HD. iiizi- CITY Ati CITY nlm* RECOMMENDED ACTION: Adopt Resolution No. 9/ l dW Brocatto. approving the final map of Carlsbad Tract No. 89-l 9, ITEM EXPLANATION: Engineering staff has completed checking the final map of Carlsbad Tract 89-19. This subdivision is located off Batiquitos Drive, north of the Batiquitos Lagoon, west of Interstate-5 and east of Aviara Phase II. It is comprised of 81 lots with uses as follows: 72 lots for single family detached homes, 8 open space lots and one lot deeded to the State Lands Commission. The final map conforms substantially with the Subdivision Map Act, the Carlsbad Municipal Code and with the conditions of approval and the tentative map as approved by the City Council on January 8, 1991, per Resolution No. 91-05. This map has been found to be consistent with the Growth Management Ordinance and the requirements of the Local Facilities Management Plan for Zone 19. For a more complete analysis of the public facilities impact for this project, see the attached Local Facilities Impact Assessment Form. The project density is 3.10 du/acres and is below the Growth Management Control Point of 3.2 du/acre. The findings required to approve the project below the Growth Control Point were made as a part of Planning Commission Resolution on October 17, 1990 and were accepted by City Council. The developer has entered into an agreement with the California Coastal Commission, creating a deed restriction over the open space areas within the subdivision. This deed restriction prohibits any encroachment for development into said areas in perpetuity. The developer has contracted with a licensed environmental consultant to provide construction observation and monitoring services for the mitigation measures required by the tentative map and the environmental impact report for the subdivision. The developer has dedicated all onsite wetlands to the State Lands Commission as required by the tentative map. The project is consistent with the General Plan and RLM/RM Zone, meets all requirements of the Zoning Ordinance, Local Coastal Program, and complies with Growth Management. Staff recommends acceptance of the final map for CT 89-19. 1 FISCAL IMPACT: This project will generate the following fees at building permit issuance: 1. Park-in-lieu Fees 2. Traffic Impact Fees 3. PAGE TWO OF AB# //. 323 The exact amount of public facility fees are unknown until the applicant submits an application for Building Permits. Likewise, the drainage area fees are unknown and will be assessed at the time the City adopts a drainage fee schedule. Public improvements for this project include onsite Batiquitos Drive from existing terminus to boundary, upgrade of offsite Batiquitos Drive to the north to City Standards and construction of streets, storm drains and sewer as shown on the improvement plans. That the above recitations are true and correct. 2. That said Final Map known as Carlsbad Tract 89-l 9, Brocatto from Odmark and Thelan and the Davidson Companies which is on file with the City Engineer and is incorporated herein by reference, is accepted. 3. That the City Clerk is authorized to sign the Certificate of Acceptance on the Final Map. 5.
