ENG CITY RECOMMENDED ACTION: Adopt Resolution No. 92-& C accepting a portion of a previously rejectec dedication to accommodate a future traffic signal, and direct the City Clerk to cau acceptance to be recorded in the office of the County Recorder. ITEM EXPLANATION: As a condition of approval of the proposed La Costa Hotel and Spa Laundry Fac owners are required to provide the appropriate street easement to accommoc installation and maintenance of a future traffic signal at the intersection of Costa Road and El Camino Real. Costa Del Mar Road was offered for dedication on Ma File No. 102138 dated June 18, 1968 and rejected. A note was placed on tl clarifying the point that this is an irrevocable offer of dedication and that it accepted at any time. Total area of dedication equals 740 square feet, and is de and shown on the attached Exhibits. The area to be accepted at this time is for the purpose of installing traffic sigr detectors and represents only a small portion of the land which has been offc dedication and rejected per the previously referenced map. The remaining portio land offered for dedication will remain available for acceptance by the City in accc with the terms of the previous offer and in accordance with State law. FISCAL IMPACT: Required dedication as a condition of approval will save the City expenses in th right-of-way acquisitions. WHEREAS, Costa Del Mar Road was previously irrevocably offered for de the public pursuant to Map No. 61 29 File No. 1021 38 dated June 18, 1968, and WHEREAS, said offer of dedication was rejected subject to acceptance by at a future date; and, WHEREAS the City Council of the City of Carlsbad now deems it to be in interest to accept a potion of said offer for the purpose of the installing a traffic : appurtenant loop detectors. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of California, as follows: 1. 2. That the above recitations are true and correct, That the portion of the previously rejected offer of dedication from Hotel & Spa Corporation over a portion of a private street known as Costa Del adjacent to the existing El Camino Real street easement described in Exhibits A accepted. 3.
