RECOMMENDED ACTION:
Adopt Ordinance No. NS-177, establishing a Traffic Impact Fee.
ITEM EXPIANATION
Ordinance No. NS-177 was introduced and first read at a regular City Council meetin
on October 1, 1991. The second reading allows Council to adopt the ordinance whic
would then become effective in thirty days. The City Clerk will have the ordinanc
published in the "Carlsbad Journal" within fifteen days, if adopted.

AN ORDINANCE OF THE CITY COUNCIL OF THE CIN OF
CARLSBAD, CALIFORNIA AMENDING TITLE 18, CHAPTER
18.42 OF THE CARLSBAD MUNICIPAL CODE
ESTABLISHING A TRAFFIC IMPACT FEE
WHEREAS, a report entitled "City of Carlsbad Circulation lmpleme
Program and Traffic Impact Fee Study" was completed in April 1991 and is incorF
as Exhibit A to this ordinance (hereinafter referred to as the "Traffic Impact Fee I
and
WHEREAS, the Traffic Impact Fee Study estimates the capital cl
construction of improvements to implement the City's Circulation Program; and
WHEREAS, fees to implement the construction of those improveme
set forth in the Traffic Impact Fee Study; and
WHEREAS, the fees so established do not exceed the reasonablc
of constructing these facilities and the fees are not levied for general revenue pur
and
WHEREAS, this study was available for public inspection and
fourteen (14) days prior to this public hearing; and
WHEREAS, the Finance Director is directed to establish a fund o
necessary to collect the fees so imposed and to maintain said fund or funds i
interest collected therein and to authorize expenditures for only those project5
payments or other construction activities set forth in the Traffic Impact Fee Stud
Finance Director is further directed to make a report, at least annually, and witt-
(60) days of the close of the fiscal year determining the beginning and ending bi
for the fiscal year and the fees, interest and other income and amount of expend
each public facility, The fees deposited in the fund or funds shall not be comming
any other fees or revenue of the City. The Finance Director is further directed t

fifteen (15) days after making said information available to the public. The F
Director shall monitor these funds so that, if required, the City Council may make
findings that all or any portion of the fees remaining unexpended or uncommitte
fund for five (5) or more years are still necessary and needed for the purpose tc
the fee is to be expended and demonstrate a reasonable relationship between 1
and the costs of the improvements.
NOW, THEREFORE, the City Council of the City of Carlsbad, C:
does ordain as follows:
SECTION 1 : That Title 18 Chapter 18.42 of the Carlsbad Municip;
is retitled "Traffic Impact Fee" and amended by the amendment of Section 18.42
read as follows:
"Chapter 18.42
TRAFFIC IMPACT FEE
18.42.01 0 Purpose and intent.
This chapter imposes a fee to pay for various traffic circ improvements within the City of Carlsbad. The amount of the fee is based on ;
engineering analysis and has been calculated to be equal to or less than the cos
circulation improvements. The circulation improvements funded by this fee st
designated by City Council resolution. The City Council may modify the designal
amendment to the resolution at any time. It is the City Council's intention to revif
designation of circulation improvements and the amount of the fee on an annual
In reviewing the improvements and amount of the fee the
City Council shall consider, among other things, any changes to the Ian
designations or intensity of development, changes in the amount of traffic generz
anticipated, inflation, and increases in cost of materials and labor.
This chapter is necessary to ensure that adequate circulation faciliti
available to serve the City of Carlsbad in a manner which is consistent with the
general plan. Without the circulation improvements which will be funded by this f
circulation system of the City will be inadequate to serve any further development
City.
SECTION II: That Title 18, Chapter 18.42 of the Carlsbad Municipal CC

SECTION Ill: That Title 18 Chapter 18.42 of the Carlsbad Municipal C
amended by the amendment of Section 18.42.020(e) to read as follows:
(e) "Trip" means an arrival at or a departure from a project by any
vehicle averaged over a one-day period (12:Ol a.m. to 11:59 p.m.) as dete
according to Table 18.42.020(e). In using this table, the square footage of the bt
structure or use shall include all interior floor area of a building or structure, and all
ground area of a use without a structure, except any designated open spacf
Where the table establishes traffic generation for a project on the basis of square fc
acreage, or some other unit, the unit establishing the greatest number of trips s
utilized. When a project has more than one use the number of trips shall be calc
by adding together all the trips generated by each use. For uses not listed in th
the trips shall be calculated by the City Engineer.

SECTION IV: That the Title 18, Chapter 18.42 of the Carlsbad Municipal C
amended by the amendment of Section 18.42.050(a) to read as follows:
18.42.050 Fee.
A traffic impact fee of seventy-seven dollars for each average dz generated by a residential project, a traffic impact fee of thirty-one dollars fol
average daily trip generated by a commercial or industrial project, pursuant to 5
18.42.020(e), shall be paid by the owner or developer prior to the issuance (
building permit or occupancy permit for a project. Traffic Impact Fees shall be ad
annually as part of the City's Capital Improvement Program budget process, effectik
1,1991, according to the Engineering News Record Los Angeles Construction Cost
with a base year index of 5930.
SECTION V: That Title 18, Chapter 18.42 of the Carlsbad Municipal Cc
(a)
amended by the amendment of Section 18.42.070 to read as follows:
18.42.070 Use of Fee. All of the fees collected shall be allocated to a circu
improvement account and shall be expended only to build or finance circu
improvements serving the City."
EFFECTIVE DATE: This ordinance was adopted at a noticed 1
hearing at which time the Council also considered the Traffic Impact Fee Study 1
study and associated information was available to the general public for a period
least fourteen (1 4) days prior to the public hearing. The fee established by this ordin
shall apply to the issuance of any building permit, for any residential development is'
sixty (60) days following this ordinance's adoption and for all other types of develop1
thirty (30) days following its adoption. The City Clerk shall certify to the adoption of
