NS-159 and NS-160, amending various sections of the Municipal Code to consolidate water operations within the Carlsbadl Municipal Water District service area. lTEM EXPLANATION Ordinance No. NS-159 and NS-160, were introduced and first read at a regular City Council meeting on June 25, 1991. The second reading allows Council to adopt the ordinances which would then become effective in thirty days. The City Clerk will have the ordinances published in the "Carlsbad Journal" within fifteen days, if adopted. FISCAL IMPACT See Agenda Bill No. 11,219 on fie with the City Clerk. EXHIBIT 1. NS - 15 9 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA AMENDING TITLE 2, CHAPTERS 44.030, AND 48.030 BY AMENDMENTS OF VARIOUS SECTIONS TO ADD MANAGEMENT CLASSIFICATIONS OF THE CARLSBAD MUNICIPAL WATER DISTRICT The City Council of the City of Carlsbad, California, does hereby o follows: SECTION I: That Title 2, Chapter 44.030, Section 2.44.030 of the ( Municipal Code is amended by the addition of subsection (13) to read as follows: "(13) General Manager, Assistant General Manager, District E Superintendent and Administrative Analyst positions of the Carlsbad Municipal Water 1 SECTION 11: That Title 2, Chapter 48.030, Section 21.48.030 of the ( Municipal Code is amended by the amendment of Section 48.030(7) to read as follows The following classifications are to be added to the existing list of positi specified in 2.48.030(7). NS-160 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA AMENDING TTXLE 2, CHAPTERS 12.035, AND 14.050, TITLE 3, CHAPTER 28.04 BY AMENDMENT T REFLECT THE ADDED RESPONSIBILITY OF THE CARLSBAD MUNICIPAL WATER DISTRICT TO THE CITY MANAGER, ATTORNEY AND PURCHASING OFFICER CLASSIFICATIONS The City Council of the City of Carlsbad, California, does hereby or f 0110 w s: SECTION I: That Title 2, Chapter 2.12, Section 2.12.035 of the C Municipal Code is amended by the amendment of subsection (I) to read as follows: "(1) Additional duties. It shall be the duties of the city manager to perfor other duties and exercise such other powers as may be delegated to him from time to t ordinance or resolution or other official action of the city council. The city manager shall also act as the Executive Manager for the Carlsbad Municipal District. The Executive Manager shall be the administrative head for the Water District anc directly to the Board of Directors. It SECTION 11: That Title 2, Chapter 2.14, Section 14.050(d) of the C, Municipal Code is amended by the amendment of Section 2.12.050(d) to read as follow "The city attorney shall be the chief legal officer of the city under directi 1 control of the city council. The city attorney will also act as the legal counsel for the Ci 20 21 22 23 24 25 26 27 28 Municipal Water District (district), and report directly to the Board of Directors. Exc otherwise provided in this chapter, the city attorney shall have the following responsibilit both the city and district. 1 SECTION III: That Title 3, Chapter 28.040, Section 3.28.040 of the C; Municipal Code is amended by the amendment of subsection 3.28.040 to read as follow "Other functions.
