Construction of the projec anticipated to require nine (9) months to complete. $ h Municipal Projects staff, Purchasing staff, and the City Attorney’s Office 2 reviewed in detail the complete bid documents from all parties, and have concl that the lowest responsive, responsible bidder is Pacific Mechanical Corporat It is therefore recommended that the award of contract be made to Pac Mechanical Corporation. z 0 .. E a 5 4 z 3 0 Fundamental to the successful construction of this project is the continued ac participation of the design engineer. The design engineer’s duties du construction includes the review, processing, and approval of contractor drawing submittals; periodic visits to the site to observe construction progr attendance at construction progress meetings; and participation in the start-ul operation of the new sewage facilities. ! 0 a 0 0 Page 2 of Agenda Bill No. 1/,33% Staff recommends approval of the attached amendment to the design agreement Almgren and Koptionak, Inc., for continued professional engineering services d the construction phase of this project. One of the other bidders filed a bid protest on the issue of whether the 1 bidder was going to perform a major i tem of work in the project with his own f or through a subcontractor. Attached Exhibit 6 is a letter dated August 9, from the lowest bidder, Pacific Mechanical Corporation, indicating this it work will be performed by their own forces and not subcontracted. COASTAL DEVELOPMENT PERMIT: On May 7, 1991, the California Coastal Commission formally approved the iss of a Coastal Development Permit for the project, and that the project conforms the adopted Local Coastal Program. One condition imposed on this project b Coastal Commission is that the City record an irrevocable offer to dedicate t State of California, Department of Fish and Game, an open space easement consi of a 100‘ buffer zone extending from and parallel to the waters edge of Buena Lagoon adjacent to the Home Plant site. The upper 50’ of the buffer area a for a 5’ wide pedestrian trail along its entire width. This will facil installation of a future important trail link to the beach in the City’s ov trails system. Staff recommends approval of the attached grant deed dedicating the area sho the attached map, as an open space easement to the State of California, Depar of Fi sh and Game. PROPOSITION H CAPITAL SPENDING LIMITATIONS: This project is funded entirely with Sewer Funds which is a source of fu exempt from the Proposition H Capital Spending Limitation. Staff recommends an additional appropri from the Sewer Fund of $100,000 and a transfer to this project account. This alleviate the need to appropriate additional Sewer Funds as has been request the 1991-92 CIP. In order to proceed with the construction of this project, recommends that $100,000 be appropriated at this time from the Unappropriated Balance in the Sewer Fund. The City's Purchasing Ordinance allows the City Council to authorize the construction contract amount. Staff recommends that for this project, ten pe (10%) be allocated for the City Manager to approve individual construction c orders of $25,000 or less and a cumulative value of $86,016. If the constru change orders exceed this amount, Council action will be necessary appropriating additional funding and approval of future change orders. Funding for this project from the Sewer Fund is provided through the city sewer connection fee. The recently completed Capacity Fee Update to the C Sewer Master Plan estimates the Home Plant project budget at $1,137,000, The no adjustment to the sewer fee will be necessary. EXHIBITS: 1. Included in the agenda bill was a deed to dedicate an open space easement to the State Dept. of Fish and Game. Subsequent to the City Council Meeting, we were informed by John Cahill that the State is requesting that a different form of deed be used. After checking with the City Attorney, it was determined that the new deed would have to go back to Council for approval. The "old" deed (attached) is not to be processed.
