Between the City of Carlsbad and the City of Encinitas for Maintenance of the Trafi
Signal at Olivenhain Road and Amargosa Drive.
ITEM EXPLANATION:
As a result of discussions between the City of Carlsbad and the City of Encinitas,
maintenance agreement has been developed for a traffic control signal which borde:
the two cities. The traffic signal is located at Olivenhain Road and Amargosa Driv
The intersection is located two-thirds (2/3) within the City of Encinitas and one-thil
(1/3) within the City of Carlsbad. The agreement reached by the cities specifies th
maintenance and energy costs will be shared on the basis of jurisdictional proximig
The City‘s portion of the annual energy costs are estimated at $850.00. Maintenanc
costs are estimated at $1400.00.
FISCAL, IMPACT.
Although the costs associated with this agreement were not included in the Fiscal Ye:
1991-92 budget, energy costs will be absorbed in account number 001 -820-5410-221
and maintenance costs will be absorbed in account number 001-820-5410-2414.

A RESOLUTION OF THE QTY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA,
AUTHORIZING EXECUTION OF A TRAFFIC
CONTROL SIGNAL MAINTENANCE AGREEMENT
5 WHEREAS, the City of Carlsbad is responsible for the provision o
6 maintenance of all traffic control devices within the City's jurisdictional boundaries ' 11 and

WHEREAS, the City of Carlsbad and the City of Encinitas have negotiate(

AGREEMENT BETWEEN THE
CITY OF ENCINITAS
AND THE CITY OF CARLSBAD
FOR THE MAINTENANCE OF A
TRAFFIC CONTROL SIGNAL SYSTEM AT
OLIVENHAIN ROAD AND AMARGOSA DRIVE
This agreement is made and entered into this - day of
1991, between the City of Encinitas (hereinafter IICITYll), and thl
City of Carlsbad in consideration of the following:
1. The City of Carlsbad and the City desire to cooperate an( jointly participate in the maintenance of a traffic contro. signal system and safety lighting at the intersection 0.
Olivenhain Road and Amargosa Drive.
2. This intersection is 2/3 within the City jurisdiction and 1/:
within the City of Carlsbad jurisdiction.
3. The City of Carlsbad will reimburse City 1/3 of the tota: maintenance and operating costs of the traffic signal systel
and safety lighting. These payments will be made to the Cit: on a monthly basis and .will commence from the date 0.
acceptance of this agreement.
4. This agreement may not be modified, amended. or otherwist
changed unless by an amendment, in writing, and executed b;
the parties.

Dear Lloyd:
I am writing this letter in regard to a maintenance agreement or
the traffic signal at Armagosa Drive and Olivenhain Road.
It is my understanding that in a meeting hel-d in this office or July 6, 1990, the question of maintenance on the subject traffic signal was discussed. The meeting was attended by yourself, Bok Johnson, Mort August (then Director of Public Works, Encinitas) and representatives of McMillin Corporation.
It is my further understanding that an agreement was reached whereby the City of Carlsbad agreed to participate in the maintenance of the subject signal after a one-year period. Because
the one-year period has expired, this agreement would now be ir
effect and have therefore enclosed a copy of a maintenance
agreement for your approval.
