CT 89- 18, Ranch0 Verde. ITEM EXPLANATION: On September 4,1990, City Council adopted Resolution No. 90-258 approving a Tentative Tract Map (CT 88-3, Arroyo La Costa) for 1,076 single family dwellings on property generally located east of El Camino Real, north of Olivenhain Road and west of Ranch0 Santa Fe Road. A condition of that approval required the developer to submit a financial guarantee acceptable to the City Council for construction of Ranch0 Santa Road improvements within 180 days of the effective date of the Resolution (September 4, 1990). The condition gave Council the discretion to extend the time limit. On March 27, 1991, the applicant requested a 180 day extension. The original 180 days expired on March 4, 1991; however, the intent of the condition was to insure a good-faith effort by the developer to formalize the guarantee and financing for the Ranch0 Santa Fe Road improvements. The developer has been working to complete this financing package and has recently submitted a plan for review. Full review of the plan was not possible until the status of Citywide Community Facility District was known. Staff believes that the developer is making every effort to complete the financing packaging and recommends that the Council grant a 180 day extension. With this extension, the condition will be valid until September 3, 1991. Approval of the extension will allow staff to begin the plancheck process for these two projects. Staff is also requesting that Condition 1, of Resolution No. 90-274 approving a 180 lot subdivision for CT 89-18, Ranch0 Verde be extended. Ranch0 Verde is located at the southeast corner of the City adjacent to the City of Enciniats. CT 89-18 was approved by Council on August 7, 1990. Condition No. 1 required that the developer submit financing plans within 180 days of approval of the Resolution. The developer is diligently working to complete a financing package. Staff is requesting that Condition No. 1 be extended to expire on September 3, 1991. Since the condition for submittal of financing plans for both Tentative Map approvals expire within a month of each other, staff is requesting the extension for CT 89-l 8 as well as CT 88-3. Having conditions of both CT 88-3 and CT 89-18 for submittal of financing plans coincide will assist staff in tracking the conditions of the tentative maps. FISCAL IMPACT: These extensions will have no direct fiscal impact on the City. Funding for installation of improvements for the subdivisions will be paid by the developers. PAGE TWO OF AB# /[ A 3 ‘? By our calculations, that 180-day period has recently expired, and an extension is necessary in order to insure continuing processing of the final map(s). We believe the intent of condition 98 was to insure a good-faith and diligent effort to formalize the guarantee and financing of Ranch0 Santa Fe Road, and a request for extension of the 180 days would be favorably considered in such event. Since the Council approval, we have been working diligently to complete a financing package which, as you know, has recently been submitted to staff for processing and review. The financing plan for both Zones 11 and 12 contemplates a Community Facilities District up to $150 million to take care of the financial guarantee required of all Zone 11 and 12 facilities, including the full improvements required to Ranch0 Santa Fe Road. Therefore, we anticipate City approval of this Financing Plan package will satisfy condition 98. Concurrently with our work on the Financing Plan, we have been preparing the improvement plans for Phase I of the final map, and anticipate submission to the City in mid-April. Prior to the recordation of the first final map, the applicant shall enter into a third party agreement with the City to contract with an environmental consultant, paid by the applicant, to provide a monitoring program for the mitigation measures required by the tentative map and environmental impact report. The offer shall be made by a certificate on the final map for this project. All land so offered shall be granted to the City free and clear of all liens and without cost to the City. The developer shall enter into-secured agreements for the installation and removal of the electronic .gates at ~1 Bosque Avenue and Carte Carolina to the satisfaction of the city engineer and city attorney pursuant to the requirements of the master plan and these conditions of approval. 97. Prior to final map approval the developer shall deposit cash in and amount determined by the city engineer as necessary to fund the removal of the emergency access gates installed at the project boundaries at Corte Carolina and El Bosgue Avenue and to fund any necessary restoration of the area. Prior to final map the developer shall make arrangements for a program to the satisfaction of the planning director to include a notice to all prospective purchasers in the development that the project may be subject to additional traffic from the opening of the two gated street connections. A note to that effect shall be placed on the final map and notice shall be included in the deed3 for the sale of each individual lot. 0 * 98 Within 180 days from the date of the Arroyo La Costa' Tentative Map approval, (the effective date of this resolution), a financial guarantee,acceptable to the City Council for construction of Ranch0 Santa Fe Road improvements must be provided by the Developer. Unless the guarantee is approved by the City Council within the 180 day period, all processing on the Arroyo La Costa Final Map will cease until such time as it is approved. The time limit may be extended at the discretion of the City Council. 99. 'Olivenhain Road shall be improved to a four-lane interim roadway from El camino Real to Ranch0 Santa Fe Road including any necessary offsite transition. The developer/owner may be eligibIe for partial reimbursement from adjacent property- owners. A reimbursement agreement must be approved by the City prior to approval of the final map for this phase. Exhibit YH3~@ shall be amended to show placement of the solid village wall on the south side of proposed Street N- N, which is existing Calle Barcelona and hereafter called Calle Barcelona, next to Santa Fe Ridge, as follows: 1. The wall on the east side of Corte Carolina shall be placed 'within the public right-of-way of Call8 Barcelona and Corte Carolina, or on private property if applicable. The wall shall be extended from Call8 Barcelona south along Corte Carolina to a point approximately one-half of the side lot distance of 2920 Via Ipanema. 2. All other maintenance, for example, periodic painting, shall be shared, with the Arroyo La Costa Homeowners0 Association maintaining those portions of the wall facing Arroyo La Costa, and individual Santa Fe Ridge property owners agreeing with the City and maintaining * those portions of the wall facing their properties. All streets in the project shall be public. Prior to final map, the developer shall make arrangements for a program to the satisfaction of the Planning Director to include a notice to all prospective purchasers in the development that the project may be subject to additional traffic from the construction of a street connection to Encinitas through the subdivision at Paseo De1 Oro. A note to that effect shall be placed on the final map. Notice shall be included in the deed for the sale of any lot that access to the City of Encinitas exists through this subdivision at Paseo De1 Oro which may be constructed and placed in service at the discretion of the City Council. The developer shall make an irrevocable offer to dedicate a public street with a 60 foot right-of-way and providing for a 40 foot roadway from Paseo de1 Oro easterly to the subdivision boundary to provide for an access road connecting Carlsbad and Encinitas. Prior to Final Map approval, the developer shall provide security to the satisfaction of the City Engineer and the City Attorney that guarantees the design and construction of the access road identified in Condition No. 7 above. Condition No. 67 of Planning Commission Resolution No. 3023 is deleted. There shall be no access at this time to Encinitas. .
