavs. The business office of the District shall remain open from 8:OO A.M. to 5:OO P.M. except upon the following designated Holidays: January 1st (New Year's Day) 2nd Monday in February (Lincoln Day) 3rd Monday in February (Washington Day) Last Monday in May (Memorial Day) July 4th (Independence Day) 1st Monday in September (Labor Day) 2nd Monday in October (Columbus Day) November 11th (Veteran's Day) Thursday designated Thanksgiving Day Friday after Thanksgiving Day December 25th (Christmas Day) In the event that a Holiday falls on a Saturday, the previous Friday shall be considered a Holiday; in the event that a Holiday falls on a Sunday, the The District off ice shall be considered closed on the day designated by the State of California. One Elective Day as a Holiday. In addition to the above Holidays, each employee shall be entitled to eight (8) consecutive hours off with pay of his/her choice per each twelve (12) month period within the following limitations: 1. Employee must obtain supervisory approval of the elective day at least 30 days in advance of the day selected. Monday through Friday of each week of the year, following Monday shall be considered a Holiday. -1 m a 2. New employees are not eligible for the elective holiday until successful completion of one year of employment with the District. Full-time employees shall be compensated for eight hours' pay for each of the above-designated holidays. The General Manager shall develop a schedule of holidays to provide for the Field Operations 1C hours per day employees. Any employee on leave of absence without pay durinc a designated holiday date shall not receive compensation for said holiday. To be eligible for holiday pay, an employee must work or be on an approved paid absence the workin< day preceding and the working day following a legal holiday on which the District office is closed. The Supervisor shall report to the Personnel officc any employee not eligible for the holiday pay. Sec. 4.8 Health Insurance and Life Insurance. The District will provide each full-time employee and his/her dependents with a choice of ACWA-Blue Cross Prudent Buyer, ACWA-California Care, or Kaiser healtk insurance. The District will provide either of the two ACWA policies at no cost to the employee, and will contribute an amount not to exceed the cost of the ACWA policy toward the Kaiser program at thc option of the employee. The District will provide each full-time employee e life insurance policy or group policy, as determined by the Board of Commissioners, whick will provide a reasonable amount of protection 01 coverage at no cost to the employee. Prior to being employed, a physical questionnaire form shall be filled out. This will be followed bj a physical examination, the cost to be paid by thc District. for each designated District holiday. If t I .I e Q An employee shall not be entitled to any benefits effective the day following the day that the status of employment is terminated. The day of termination is not extended through the period of accumulated vacation or sick leave the employee is entitled to as of the date of termination. Effective January 1, 1987, terminated employees who leave for reasons other than gross misconduct on the part of the employee, will be eligible, along with their dependents, for continuation of health insurance coverage to be paid by the employee as required under federal law. The District will continue to pay, after retirement of an employee, premiums for existing health insurance provided for District employees: 1. Who have voluntarily retired after the age of 50 with no less than five years of service with the District, and whose age combined with years of service with the District equals 70 or more; or 2. Who have retired by having reached the mandatory retirement age established under the State of California Public Employees' Retirement System with no less than five years of service with the District; Health insurance coverage for the retiree will be coordinated with Medicare and other benefits be reduced when the retiree qualifies for those benefits ; health insurance coverage for the spouse and dependents of a retiree will be coordinated with Medicare and other benefits provided by federal and state law, and will thereby be reduced when the spouse qualifies for those benefits. Upon death of the retiree, health insurance coverage for the spouse and dependents will be continued, provided the spouse keeps the District informed of his/her name, address and marital status. In the event such spouse remarries, his I her eligibility for such coverage ceases immediately and shall be terminated. As used herein, llspousell shall mean the spouse of the Sec. 4.8 - 1 (Addendum) Health Insurance for Retirees. provided by federal and state law and will thereby employee at the time of the employee's retirement, e a If the retiree divorces, neither his new spouse nor his former spouse will be eligible for coverage and it shall cease immediately and be terminated. The District shall provide all employees a Group Disability Insurance Plan. The cost of such premiums shall be borne entirely by the District, Sec. 4.10 Credit Union. The District will permit a payroll deduction bi-weekly for those employees who wish to avail themselves of the services of the San Diego County employees' Credit Union. Sec. 4.11 Retirement Plan. In accordance with an agreement between the District and the Public Employees' Retirement System, all full time employees shall be enrolled as members of the System. The District contributes both the District's and employee's share of the costs. Part time employees are not eligible for membership in the Public Employees' Retirement System unless they work at least 30 hours per week on a regular basis. Sec. 4.12 Unemployment Insurance. The District does participate in the State Unemployment Insurance Program. Sec. 4.13 Workers' Compensation Insurance. The District is covered as required by California law, by Workers' Compensation Insurance. All employees, without exception, are therefore afforded the protection and benefits provided by Workers' Compensation Insurance. Injury Leave Definition: Injury leave means a paid absence from duty as a result of a job-related injury. Eliqibilitv for Iniurv Leave Shall be as Follows: A. Injury leave may be granted only during the period the employee is unable to perform his/her duties and is entitled to Workers' Compensation temporary benefits. No injury leave may be granted during the first three days after the employee leaves work as a -8 0 result of the injury except in a case where thc injury causes disability of more than twenty on€ days or necessitates hospitalization within the leave may commence the first day the injurec employee leaves work or is hospitalized as a result of the injury and shall not be credited against employee's sick time, B. Sec. 4.14 Educational Reimbursement. The District encourageE Thc educational advancement of its personnel. purpose of the reimbursement program is to providc financial assistance to those employees whc voluntarily engage in educational pursuits beneficial to the District. Although any employee who uses his leisure hours tc develop his skills and knowledge is to bc commended, the District cannot assume financia: responsibility for all such pursuits. Employec educational reimbursement is confined to expense: for voluntary, both the employee and the District. 1. Sec. 4.15 Lonqevitv Pay. Each classified regular employee in the District service will be eligible for longevity allowance as follows: After five (5) years of service in the same classification at E step, an employee shall be entitled to an allowance of 5% in addition to any other regular pay, i.e. C.O.L.A., that he or she is entitled to. The employee is then placed at the LI step. After an additional five (5) years an employee shall be entitled to a 2-1/2% increase in addition to any other regular pay that he or she is entitled to and is then classified as an L2. Effective July 1, 1989 an additional one-time $1,500 net award will be given to all employees who reach L2 and every five (5) years thereafter. Sec. 4.16 Seniority. Seniority shall mean the status attained by length of continuous service with the District. Seniority shall be determined from the day of an employees official appointment to District service. An employee shall have no seniority until completion of at least six (6) months service with the District, at which time the employee will acquire seniority from the date of accrue no seniority in the new position until completion of six (6) months in pay status in the new position. The employee's total seniority with the District will be credited. The employee, and not the District, shall be responsible for the general maintenance of the house and surrounding property. The employee shall also be expected to provide security during nonworking hours by having themselves, a member of their household or another District employee on-site four weeknights per week and at least three weekends per month. The employee shall be expected to respond to emergency situations to include the chlorination facility, the hydroelectric facilitp and the mobile chlorination equipment. The employee shall make a visual inspection of the entire site at least weekly and shall repair any minor fence breaks. The employee shall drive a District vehicle. No more than three private vehicles shall be kept at the residence. No overtime or supplemental compensation shall be paid for these duties. 6. Rent. The District shall charge an appropriate rent for the residence. Said rent shall be established from time to time by the Board of Commissioners. The District shall furnish the water supply and electricity for the residence and the District employee shall be responsible for the balance of the utilities. Upon change of resident bill the outgoing resident. 7. Firearms. The employee shall not carry any firearms in the performance of his/her duties as caretaker nor in District vehicles and shall not discharge any firearms on District property. 8. Parties. The employee shall notify the General Manager in advance of any party at the residence involving 15 or more people. 9. Pets. The employee shall be allowed to have only non-house pets and any pets shall remain within the fenced portion of the property provided -for this purpose.
