I CITY A' DEPT.m SURPLUS CITY PROPERTY CITY M RECOMMENDED ACTION: Adopt Ordinance No. NS-154, amending the Municipal Code to revise the disposal procedures of surplus City property and lost and unclaimed property. i. ADOPTION OF ORDINANCE - MTG. 7/02/91 ITEM EXPLANATION Ordinance No. NS-154 was introduced and first read at a regular City Council meeting on June 25, 1991. The second reading allows Council to adopt the ordinance whick would then become effective in thirty days. The City Clerk will have the ordinance published in the "Carlsbad Journal" within fifteen days, if adopted. FISCAZ. IMPACT See Agenda Bill No. 11,206 on file with the City Clerk. EXHIBIT 1. NS 154 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING TITLE 3, CHAPTERS 3.29 AND 3.30 OF THE CARLSBAD MUNICIPAL CODE BY THE AMENDMENT OF SECTIONS 3.29.040 AND 3.30.020 TO REVISE THE PROCEDURES OF SURPLUS CITY PROPERTY AND LOST AND UNCLAIMED PROPERTY The City Council of the City of Carlsbac California, does ordain as follows: SECTION 1: That Title 3, Chapter 3.29 of tl Carlsbad Municipal Code is amended by the amendment of Sectic 3.29.040 to read as follows: t13.29.040 Manner of DisDosal. (a) If the surplus property which is nc required for city use has an estimated market value of le: than twenty-five thousand dollars, the city manager m4 authorize the disposal of the property by: (1) public auction; (2) negotiated sale to other San Die( County municipalities or governmental agencies at a pric determined to be fair and reasonable; (3) sealed bids. If the items of city-owned personal proper are determined to be "unable to be sold" by the city manag after an attempt at sale through the above prescrib procedures, they may be donated to a charitable organizati in lieu of discarding such property. Charitable organizatio shall mean non-profit organizations exempt from taxation und provisions of Internal Revenue Code, whose primary purpose 1 20 21 22 23 24 25 26 27 28 (b) If the surplus property which is n required for city use has an estimated market value of mo than twenty-five thousand dollars, the city manager sha dispose of the property as provided by resolution of the Ci Council. The amount received for any property so pursuant to this chapter shall be credited to the appropria fund as the city manager shall determine.#* SECTION 2: That Title 3, Chapter 3.30 of t Carlsbad Municipal Code is amended by the amendment of Secti 3.30.020 to read as follows: //// (c) 1 1 4 m 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 e e 113.30.020 Retention authorized-Taaainq reauireq. (a) All lost and unclaimed property, includir bicycles, in the possession of the police department shall k held by the department for a period of at least three months Lost and unclaimed animals shall be turned over to the Sz Diego County animal regulation department. Lost and unclaimc perishable property shall be held by the department for z least twenty-four hours. (b) All lost and unclaimed property in tk possession of the department shall be tagged showing the dal and circumstances of its acquisition by the department." EFFECTIVE DATE: This ordinance shall be effectii thirty days after its adoption, and the city clerk sha: certify to the adoption of this ordinance and cause it to 1 published at least once in the Carlsbad Journal within fiftec days after its adoption.
