1. Adopt Resolution No. 5 / -3 ?:! authorizing the City Manager to execute a contract
with Coast Wate Management to provide for a three month pilot green waste
eolleetion program.
ITEM EXPLANATION:
Background
Solid waste source reduction and recycling are mandated by AB 939. The County ha
banned disposal of recyclables at the landfill. The City Council has adopted *
mandatory recycling ordinance which complies with the County‘s requirements an
which requires yard or green waste diversion to begin by January 1, 1992.
To provide for yard waste diversion, staff has been surveying jurisdictions through01
the country to determine the most effective collection methods. Staff of the Norl
County Cities have also met to examine the various collection methods in use. In i
attempt to determine the most effective methods, several cities are pursuing pilot ya
waste collection programs using different collection methods. Program effectivene
and cost data developed in the pilot programs will be shared between the cities.
Alternative collection methods include:
1. A claw, shovel, or vacuim collects loose piles at the curb on regular tra
collection days. This merhod requires an investment in capital equipment, a
the potential for contamination from road debris, etc., exists.
2. Yard waste is collected by residents in specially marked bags (eitl
biodegradable or non-biodegradable) and set out at the curb for pickup
regular trash collection clays. This method requires provision of or availabi
to purchase the bags, and in the case of non-biodegradable bags, manual
mechanical debagging. However, it is possible to pass through the cost of program h the price of the bag, resulting in a volume based fee system.
Residents and/or landscapers drop-off yard waste at centralized site(s). ‘
method is less convenient for residents and may result in lower participa
rates, and drop-off sites must be identified. However, this method substanb
reduces collection costs.

at the curb on regular trash collection days. This method requires a large capital
investment in the bins.
Residents are $veri large adhesive stickers to aGx to their own waste cans.
When yard waste is to be s12t out, the resident turns sticker toward street and
separates the yard waste can from their refuse cans by approximately four feet.
Staff has evaluated all of these methodologies and leans toward recommending a system
using biodegradable paper bags. The recommended bag is a 30 gallon capacity, 50
pound wet strength kraft bag. Residents would be charged for the bags and the price
of the bag would include all program costs. This system would accommodate seasonal
variations in volume of yard waste, and would assess costs based on each household's
use. The bag-based approach also provides for easy transition in the event that the City
determines to implement a "co-collection" for refuse and recyclables collection.
"Co-collection" is a system in which mixed refuse, recyclables, and yard waste are all
collected by the hauler in the same truck, and it is sorted at a materials recovery facility (MRF). Typically, refuse is loose, and recyclables and green waste are in specially
marked bags. This system reduces the number of trucks on the road, could eventually
make use of the MRF to be built at the San Marcos landfill, and substantially reduces
collection costs.
However, prior to city-wide implementation of a bag based program, staff recommends
that a pilot project be operated to allow staff the opportunity to evaluate the
effectiveness of the proposed program, acceptance by the public and to determine costs.
The pilot program would be implemented for approximately 1,100 Carlsbad residences
for a three month period (the Term can be extended for two additional three month
periods, at the City's option). These residents would be asked to provide their feedback
to Coast Waste Management arid Utilities & Maintenance staff. Staff hopes to
determine the durability of the bags, the average number of bags used per household
ease of use, public acceptance oft he collection method and an appropriate price for the
bags.

The proposed pilot program would be performed by the City's contracted refuse anc
recycling collection agent, Coast Waste Management (CWM). This service would bf
provided at no cost to the City, with the exception of reimbursement for the yard wastf
collection bags. This cost is estimated to be approximately $6,700, and could be
funded from the Tonnage Grant monies to be received from the County. A contract foi
the pilot program is attached.
The City of Del Mar has approved a city-wide, bag-based collection program. Staff had
met with CWM and City of Del Mar staff to discuss a joint, volume, purchase of th
bags. It was agreed that a volume purchase would reduce costs and CWM agreed ti
purchase the bags in volume for the Cities of Del Mar and Carlsbad. The two cities wi
reimburse CWM for the delivered cost of the bags.

Staff is meeting regularly with staff from the other North County cities to compare
program information and costs of pilot programs. Staff will evaluate and consider other
cities’ success with various methodologies prior to recommending a program for city-
wide implementation in Carlsbad.
Backyard Composthg
Staff is in the process of researching backyard composters. A City-sponsored backyard
composting program would offer residents an alternative to purchasing the green waste
collection bags, and allow them to use the product as a soil amendment in their own
gardens. A backyard composting program would also allow residents to eliminate their
own yard waste, and therefore, participate in solving the solid waste crisis.
Five composters are currently being evaluated by Carlsbad employees who are residents.
Staff intends to present the results to Council along with a recommendation in approximately three to four months,
FISCAL. IMPACT:
The implementation of this pilot program would require reimbursement to CWM for the
purchase of 22,400 yard waste collection bags in the amount of approximately $6,700.
This amount would be funded from the Solid Waste Enterprise Fund. During the pilot
program, these costs would not be passed through to the customer. Should the City
decide to implement this system city-wide, the program costs could be captured in the
price of the bags. However, the bag-based system would require the City to purchase
the bags up front, and be reimbursed as they were sold.

CtlRLSBAD, CALIFORNLA, APPROVING AND AUTHORIZING
EXECUTION OF A PILOT YARD WASIT COLLECTION
CONTRACT WITH COAST WASTE MANAGEMENT, INC.
WHEREAS, on November 5,1991, the City Council adopted a Mandatc
Recycling Ordinance which prohibits the disposal of designated recyclables, includi
yard waste, with mixed refuse; and
WHEREAS, the Ordinance necessitates the provision of yard wa
collection in Carlsbad; and
WHEREAS, staff has determined that a pilot program would best serve
needs of the City; and
WHEREAS, the City's current contracted Refuse Hauler is qualifiec
implement a pilot yard waste collection program;

to as "Contractof'.
WIT N E S S ET H:
WHEREAS, the City does find theproposal tendered by the Contractor for op&ting
a pilot yard waste collection program, including the funishing of all labor, services.
materials and equipment at no cost to the City, except as specifically stated otherwise ir
this contract, a responsible proposal and of high standards;
WHEREAS, the City does further find and determine that it would be in the bes
interests of the City that said proposal be accepted and the contract be awarded to thi
Contractor;
NOW, THEREFORE, for and in consideration of the mutual covenants and promise
of the parties hereto and upon the express tern and conditions hereinafter set forth, it
agreed by and between them, and each with the other, as follows:
1. CONTRACTORS OBLIGATIONS
A The Contractor agrees to furnish all tools, equipment, appmn
facilities, labor, services and materia@, and perform all work necessary to operate in goc
workerlike manner? all facets of a pilot yard waste collection project, three months
duration, according to the proposal (Exhibit A) submitted and accepted and as delinear
in this Contract. It is understood and agreed that all said labor, services, materials, a

1 equipment shall be fiunished and said work performed and completed by the Contract(
as an independent Contractor, subject to the inspection and approval of the City actit
through its Utilities and Maintenance Director or designated representative. The Contract
shall assume all risks for loss of or damage to tools or equipment owned/rented by tl

yard waste collection. Contractor shall also conduct on-going promotion throughout
duration of the piIot project. This promotion will be sufficient to expose all household
the pilot project area to’information about the yard waste collection program&
promotional materials are subject to the review and approval of the Utilities & Mahtena
Director or designee.
E. Contractor agrees 10 accurately record collection data, including ton

G. Contractor shall distribute packages of bags to each partiapatini
household at least seven (7) days prior to the first collection.
I. Contractor shall begin yard waste collection during the week of Januar
13, 1992, and shall make weekly collections throughout the duration of the project.
2. CITY'S OBLIGATIONS
A. The City agrees to rehiburse the Contractor for the delivered cost of tf
yard waste collection bags. The entire cost of the bags will be borne by the City.
B. The City will cooperate with Contractor in the preparation of promotior
materials.
C. The Utilities and Maintenance Director or his designated representati
shall monitor the contract senrice and act as City liaison to the Contractor.
3. WORKERLIKE PERFORMANCE
Contractofs employees shall be required to be clean and neat in appeara
and wear identification. Contractor will be required to submit verification that exnplol
have the right to work in the United States. Contractor shall perform all obligations *
good professional and lawful manner, provide competent and sober personnel, efficient
clean equipment, and service the City in courteous, helpfui and impartial manner.

4. FREOUENCY OF COLLECTION
Contractor shall collect yard waste once per week from each residential

designated in Exhibit B of this contract. Pilot homes will have yard waste collected on th
same day as their regular refuse is collected.
5. HOURS OF COLLECTION
Contractor shall make collection of yard waste between the hours of 7:O
a.m. and dark.
6. HOLIDAYS
The following listed holidays are designated for the purposes of this contrac

Thanksgiving Independence Day Christmas Day
Customers scheduled for collection on a holiday shall be serviced on t
following workday.
7. INDEMNITY
The Contractor shall assume the defense of, pay all expenses of defense, a
indemnify and hold harmless the City, and its agents, officers and employees, from
claims, loss, damage, injury and liability of every kind, nature and description, directly
indirectly axising from or in connection with the performance of this Contract or work;
from any failure or alleged failure of the Contractor to comply with any law, rules
regulations including those relating to safety and health; except for loss or damage wh
was caused solely by the active negbgence of the City; and from any and all claims, k

damage, injury and liability, howsoever the same may be caused, resulting directlj
indirectly from the nature of the work covered by this Contract, unless the loss or dam

8. INSURANCE

9. IMMIGRATION REFORM AND CONTROL ACT
The Contractor shall be aware of and comply with all Federal, State, Coun
and City Statutes, Ordinances and Reflations, including Workers' Compensation hi
(Divhion 4, Califomia labor Code) and the "Immigration Reform and Control Act of 198
(SUSC, Sections 1101 through 1525>, to include but not limited to, verifying the eligibil
for employment of all agents, employees, subcontractors and consultants that an! hdud
in this Contract.
10. ORDINANCES AND RESOLUTIONS
This Contract is subject to all Citfs Ordinances and Resolutions, both pres
and future, to the extent that they regulate the subject matter of this Contract, si
ordinances and resolutions shall bind the parties hereto and shall bind each of the part
here to and are by this reference incorporated herein.
11. REPORTING REOUlREMENTS
A. The Contractor shall submit comprehensive reports to the Utilities a

C. Every month, a lbs/ton count of yard waste collected in the pilot project
will be recorded for the pilot project areas.
D. Separate finanaal records of all costs and revenues associated with the
pilot project will be kept, and subject to the inspection by the City at any time during
normal work hours.
12. - COLLECTION EOUPMENT
The Contractor shall provide an adequate number of vehicles and equipmen
for collection, processing and marketing in order to adequately operate the pilot project
Truck bodies will be all metal and watertight. The Contractor shall paint its name ant
phone number on the sides of each truck used in yard waste collection. Tntcks shall b
cleaned and washed at least once a week and will be maintained in a dean, sanita~
condition at all times.
13. BOOKS AND RECORDS
Collector shall keep true and accurate books and accounts of all busine
done, money received, accounts payable and cash disbursements by reason of
obligations hereunder. Said books and accounts shall be kept separate from any books
accounts for services and Contractois business operations performed outside the scope
the Contract. Said books and records and accounts shall be open to inspection and au

14. ASSIGNMENT
Contractor shall not assign or sub-contract any of the duties ullczer

15. INSPECI'ION
All perfonnance, which includes services, materials, supplies and equipme
furnished or utilized in the performance of this Contract, and workmanship in tl

18. INDEPENDENT CONTRACTOR PROVISION
It is expressly understood and agreed that the Contractor named her& for
the furnishing of all labor, service materials, and equipment performing the work as
provided in this Contract, is acting as an independent Contractor and not as an agent,
servant, or employee of the City.
19. CLAIMS AND LAWSUITS
The Contractor shall compry with the Government Tort Claims Act (Califox&
Government Code, Section 900 et seq.) prior to filing any lawsuit for breach of thi:
Contract or any clatn or came of action €or money or damages.
20. PROVISIONS REOUIRED BY LAW DEEMED INSERTED
Each and every provision of law and clause required by law to be inserted i
this Contract shall be deemed to be inserted therein and included herein, and if, hug
mistake or otherwise, any such provision is not inserted, or is not correctly inserted, thf
upon application of either party, this Contract shall forthwith by physically amended
make such insertion or conection.
21. DEFAULT BY CONTRACTOR
In the event Contractor fails for any reason whatsoever to perdonn 1
obligations hereunder ten (10) days after written notice from City of any default, City m
at its sole option tenninate this conpact.

This Contract may be amended or modified only by written Contract Sig
