ITEM EXPLANATION:
On July 24, 1990, the City Council adopted Resolution No. 90-242 approvinc consultant agreement with Woodward-Clyde Consultants, Incorporated for the des
of the proposed Carlsbad Boulevard Shore Protection Project. On November 12, 19 the California Coastal Commission approved the City’s application for the requi Coastal Development Permit for thi s project. The permit incl uded certain des revisions to the proposed south revetment which will require deletion of revetment and extension of the proposed seawall. All other portions of the projc design were approved by the Commission and will not require any redesign or otl modifications.
City staff and the Consultants have assembled a scope of work and fee schedule perform the additional design services and are presented in attached Amendm No. 1 to the design contract. The Consultant‘s work includes geotechni investigation, preparation of a supplemental design report, attendance at proj meetings, and all design work associated with revisions to the project pla, specifications, contract documents, and project cost estimates. Staff recomrner approval of the attached Amendment No. 1.
Design work associated with these revisions will be completed within sixty (( days and will be reviewed by both Coastal Commission staff and the Califorr Department of Boating and Waterways as a requirement of an existing agreemc between the City and Boating and Waterways in accordance with the grant funding 1 the design of this project.
FISCAL IMPACT:
On February 6, 1990, the City Council adopted Resolution No. 90-27 approving agreement with the State of California Department of Boating and Waterways for t funding of the Phase I design of the Carlsbad Boulevard Shore Protection Projec The City received $300,000 of State funding provided by Assembly Bill 1580, t California Park and Wildlife Preservation Act, which became effective January 1990. These funds have been utilized for all Consultant design cost environmental and other Regulatory Agency processing, and reimbursable City sta costs for the Phase I design of this project. All costs associated with t attached Amendment No. 1 totaling a not-to-exceed $20,000 are reimbursable by t State to the City under the terms of the existing City/Boating and Waterwa agreement.
Staff recommends approval of the attached Amendment No. 1.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING AMENDMENT NO. 1 TO AN AGREEMENT BETWEEN THE CITY OF CARLSBAD AND THE FIRM OF
REVISIONS OF THE CARLSBAD BOULEVARD SHORE PROTECTION PROJECT, PROJECT NO. 3307
WOODWARD-CLYDE CONSULTANTS, INCORPORATED FOR DESIGN
WHEREAS, the City Council of the City of Carlsbad has determined tb
is desirable and necessary to amend an agreement between the City of Carlsb4
the firm of Woodward-Clyde Consultants for the design revisions of the Car
Boulevard Shore Protection Project.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carl
California, as follows:
1. That the above recitations are true and correct.
2. That the City Council approves Amendment No. 1 to an agre
between the City of Carlsbad and the firm of Woodward-Clyde Consultants fc
design revisions of the Carlsbad Boulevard Shore Protection Project, Projec

3. Following the Mayor’s signature of said Amendment No. 1, the
Clerk is authorized and directed to forward copies of said amendment and

AMENDMENT NO. 1 TO AGREEMENT
FOR ADDITTONAL DESIGN SERVICES FOR THE
CARLSBAD BOULEVARD SHORE PROTECIION PROJECX
THIS AMENDMENT NO. 1, made and entered into as of the $9 day of
-.JJ+, 1992, by and between the CITY OF CARLSBAD, a municipal
corporation, hereinafter referred to as TITY," and WOODWARD-CLYDE
CONSULTANTS, INCORPORATED, hereinafter referred to as "CONSULTANT."
RECITALS
WHEREAS, CONSULTANT and CITY entered into an agreement on July 24,
1990, to provide engineering design services for the Carlsbad Boulevard Shore
Protection Project, hereinafter referred to as the "PROJECT"; and
WHEREAS, said agreement identified a scope of work including the
preparation of plans, specifications, contract documents, and cost estimates for the
PROJECT; and
WHEREAS, the parties to this aforementioned agreement desire to expand the
scope of work to include additional design services including, but not limited to,
supplemental design and redesign of various elements of the PROJECT; and
WHEREAS, CONSULTANT possesses the necessary skills, experience,
professional expertise, financial abilities, and other qualifications to provide said
services required by CITY; and

WHEREAS, a supplemental scope of work and fee schedule have been
negotiated and agreed to between the parties hereto; and
WHEREAS, the City Council of the City of Carlsbad, California, hereby finds
it necessary, desirable, and in the public interest to proceed with this Amendment
No. 1 for said additional work.
NOW, THEREFORE, in consideration of these recitals and the mutual
covenants contained herein, CITY and CONSULTANT hereby agree as follows:
1. CONSULTANT shall provide the following scope of work:
e Perform additional geotechnical investigation required to
facilitate the redesign of the proposed PROJECT south
revetment to include all field services, office engineering,
equipment, manpower, materials, supplies, and other related
work and facilities required of this effort. . Evaluate and propose alternative design options including, but
not limited to, a structured wall redesign in lieu of the
proposed south revetment as indicated in the PROJECT plans
and specifications.
e Prepare a supplemental design report for selected alternative
shore protection structures in lieu of the proposed south
revetment.
e Attend all meetings with CITY and other public agencies as
may be required to facilitate approval of the redesign of the

south revetment including, but not limited to, attendance at
California Coastal Commission, State Parks, City of Carlsbad ,
California Department of Boating and Waterways, and other
meetings as may be required. CONSULTANT shall provide any
and all exhibits, reports, data, and any other materials required
for said meetings.
b Make revisions to the PROJECT plans, specifications, contract
documents, cost estimates, and other related PROJECT
documentation as may be required to include the alternative
design for the south revetment as may be required under
conditions fulfilling CITY'S California Coastal Commission's
coastal development permit for said PROJECT.
0 Coordinate all design activities with CITY and other public
agencies as may be required.
2. CITY shall pay CONSULTANT for all work associated with Paragraph
1 above, on a time and materials basis not to exceed $20,000. CONSULTANT shall
provide CITY on a monthly basis copies of invoices sufficiently detailed to include
hours performed, hourly rates, and related activities and costs for approval by CITY.
All provisions of the aforementioned agreement entered into on July
24, 1990, by and between CITY and CONSULTANT shall remain in full force and
effect.

4. This Amendment No. 1 to the aforementioned agreement between
CITY and CONSULTANT shall be effective on and from the day first above written.
