ITEM EXPLANATION: Continuing drought conditions and limited water resources in California have made it necessary for local agencies to examine and implement new water conservation measures. Requiring installation of Ultra Flush Toilets represents one conservation measure which is being proposed for inclusion in the Carlsbad Municipal Code. Effective ~cvAE.R 3 1991, only tank-type water closets using an average of 1.6 gallons of water per flush or less, would be required for installation in new construction. All tank-type water closets, urinals and associated flushometer valves must meet adequate standards of safety and sanitation. Installation of ultra low flush toilets will apply to existing buildings only when toilets are being replaced in existing 1 bathrooms or installed in new bathrooms. The new ordinance incorporates several provisions for exemption from the low flush requirements. These exceptions would include: (1) when, in the opinion of the Building Official, the configuration of the building drainage system requires a greater quantity of water to adequately flush the system, or (2) if an unreasonable hardship can be demonstrated by an applicant. The requirements for the maximum flush rate of 1.6 gallons per flush may be suspended for a specified period of time by a Resolution adopted by the City Council upon a finding by the Building Official that there is an inadequate supply of water closets or urinals to satisfy the needs of new construction. NS-170 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIF( AMENDING TITLE 18, CHAPTER 18.1 6, BY THE ADDITION OF SECTlON 18.' TO THE CARLSBAD MUNICIPAL CODE TO AMEND BY REFERENCE THE UN PLUMBING CODE, 1988 EDITION TO REQUIRE ULTRA LOW FLUSH TOILETS The City Council of the City of Carlsbad, California, does ordain as follows: SECTION 1: The City Council finds that unique circumstances require certair conservation amendments to the Uniform Plumbing Code. The amendments set forth ordinance are reasonably necessary because of the local climate which includes low and periods of drought. It has become necessary to import over ninety percent of thc for this area. These findings are consistent with the State of California ethic oi conservation and are made pursuant to Sections 17958.5, 17958.7 of the California and Safety Code. SECTION 2: That Title 18, Chapter 18.1 6 is amended by the addition of ! 18.1 6.070 to read as follows: 18.1 6.070 Add Section 901.1 and 901.2, ChaRter 9, Uniform Plumbina Code, as follows: 901.1 Ultra Low Flush Toilets. Effective fl / 3/ 9 1 , only tank-typr closets that use an average of 1.6 gallons of water per flush or less, and urin, associated flushometer valves, that use an average of 1 gallon of water per flush or le be installed in new construction. The provisions of this Section shall apply to existing buildin when toilets are being replaced in existing bathrooms or installed in new bathrooms ExceRtions: The Building Official may allow the use of standard flush toilets or when, in the opinion of the Building Official, the configuration of the building drainage requires a greater quantity of water to adequately flush the system. EFFECTIVE DATE: This ordinance shall be effective sixty days after its adoptic the City Clerk shall certify to the adoption of this ordinance and cause it to be publis least once in the Carlsbad Journal within fifteen days after its adoption.
