VERBATIM TRANSCFUPT OF BILL TOTH'S STATEMENT
AT COUNCIL MEETING HELD NOVEMBER 12,1991 - ITEM #11
Bill Toth: Mayor, Council Members, Ladies and Gentlemen:
My name is Bill Toth, Project Manager, M. Juarez Construction. My address
is 1540 Harbor Drive, #15, Oceanside, California. I come before you to give
you some insight on the harassment, discrimination and neglect to minority
businesses and to the residents of the Barrio. M. Juarez entered into a
contract with the City of Carlsbad on April 12, 1990, HUD Block Grant
pedestrian ramp improvements in the Barrio. The second day into the
project, the project was shut down by Ron Addison, the site inspector. Mr.
Addison's memo states, and I quote, "There will be no more concrete sawing
until waste material from the previous saw cut is removed." This was just
three hours into the project. Even though the work area was coned in and
ringed with caution tape. Mr. Addison then called our office and threatened
Mr. Juarez's wife. Is this procedure City policy? M. Juarez has been in
business since 1977 and has never had an employee hurt or a liability claim
filed against this company. In addition, M. Juarez has recommendations just
in the year of 1990 from the federal government, the County of San Diego,
the City of Oceanside, the Carlsbad School District, the Vista School District
and the City of Carlsbad. But the principal inspector, Dick Cook, said M.
Juarez was a public nuisance. How can this be the truth? On May 3, 1990,
four working days later, Mr. Addison wanted M. Juarez to do survey work
and look for monuments and bench marks that did not exist. After Mr.

Addison kept on persisting, M. Juarez did extensive research on the drawings
of the year 1959 and found there were no monuments or bench marks. Also,
M. Juarez discovered that the City never put in the storm drain systems ir
the Barrio as the plans of 1959 had indicated. This neglect by the Cig
causes flooding in the Barrio. Mr. Addison wanted M. Juarez to fix thi5
condition as stated in his memo May 15, 99 (sic). Does the City condonc
mystical searches? On May 10, 1990, Dick Cook sent a letter to M. JuareI
requesting a price change to do work on the corners of Grand and Jefferson,
Roosevelt and Beach. The same Dick Cook that said the company was a
public nuisance. M. Juarez refused to do the extra work because it was
obvious the City was going to divert funds from the Bamo to the affluent
downtown area. M. Juarez signs a HUD document called a Project
Statement designating the boundaries of the project. When M. Juarez
refused to do the work, Dick Cook threatened Mr. Juarez and myself that he
could get any two-bit concrete contractors where we came from to do the
job. The harassment intensified after that meeting, even to a display oj
violence against Mr. Juarez by Mr. Addison. Does the City condone this typc
of behavior? M. Juarez was denied the use of a monolithic concrete pourer
even though the City let a bigger contractor a mile away use this application.
This was direct prejudice against M. Juarez Construction. It shows the small
minority businesses that there are two standards being allowed in the City
of Carlsbad. We hope the City Council will take action and correct this
injustice so minority businesses can participate in these projects. The

residents of the Barrio deserve their fair share of the federal and state funds
allocated for their areas. They need your help. Please look into the entire
issue. Thank you very much.
