RECOMMENDED ACTION:
If Council concurs your action is adopt Resolution No. q-325 approving the Conditional Negative Declaration, Tentative Map (CT 91-2), Local Facilities Management Plan (LFMP 87-24(A)), Hillside Development Permit (HDP 91-2) and Special Use Permit (SUP 91-1) and adopt Ordinance No. NS-175 approving ZC 91-5.
ITEM EXPLANATION
The City Council at your meeting of September 17, 1991 introduced Ordinance No. NS-175 and directed our office to prepare documents approving the Conditional Negative Declaration, Tentative Subdivision Map CT 91-2, Local Facilities Management Plan LFMP 87-
24(A), Hillside Development Permit HDP 91-2 and Special Use Permit SUP 91-1. The resolution is attached. The Council should satisfy itself that the findings and conditions as recommended by the Planning Commission accurately reflect your intentions in the matter. If the Council concurs, your action is to adopt Resolution No. cl/-325 and Ordinance No. NS-175.

RESOLUTION NO. 91-325
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA APPROVING A CONDITIONALNEGATIVE DECLARATION AND TENTATIVE SUBDIVISION MAP (CT 91-2), LOCAL FACILITIES MANAGEMENT PLAN (LFMP 87-24(A)), HILLSIDE DEVELOPMENT PERMIT (HDP 91-2) AND SPECIAL USE PERMIT (SUP 91-1) FOR A 32 LOT PROJECT ON 14.54 ACRES OF LAND GENERALLY LOCATED ON THE WEST SIDE OF EL CAMINO REAL, NORTH OF CAMINO HILLS DRIVE. APPLICANT: EAGLE CANYON CASE NO: CT 91-2/LFMP 87-24(A)/HDP 91-2/SUP 91-1
WHEREAS, on July 17, 1991 the Carlsbad Planning
Commission held a duly noticed public hearing to consider a
proposed Conditional Negative Declaration, Tentative Subdivision
Map CT 91-2, Local Facilities Management Plan LFMP 87-24(A),
Hillside Development Permit HDP 91-2 and Special Use Permit SUP.91-
1 for a 32 lot project and adopted Resolutions Nos. 3270, 3282,
3271 and 3272 respectively, recommending to the City Council that
the Conditional Negative Declaration, Tentative Subdivision Map CT
91-2, Local Facilities Management Plan LFMP 87-24(A), Hillside
Development Permit HDP 91-2 and Special Use Permit SUP 91-'1 be
approved; and
WHEREAS, the City Council of the City of Carlsbad, on
September 17, 1991 held a public hearing to consider the
recommendations and heard all persons interested in or opposed to
CT 91-2, LFMP 87-24(A), HDP 91-2 and SUP 91-1: and
WHEREAS, a Conditional Negative Declaration was issued on
January 3, 1991 and submitted to the State Clearinghouse for a 30
day review period. All comments received from that review period
are fully incorporated into the conditions of approval for the
tentative map and other project approvals. These conditions will

be reviewed through a monitoring program set up for the project.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Carlsbad, California, as follows:
1. That the above recitations are true and correct.
2. That the conditional negative declaration on the
above referenced project is approved and that the findings and
conditions of the Planning Commission contained in Resolution No.
3268 on file with the City Clerk and incorporated by reference
herein are the findings and conditions of the City Council.
3. That the tentative subdivision map of this project
(CT 91-2) is approved and that the findings and conditions of the
Planning Commission contained in Resolution No. 3270 on file with
the City Clerk and incorporated by reference herein are the
findings and conditions of the City Council.
4. Local Facilities Management Plan LFMP 87-24(A) is
approved and that the findings and conditions of the Planning
Commission contained in Resolution No. 3282 on file with the City
Clerk and incorporated by reference herein are the findings and
conditions of the City Council.
5. Hillside Development Permit HDP 91-2 is approved and
that the findings and conditions of the Planning Commission
contained in Resolution No. 3271 on file with the City Clerk and
incorporated by reference herein are the findings and conditions of
the City Council.
6, Special Use Permit SUP 91-1 is approved and that the
findings and conditions of the Planning Commission contained in
Resolution No. 3272 on file with the City Clerk and incorporated by
reference herein are the findings and conditions of the City
Council.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, AMENDING TITLE 21 OF THE
CARLSBAD MUNICIPAL CODE BY AN AMENDMENT TO THE
ZONING MAP TO GRANT A ZONE CHANGE, ZC 91-5 FROM
L-C TO R-l AND O-S ON PROPERTY GENERALLY LOCATED
ON THE WEST SIDE OF EL CAMINO REAL NORTH OF
CAMINO HILLS DRIVE.

The City Council of the City of Carlsbad, California, does ordain as follows:
SECTION I: That Title 21 of the Carlsbad Municipal Code is amended by the
amendment of a zoning map as shown on the map marked “Exhibit ZC 91-5” attached
hereto and made a part hereof.
SECTION II: That the findings and conditions of the Planning Commission
set forth in Planning Commission Resolution 3269 constitutes the findings and conditions
of the City Council.
EFFECTIVE DATE: This ordinance shall be effective thirty days after its
adoption, and the City Clerk shall certify to the adoption of this ordinance and cause it to
be published at least once in the Carlsbad Journal within fifteen days after its adoption.
