FIN COMMUNITY FACILITIES DISTRICT NO. 1 CIT RECOMMENDED ACTION: Adopt Resolution No. 7 1-2 3 q Facilities District No. 1 establishing the annual tax for Commur ITEM EXPLANATION: Over the past few months the City Council has taken a variety of actions setti in place Community Facilities District No. 1. This district is designed to prov funding for a variety of infrastructure projects over the coming years which v be necessary to meet the requirements of growth management. In June the Council adopted an ordinance putting in place the tax formula for i district establishing the Maximum Tax Rates that may be levied by the distr Although this action established the ceiling for future tax rates, it did not cre the individual tax levy that will be placed on each parcel. The process establishing the levy will be conducted annually by the City as the funding nec for the next fiscal years is known. The actual tax levied need not be the sal as the madmum tax rate. In fact, the maximum tax rate will never be assess as long as the CFD is in reasonably good fiscal condition. The action before the Council is to adopt a resolution establishing the annual 1 levy for CFD No. 1. Staff has prepared the following brief review of the optic available to the Council and some of the considerations that should go ir setting this tax rate. Project scheduling: The timing of projects has a significant impact on the amount of rever necessary from the tax levy. The more funding required in any given year i higher the tax rate must be to provide funding. However, any fu collected over and above that amount needed for current projects may used to fund the early design and engineering costs for future projects. Th funds also allow the Council to set lower tax rates in later years. The staff recommendation is to delay Cannon Road and set a lower tax r for this initial year of the CFD. Council may reconsider the timing of Cam Road annually as each year's tax rates are reviewed. Tax Rates During the three years that preceded the formation of CFD No. 1 the SI held many meetings with property owners to review the possible tax rai project schedules and the effects of the CFD on their properties. During th discussions a variety of tax formulas and rates were discussed. The most important document used in this process was the CFD rep published in January 1991. This report included a cash flow forecast wh indicated the amount of the vacant land tax that would be required to fu the CFD projects under the schedule shown above. This cash flow and ri forecast has become the basis for much of the fiscal analysis done by i property owners. If the City imposes tax rates that are considerably higher than the ra included in the January 1991 report many property owners will be pay higher than expected taxes for 1991-92. Both large and small prope owners are affected by this issue. Staff has provided two tax rate proposals based on two project schedu! The first is based on the recommended project schedule. This schedule ci for a tax rate that is the same as that shown in the CFD report. The secc alternative would set a tax rate that allows Cannon Road bonds to be issc in 1991-92. This requires a higher tax rate in the first year for bc residential (3.25 percentage points) and non-residential (about 8 percent; points) properties. Staff is recommending that Council set tax rates consistent with the Janu; 1991 Report rather than set the higher rate necessary to keep Cannon Rc on the original schedule. However, the fixed rate formula would have imp0 a higher tax in the early years which remained level over a series of ye: This level tax rate would have evened out the uncertainties for the propc owners and offered a stable rate. The major property owners h consistently advocated the variable tax rate concept which is n recommended by staff. Staff is recommending that the Council adopt the tax rates that support pro. schedule No. 1, as presented in the CFD report of January 1991 with the de of Cannon Road. This rate may be adjusted in future years as the Council s fit. The rate provides the CFD with sufficient flexibility in the critical first y of the district. The recommended tax rate structure is consistent with the tables provided in the January 1991 Report. Either proposal will provide adequate for first year funding for the library proj Funding of future projects will depend on the tax rates set in the next few ye of the CFD. Council will be asked to adopt the attached resolution which sets the spec amount of the special tax on each parcel within the CFD boundary for 1991- (These taxes Will be used to pay for costs of the district only.) The special listing will then be filed with the County of San Diego to be included on the bills for December 1991 and April 1992. Council should note that there are NO homes of Carlsbad residents affected this taxes. In fact, under Council Policy No. 38, there will never be any ho owners taxes by CFD No. 1. FISCAL, IMPACX This is the final in a series of actions that will have a long term fiscal impact the City of Carlsbad. The levying of taxes on parcels within the CFD will cre the necessary cash flow to finance the construction of the new library, interchanges and other significant projects. This action is also the precursoi months to come. Growth Management is both a land use planning and a fis process. There are millions of dollars in infrastructure to be constructed in 1 next few years, much of which will be financed by this CFD. Millions more v be funded by developers directly, and others will require the involvement of i City Council in planing and structuring the use of public debt. RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ESTABLISHING ANNUAL TAX FOR A COMMUNITY FACILITIES DISTRICT WHEREAS, the CITY COUNCIL of the CITY OF CI CALIFORNIA, (hereinafter referred to as the "leqislatiue has initiated proceedings, held a public hearing, condu election and received a favorable vote from the qt electors relating to the levy of a special tax in a cc facilities district, all as authorized pursuant to the te Provi8ion3 Of the "MellO-HOOB Community Facilities AC~ of being Chapter 2.5, Part 1, Division 2, Title 5 of the Gov Code of the State of California. This Community Fac District -shall hereinafter be referred to as COMMUNITY TIES DISTRICT NO. 1 (hereinafter referred to as the "Dist. and, WHEREAS, this legislative body, by Ordinance as autk by Section 53340 of the Government Code of the State of Cz nia, has authorized the levy of a special tax to pay for and expense9 related to said Community ~aciiities Distric this legislative body is desirous to establish the specifi of the special tax to be collected for the next fiscal year NOW, THEREFORE, IT IS HEREBY RESOLVED AS FOLLOWS: SECTION 1.
