ITEM EXPLANATION: The purpose of this agenda bill is to request Council's approval of three Resolutj necessary prior to the annual public hearing for the City of Carlsbad's Street Ligh and Landscaping District No. 1. At the public hearing, which must take place at 1c three weeks after this meeting and prior to August 10, staff will present a compl report based on the Engineer's Report describing the maintenance and operat procedures of the district. Although final assessment amounts will not be available until after July 1, 1991, i anticipated that the average assessments for single family residential parcels benefit from street lighting in FY 91-92 will be $36.91. Parcels benefiting from street t maintenance and median maintenance can anticipate assessments of $35.70 and $5 respectively. A complete list of ET 91-92 assessment benefit costs as applicable to e: City assessor's parcel is available for public review at the Utilities and Maintenai Department Administrative Office. BACKGROUND: In 1983, the City of Carlsbad Street Lighting and Landscaping District was form according to the provisions of the California Streets and Highways Code known as t Landscaping and Lighting Act of 1972. Since the formation, the cost of operating t City's street lighting system has been funded through assessments levied by the Distri Assessments are apportioned to each parcel in the City based on benefit. In fiscal year 1989-90, Council approved the addition of two landscaping zones to tl original District by Resolution No. 89-194 passed June 6, 1989, at the District's pub1 hearing. The two zones formed were a Tree Trimming Maintenance Benefit Zone a1 a Median Maintenance Benefit Zone which was to be phased in to total assessme financing over a three year period. Fiscal year 1991-92 will be the third year of tl phase in program, which means street tree and median maintenance will be ful funded by the District assessments. WHEREAS, at this time there has been filed as a part of the "Report", certain plans a specifications for the maintenance of the improvements, an estimate of the costs maintenance, a diagram of the District, and an assessment roll containing a spread the estimated costs of maintenance within the District, all as required by the Act a as previously ordered by this City Council. NOW THEREFORE, pursuant to the direction from this City Council, this "Report" hereby submitted to this City Council pursuant to the provisions of the Act. The assessment to parcels within any one code will be assessed by one of the follow methods: 1. EO e 0 METHOD AND FORMULA OF ASSESSMENT SPREAD FOR LANDSCAPING STREET TREE MAINTENANCE Street Trees are in the street right-of-way, generally between the curb a: sidewalk and/or property line in the areas indicated in Exhibit "B". Ea property receives approximately the same benefit. Therefore, staff establish a benefit formula in which each parcel is given an equivalent dwelling UI (EDU) based on the average size of a single family residential lot in the City Carlsbad (7,500 square feet or .17 acres). Thus, each single family parcel given an EDU of 1.0, while most other parcels are given an EDU based on t following formula: Acreage = EDU .17 MEDIAN LANDSCAPE MAINTENANCE This service generally benefits all parcels and residents in the City. According all parcels share in the cost. However, parcels which front upon streets whi receive median landscape maintenance services generally receive more bene from landscape median improvements than other parcels. Thus, all parcels the City share in the cost of median landscape maintenance using the same E1 formula proposed for Street Tree Maintenance and those parcels which front streets with landscaped medians are assessed twice the amount of other parcl not fronting on the median streets.
