CA RECOMMENDED ACTION: If Council concurs your action is adopt Resolution No. 9r-p68 approving Site Development Plan SDP 88-3(A) and adopt Ordinance No. NS-166 approving Specific Plan SP 19(E). ITEM EXPLANATION The City Council at your meeting of August 6, 1991 introduced Ordinance No. NS-166 approving Specific Plan SP 19(E) and directed our office to prepare documents approving Site Development Plan SDP 88-3(A). The resolution is attached. The Council should satisfy itself that the findings and conditions as recommended by the Planning Commission accurately reflect your intentions in the matter and then take the recommended action. APPLICANT: CAR COUNTRY PLAZA DELI CASE NO: SP 19(E)/SDP 88-3(A) WHEREAS, on May 15, 1991the Carlsbad Planning Commission held a duly noticed public hearing to consider a Specific Plan amendment 19(E) and Site Development Plan 88-3(A) for a 1,080 square foot delicatessen project and adopted Resolutions Nos. 3220 and 3221 respectively, recommending to the City Council that they be approved; and WHEREAS, the City Council of the City of Carlsbad, on August 6, 1991 held a public hearing to consider the recommendations and heard all persons interested in or opposed to SDP 88-3(A); and WHEREAS, the Planning Director has determined that the amendment is in prior compliance because the environmental effects of the use have already been considered with the Negative Declaration issued on August 5, 1988. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. That the findings of the Planning Commission contained in Resolution No. 3221 are the findings of the City Council. . . . . . . 1 3. SDP 88-3 TO PERMIT A 1,080 SQUARE FOOT DELICATESSEN ON PROPERTY GENERALLY ‘LOCATED IN THE CAR COUNTY EXPANSION SOUTH OF CANNON ROAD, EAST OF PASEO DEL NORTE. CASE NAME: CAR COUNTRY PLAZA DELI CASE NO: SDP 88-3(A) WHEREAS, a verified application has been filed with the City of Carlsbad and referred to the Planning Commission; and WHEREAS, said verified application constitutes a request as provided by Title . i - 21 of the Carlsbad Municipal Code; and 12 WHEREAS, pursuant to the provisions of the Municipal Code, the Planning 13 Commission did, on the 15th day of MAY, 1991, consider said request on property 14 /I described as: 15 16 17 18 Lots 2 and 3 of CT 87-3 . NS-166 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING SPECIFIC PLAN AMENDMENT SP 19(E) FOR THE CAR COUNTRY EXPANSION IGENERALLY LOCATED EAST OF THE EXISTING CAR COUNTRY. CASE NAME: CAR COUNTRY PLAZA DELI CASE NO.: SP 19(E) WHEREAS, the City Council of the City of Carl&ad, California has reviewed and considered a Specific Plan Amendment for future development of the site; and WHEREAS, after procedures in accordance with the requirements of law, the City Council has determined that the public interest indicates that said plan be approved. NOW, THEREFORE, the City Council of the City of Carlsbad does ordain as follows: SECTION I: That the Car Country Expansion Specific Plan Amendment, SP 19(E), as revised dated May 15, 1991, on file with the Planning Director and incorporated by reference herein, is approved. The Specific Plan Amendment shall constitute the zoning for this property and all development of the property shall conform to the plan. SECTION II: That the findings and conditions of the Planning Commission as set forth in Planning Commission Resolution Nos. 3220 and 3221 shall also constitute the findings and conditions of the City Council.
