RECOMMENDED ACTION:
Adopt Resolution No. %-,??L, authorizing the donation of $1,000
received from Federal Equitable Sharing (Police Asset Forfeiture Fut
to Crime Stoppers, Inc.
ITEM EXPLANATIQN:
The City of Carlsbad Police Department receives forfeited funds and
assets periodically as a result of the Department's narcotics
enforcement efforts. Once the Department of Justice Assets Forfei
Fund has disbursed funds to a state or local agency pursuant to an
equitable sharing request, that agency has latitude, per federal
guidelines in determining the use of such proceeds. A local law
enforcement agency may transfer a portion of sharing proceeds to
another agency for a valid law enforcement purpose as this may be (
benefit to the agency making the transfer.
The U. S. Department of Justice Asset Forfeiture Office had determir
in a previous opinion, that a donation of funds from the Asset
Forfeiture Fund would be permissible under the Guidelines and that
there would be no apparent obstacle in preventing equitable sharing
assets from being transferred to Crime Stoppers, Inc.
Crime Stoppers, Inc. is a California non-profit public benefit
corporation which exists primarily as a service to the community ar
as an aid to law enforcement; federal, state, and local in San Diego
County. Chief Vales is a member of the Board of Directors represen
the San Diego County Police Chiefs and Sheriff Associations.
Since its inception in 1984, Crime Stoppers, Inc. has been instrume
in solving over 5,000 crimes, recovering in excess of $3,000,000 in
stolen property, and the arrest of over 700 individuals. It is funded
completely by private citizens, groups, and businesses.
If approved by Council, Carlsbad will join other cities including, Sar
Diego Police and Sheriff, El Cajon, Coronado, La Mesa, Escondido and
Oceanside, who are committing amounts ranging from $500 to $5,00

FISCAL IMPACT:
The donation of these funds has no effect on the City’s General fund
other funds. The unappropriated balance of the Assets Forfeiture
account will be approximately $632,000.00 following this action.

WHEREAS, from time to time, the City of Carlsbad Pok 6

Department receives funds and assets resulting from the Police
Department’s drug enforcement activities; and
WHEREAS, said funds should be utilized for law
enforcement purposes and supporting police activities; and
WHEREAS, San Diego Crime Stoppers is a Citizen
operated, non-profit organization which exists primarily as a
service to the community and as an aid to city police departments,
the Sheriff’s Department, state, and federal police agencies, as w1
as Naval Intelligence, Customs, I.N.S. and the Secret Service; and
WHEREAS, Crime Stoppers’ tips have played an extensivl
role in the cancellation of crime and providing major arrests in
narcotics cases, bank robberies, drive-by shootings, and other
violent crimes;

NOW, THEREFORE, BE IT RESOLVED by the City Council oi
the City of Carlsbad, California, that the amount of $1,000 be heret
donated from the available fraud balance of the Police Asset
Forfeiture Fund to Account No. 121 -820-21 10-2993 to further the
partnership between law enforcement and the community, and the
prevention of criminal activity without fear of jeopardy or
retaliation to one’s self or family.
PASSED, APPROVED, AND ADOPTED at a regular meeting thert
held on the 19 th day of November L 1991, by the
following vote to wit:
