RECOMMENDED ACTION:
Authorize staff to enter into an agreement with Telecommunication Resources to p
Telephone Refund Survey for the City of Carlsbad.
ITEM EXPLANATION:
Though staff monitors all the telephone bills received from Pacific Bell, ti some sections of the bills which are beyond our expertise such as tariff ri mi 1 eage charges.
The firm of Telecommunication Resources of New York, Inc. has the abil expertise necessary to survey the city's telephone bills and determine whet charges have been accurate. If they find errors, they work with the ti company to secure a refund for their client. (As an example, San Die{ University reported that they received a refund of approximatley $160,0 result of the services provided by Telecommunication Resources.)
It is also possible that Telecommunication Resoursces will find no billing In that event, the City receives no refund, but we have increased confidenc telephone company's billing procedures. Either way, the City wins.
Telecommunication Resources has been in this business for 13 years, and ni representative in San Diego. Once their proposal was received, staff atte locate other companies providing the same service, but was unsuccessful.
FISCAL IMPACT:
The actual fiscal impact is unkown. The company operates strictly on a co basis. Their fee is 50% of any refund they secure for the city. Therefore, find no errors in the billing, the city will receive no refunl Telecommunication Resources receives no payment for their services.

AGREEMENT
Agreement dated SePt. 18, 1991 between Telecommunication Resources of NY
Inc. (known as TRI) and

City of Carlsbad
CLIENT agrees to engage TRI to conduct a Telephone Refund Survey for the
purposes of obtaining credits, refunds and implement permanent cost
reductions resulting from telephone billing errors and overcharges.
CLIENT agrees to compensate TRI in the following manner:
. For any refunds or credits obtained by TRI from past phone bill errors,
the fee is 50% of the amount received, payable within 30 after receipt
by CLIENT.
If CLIENT does not receive any refunds, credits, or permanent reductions
in future billings, there will be NO FEE charged for TRI’s services.
CLIENT is not responsible for compensating TRI for refunds, credits, or
reductions that have been obtained by CLIENT’S own efforts.
