ITEM EXPLANATION:

hl I Earlier this year, the Engineering Department prepared a report
m d "Circulation Implementation Program and Traffic impact Fee Study"
evaluated the City's Traffic Impact Fee (TIF) Program. The purpose
study was to review the existing projects in the current TIF program, t
the City's buildout circulation network, identify future circulation neec
propose appropriate mitigation in order to comply with the Growth Mana
Performance Standard for Circulation. The report then concludes with
u ar of future projects and accompanying estimated costs. These projects

Immediately following the completion of the 1991 Traffic Impact Fee Study, thl
formally approved the formation of Community Facilities District No. 1. The foll
three facilities identified in the TIF report are to be funded by the Community Fa

On July 25, 1991 the Council adopted Resolution No 91 -1 96 providing a credit i

No. 1. Therefore, in order to guarantee the construction of the remaining infrasti

At the July 9, 1991 Council meeting, staff presented a summary of the findings
"Circulation Implementation Program and Traffic Impact Fee Study" and recomr
that the Council accept the report and schedule a public hearing. Since that tin
has met with representative from the Carlsbad Economic Enhancement Commiti
Construction Industry Federation, developers and individual property owners to
various questions regarding this proposal.
Also, a cost estimate for future improvements to El Camino Real from La Costa 1
to Arena1 Road was revised to include bridge widening over the San Marcos Cree

Staff therefore recommends that the Council adopt the ordinance establishing a CI

The Citywide Traffic Impact Fee will guarantee the construction of a number c

Sidewalk Proqram
As a part of the City’s Pedestrian Action Plan, a full inventory of sidewalk deficiencies has be
prepared and a priority program established. The total priority program is estimated to c(
nearly $1 0 million, excluding detailed right-of-way, utility and drainage consideration. As grov
occurs throughout the City, pedestrian activities will increase and provisions for full pedestri
facilities will become vital.
It is recommended that $300,000 per year be provided over a 20 year period to fund prioi
sidewalks. The $6 million is to be included in the Traffic Impact Fee Program. Remaini
funding should be generated from assessments on existing residents from Federal, State a
regional funding sources or from City General Capital Construction GCC funds.
Identified sidewalk projects and rankings are included as Appendix C in the City’s Circulati
as a part of the annual Capital Improvements Program.
Implementation Program and Traffic Impact Fee Study, Actual projects should be establish

Analysis of the overall Circulation Element has indicated that there exist a number of criti
locations that will have difficulty in maintaining the levels of service stipulated in the Grou
Management Plan. To insure optimum system operation all efforts should be made to mane
and monitor the circulation system. Many of the projected City deficiencies are related
inadequacies in the regional freeway networks. Efforts to expand these regional facilities are I
possible at the City level. Attaining the regional transportation and air quality goals will reqi
an aggressive Transportation Demand Management (TDM) Program.
SANDAG is currently working with local agencies and the Air Pollution Control District to deve’
Transportation Demand Management strategies. To facilitate these long-term efforts and
annually monitor impacts on the circulation element, $1,100,000 has been included in the Tra
Impact Fee program to finance management and monitoring efforts over a 20 year period,

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA AMENDING TITLE 18, CHAPTER
18.42 OF THE CARLSBAD MUNICIPAL CODE
ESTABLISHING A TRAFFIC IMPACT FEE
WHEREAS, a report entitled "City of Carlsbad Circulation lmpleme
Program and Traffic Impact Fee Study" was completed in April 1991 and is incorp
as Exhibit A to this ordinance (hereinafter referred to as the "Traffic Impact Fee !
and
WHEREAS, the Traffic Impact Fee Study estimates the capital cc
construction of improvements to implement the City's Circulation Program; and
WHEREAS, fees to implement the construction of those improveme
set forth in the Traffic Impact Fee Study; and
WHEREAS, the fees so established do not exceed the reasonablc
of constructing these facilities and the fees are not levied for general revenue pur
and
WHEREAS, this study was available for public inspection and
fourteen (1 4) days prior to this public hearing; and
WHEREAS, the Finance Director is directed to establish a fund 01
necessary to collect the fees so imposed and to maintain said fund or funds a
interest collected therein and to authorize expenditures for only those projects
payments or other construction activities set forth in the Traffic Impact Fee Stud

TRAFFIC IMPACT FEE
18.42.01 0 Purmse and intent.
(a) This chapter imposes a fee to pay for various traffic circi
improvements within the City of Carlsbad. The amount of the fee is based on a
engineering analysis and has been calculated to be equal to or less than the cost
circulation improvements. The circulation improvements funded by this fee SI

SECTION IV: That the Title 18, Chapter 18.42 of the Carlsbad Municipal Code is
amended by the amendment of Section 18.42.050(a) to read as follows:
18.42.050 Fee. A traffic impact fee of seventy-seven dollars for each average daily trip
generated by a residential project, a traffic impact fee of thirty-one dollars for each
average daily trip generated by a commercial or industrial project, pursuant to Section
18.42.020(e), shall be paid by the owner or developer prior to the issuance of any
building permit or occupancy permit for a project. Traffic Impact Fees shall be adjusted
annually as part of the City's Capital Improvement Program budget process, effective July
1 , 1991 , according to the Engineering News Record Los Angeles Construction Cost Index
with a base year index of 5930.
SECTION V: That Title 18, Chapter 18.42 of the Carlsbad Municipal Code is

amended by the amendment of Section 18.42.070 to read as follows:
18.42.070 Use of Fee. All of the fees collected shall be allocated to a circulation
improvement account and shall be expended only to build or finance circulation
improvements serving the City."
EFFECTIVE DATE: This ordinance was adopted at a noticed public
hearing at which time the Council also considered the Traffic Impact Fee Study which
study and associated information was available to the general public for a period of at
least fourteen (1 4) days prior to the public hearing. The fee established by this ordinance
shall apply to the issuance of any building permit, for any residential development issued
sixty (60) days following this ordinance's adoption and for all other types of development

1, 1991, to consider amending Title 18, Chapter 18.42 of the Carlsbad Municip Code to establish a city-wide Traffic Impact Fee, and to consider designating t circulation improvements to be funded by the Fee.
Copies of the Circulation Implementation Program and Traffic Impact Fee Study a on file in the Office of the City Clerk and are open to public inspection.

RESOLUTION NO. 91-326
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, DESIGNATING THE
CIRCULATION IMPROVEMENTS TO BE FUNDED BY
TRAFFIC IMPACT FEES
WHEREAS, a report entitled "City of Carlsbad Circulation lmplem
Program and Traffic Impact Fee Study" was completed in April 1991, hereinafter
to as the "Traffic Impact Fee Study"; and
WHEREAS, the Traffic Impact Fee Study estimates the capital
construction of improvements to implement the City's Circulation Program; and
WHEREAS, fees to implement the construction of those improvem
set forth in the Traffic Impact Fee Study; and
WHEREAS, the fees so established do not exceed the reasonab
of constructing these facilities and the fees are not levied for general revenue PL
and
WHEREAS, the Traffic Impact Fee Study was available for public ins
and review fourteen (14) days prior to this public hearing; and
WHEREAS, the Financial Management Manager is directed to est8
fund or funds necessary to collect the fees so imposed and to maintain said
funds and the interest collected therein and to authorize expenditures for onll
projects, bond payments or other construction activities set forth in the Traffic Imp$
Study. The Finance Director is further directed to make a report, at least annua
within sixty (60) days of the close of the fiscal year determining the beginning and
balances for the fiscal year and the fees, interest and other income and ami
expenditure on each public facility. The fees deposited in the fund or funds shall
commingled with any other fees or revenue of the City. The Finance Director is
directed to make this information available to the public and to report to the City (
not less than fifteen (1 5) days after making said information available to the publi

Finance Director shall monitor these funds so that, if required, the City Council m,
written findings that all or any portion of the fees remaining unexpended or unco
in the fund for five (5) 01 mOf2 years are still necessary and needed for the PUI
which the fee is to be expended and demonstrate a reasonable relationship betw
fee and the costs of the improvements.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of C
as follows:
1. Pursuant to Chapter 18.42 of the Carlsbad Municipal Code the cir
improvements as shown on Exhibit A attached hereto and made a part hereof I
funded by fees collected under said chapter.
2, The fees collected pursuant to Chapter 18.42 shall be placed in a
fund account designated for use for the improvements designated by this resoli
any subsequent amendments hereto. Funds shall be allocated for specific I
during the annual capital improvement program budgeting.
3. The City Council may advance money from any available source
for the construction of the improvements listed in this resolution or any amendment
and repay the source or fund from the account established pursuant to this resc
