Alternative works which could also be considered are the following: 1. Construct sidewalks 220,00( 2. Construct median landscaping 765,00( e 0 Page 2 of Agenda Bill No. /Ij ’{q 7 Obviously, constructing either sidewalk or median landscaping could not be don( without additional funds from property owners. Staff scheduled a meeting with all property owners and asked their opinion. Nc property owner wished to use any of the excess funds for any projects beyond thosc proposed by staff. Two, in fact, felt that all the excess funds should be returnec to the property owners. (See the letter from the Price Club attached a: Exhibit 2.) The extra work proposed by staff will not increase any assessments nor change thc boundaries of the district. Therefore, although a resolution ordering changes i: required, a public hearing is not required. However, staff wanted to keep thc owners informed and provide them with the opportunity to comment and has therefore, noticed this meeting as a public hearing. FISCAL IMPACT: The final project cost was as follows: Property Owners $3,965,980 City Contribution 3,304,466 TOTAL PROJECT COST $7,270,446 The property owner’s balance is as follows: Assessment District Appropriation $4,496,338 Property Owner’s Cost 3,965,980 ASSESSMENT DISTRICT BALANCE $ 530,248 The expenditure of approximately $390,000 on mitigation repair monitoring an maintenance will leave a balance of $140,000 which will be used to reduce propert owner’s payments. ' 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 0 w RESOLUTION NO. 91 -400 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ORDERING CHANGES AND MODIFICATIONS IN PROCEEDINGS AND ASSESSMENTS IN A SPECIAL ASSESSMENT DISTRICT WHEREAS, the City Council of the City of Carlsbad has previous adopted its Resolution of Intention and confirmed an assessment for certain wor of improvement in a special assessment district, pursuant to the terms a provisions of the "Municipal Improvement Act of 1913", being Division 12 of t Streets and Highways Code of the State of California; said special assessme district known and designated as Assessment District No. 86-1 (Palomar Airpc Road), hereinafter referred to as the "Assessment District"; and, WHEREAS, subsequent to the confirmation of the assessment and afl the improvements were ordered, but during the pendency of these proceedings, appears to be in the best public interest to order certain changes i modifications to the proceedings, the Engineer's "Report" and the works improvement. NOW, THEREFORE, BE IT RESOLVED as follows: 1. That the above recitations are true and correct. 2. That it is hereby ordered that certain specific changes ( modifications be made, said changes and modifications generally described follows: A. Mitigation repair and replacement including weeding, planti irrigation repair and fertilizing, cultivating or associa work as required. The other items listed in your letter were not specifically identified as improvements to be taken care of by the assessment and the funds should not be used for those items. We are unable to attend your meeting on October 30, 1991, but we would appreciate your contact after the meeting to inform us of the general comments and information to be presented to the City Council on November 19, 1991.
