ENG:MP UNDERGROUND UTILITY DISTRICT NO. 13 CITY MG . - RECOMMENDED ACTION: Adopt Resolution No. 91-2q7 setting a public hearing to receive input and initiate proceedings to determine the formation of Underground Utility District No. 13 on Tamarack Avenue, from 1-5 to Carlsbad Boulevard. ITEM EXPLANATION: On December 18, 1990, the City Council selected an alignment alternative and directed the final design of improvements to Tamarack Avenue between 1-5 and Carlsbad Boulevard. The reconstruction of Tamarack Avenue will also include the undergrounding of all overhead utilities. Staff has met with representatives of the various utility companies and established the precise boundaries of the proposed district with consideration for the location of utility facilities, services to existing buildings, and property boundaries. It is proposed that the Council set a public hearing for August 27, 1991 regarding the formation of this district. Staff will forward information to all property owners explaining the district formation procedures and requirements. Notwithstanding the considerable City contributions to the project, an underground utility district is required on Tamarack Avenue to provide the City with the ability to underground existing utilities and provide for on-site connections of private utility services. Staff recommends approval of the attached resolution setting the public hearing. FISCAL IMPACT: The estimated cost for utility undergrounding as an element of the Tamarack Avenue improvement project is $900,000. This is solely a City expense and an element of the Tamarack Avenue project budget and not the obligation of surrounding property owners nor budgeted within the City's Public Utility Code 20B undergrounding funds through SDG&E. Funds are available in Project Account No. 320-820-1840-3203 for costs associated with undergrounding all utilities in this project. In accordance with Public Utility Code 20B, property owners will be responsible for connectingtheir own on-site utility services at an approximate cost of $1,000 to $1,500 per service. Instituting the Underground Utility District process is required to enable the City's contractor to underground the overhead lines as an element of this project and require adjacent property owners to connect their own on-site services in accordance with the 20B procedures. .. e 0 * Page 2 of Agenda Bill No. I), a';o The cost of the balance of the project which includes the complete road improvements from Jefferson to Carlsbad Boulevard is $1 million. The overall project account totals a $1.9 million project appropriation in the current CIP from Public Facilities Fee funds. EXHIBITS : 1. Location map. 2. WHEREAS, Chapter 11.08 of the Carlsbad Municipal Code provides for the formation in the City of Carlsbad of underground utility districts to accomplish the orderly removal of existing overhead facilities and the construction of new underground facilities; and WHEREAS, the City staff has consulted with the affected utilities and has conducted preliminary studies and made investigations concerningthe feasibility of such a district in an area generally on Tamarack Avenue from Carlsbad Boulevard to 1-5. WHEREAS, said studies and investigations indicate that further proceedings pursuant to Chapter 11.08 are ‘warranted to determine whether or not the district should be established; NOW, THEREFORE, BE IT RESOLVED as follows: 1. NOTICE IS HEREBY GIVEN that a public hearing will be held by the City Council of the City of Carlsbad on September 3,1991, at the hour of 6:OO p.m. in the Council Chambers of the City Hall, Carlsbad, California, to ascertain whether the public health, safety, or welfare require the removal of poles, overhead wires, and associated overhead structures, and the underground installation of wires and facilities for supplying electric, communication or similar associated service in the area hereinabove described and to determine whether or not the City should continue proceedings to create and implement an underground utility district to accomplish said removal and. installation. 3. At said hearing, all persons interested are invited to appear and present their views and all such persons shall be given an opportunity to be heard. Said hearing may be continued from time to time as may be determined by the City Council. 4. The area to be included within the proposed District No. 13 is shown upon that certain map, entitled Wnderground Utilities District No. 13, dated July 18, 1991, which is on file in the Office of the City Clerk of the City of Carlsbad, and which is incorporated by reference herein. 5.
