RECOMMENDED ACTION:
Adopt Resolution No.')/ -3/h approving the First Supplemental Agreement wit1 Atchison, Topeka and Santa Fe Railway Company (AT&SF) for construction of Tamarack Avenue storm drain within existing railroad right-of-way.
ITEM EXPLANATION:
The City Council previously approved Agreement No. 151014 with AT&SF, ( November 1, 1976, for construction of storm drains in AT&SF's right-of-way il around Tamarack Avenue. This agreement requires the execution of a Supplemc Agreement which will enable the installation of a storm drain pipe under railroad tracks at Tamarack Avenue as an element of the City's upcc improvements to Tamarack Avenue from Jefferson Street to Carlsbad Boulevard. Tamarack Avenue improvement plans call for the installation of 24" and 27" : drains inside the railroad right-of-way intercepting the street flows from Tam, Avenue.
This Supplemental Agreement authorizes the City to install all nece: connections inside the railroad right-of-way at Tamarack Avenue at City ex1 subject to AT&SF approval of City plans and AT&SF inspection. Staff recomt approval of the attached First Supplemental Agreement with AT&SF.
FISCAL IMPACT:
Funds in the amount of $1,900,000 have been appropriated for this project an1 available in Project Account No. 320-820-1840-3203. AT&SF administrative cos process the Agreement total $150.00. AT&SF inspection costs are estimated ' $2,500.00 and will be absorbed within the overall City project account wi. requiring additional appropriations.

Santa Fe and Second Party are now parties to an agreement date1 November 1, 1976, Santa Fe's Secretary's Contract No. 151014, together wit: any and a1 1 modifications, supplements and amendments thereto (hereinafte called "Original Contract"), relating to five pipelines located on Santa Fe' property at Carlsbad, San Diego County, California.
Second Party desires to construct an additional 24-inch RCP stor, water pipe1 ine across Santa Fe's right-of-way at MP 230+0507.7 and connec into the existing 4' x 10' box culvert at Tamarack Avenue, and the partie hereto desi re to modify the Original Contract as hereinafter provided.
- AGREEMENT:
IN CONSIDERATION of the sum of One Hundred Fifty and No/100 Dol 1 ar ($150.00) to be paid to Santa Fe by Second Party upon execution of thi Supplement Agreement as a one-time charge for preparation of the revise( Exhibit "A" drawing and admini stration of this Supplemental Agreement, it i I mutually agreed that the print hereto attached No. 1-01 194, date( August 26, 1991, is hereby made part of the Original Contract.
As herein modified, the Original Contract shall continue in ful' force and effect.
