Gd .rl 0 0 .rl au a(d (d-d d ria, *l-l E VE GO 3v uLl 09) Fi rl c1\ \ Ul \ rl rl ITEM EXPLANATION: This item was placed on the City Council agenda in September by Council Member response to occurrences of property damage (both public and private), and pedestrian, sk and vehicular traffic safety hazards which are reportedly caused by skateboarders. At its September 10, 1991 , the City Council heard testimony from members of the public d nuisances caused by skateboarders, including pedestrian and traffic hazards and proper and their concern for the safety of skateboarders. Those who testified were in support of ar prohibiting skateboarding in certain areas of the City. After hearing this testimony, Council directed staff to prepare an ordinance whic skateboarding in the Village Area, on the blufftop walkway, and in commercial areas Y prohibiting such activity are displayed, such as parking lots near malls and grocery store In response, staff has prepared the attached ordinance which prohibits skateboarding in Redevelopment Zone, on Ocean Street between Cypress Avenue and Carlsbad Village DI the blufftap walkway. In addition, the ordinance also prohibits skateboarding on private prc to the public in general and neighborhood commercial zones where signs are posted. ordinance allows the City Council, by resolution, to prohibit skateboarding at any time public property or public right-of-ways upon the posting of appropriate signs. NS-182 3 4 5 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CA CALIFORNIA, AMENDING TITLE 10 OF THE CARLSBAD MUNICIPAL CODE BY THE ADDITION OF CHAPTER 10.58 TO PROHIBIT SKATEBC WITHIN CERTAIN AREAS OF THE CITY 6 The City Council of the City of Carlsbad, California, does ordain as follows: 7 SECTION 1: That Title 10 of the Carlsbad Municipal Code is amended by thc 8 of Chapter 10.58 to read as follows: 9 "Chapter 1038 Skateboarding 10 11 12 13 14 15 16 17 18 10.58.01 0 skateboarding prohibited in certain areas. (a) It is unlawful for any person to ride a skateboard on any sidew: street, or public property within the Village Redevelopment Zone, or on OCE between Cypress Avenue and Carlsbad Village Drive, or on the blufftop siden Carlsbad Boulevard between Pine Avenue and Tamarack Avenue. (b) The Village Redevelopment Zone, for the purposes of this sectior defined as the area referred to in Section 21.35.01 0 of the Carlsbad Municipal (c) It is unlawful for any person to ride a skateboard on private properl the public in a general or neighborhood commercial zone where signs prohib activity are posted by the owner of the property. (d) In addition to the general regulations imposed by this chapter Council may adopt a resolution regulating the use of skateboards on specifi property or public right-of-ways upon the placement of appropriate signs. Margaret Stanton: Dear Madam, I wish to convey to you our full support on the proposal to ban skateboar on certain streets in Carlsbad, My husband and I manage the apartment building on the corner of Ocean anc Oak Streets in Carlsbad and are aware of the dangers to residents and visitors alike when youths on skateboards zoom up 'out of seemingly nowher and crash either into their person or vehicle. Apart from the physical danger, we are'faced with-the-noise pollution. Tt noise of the skateboard constantly hitting:thef.Concrete:as 'its rider tries to jump a curb or other obstacle. Carlsbad is a beautiful place to live. Let us keep it that way for all a€ groups and let us help attract tourism by keeping Carlsbad a happy and s; place to visit.
