McCann and Deborah S. McCann to quitclaim the ( interest in a waterline easement located on their property at 3475 Charter Oak Drive easement was originally dedicated to the Carlsbad Mutual Water Company of whic September 18, 1991 to Mr. and Mrs. McCann stated that the easement is not utilized and that their master plan has no use scheduled for this easement now or future. The above easement is no longer necessary and staff recommends that Council ap the quitclaim requested by Mr. and Mrs. Kevin E. McCann. City is successor in interest. WHEREAS, Kevin E. McCann and Deborah S. McCann have submitted a requ quitclaim of a water easement which was originally dedicated to the Carlsbad Mutual Company over a portion of their property located at 3475 Charter Oak Drive; and, WHEREAS, the City of Carlsbad is the successor in interest to the Carlsbad Water Company; and, WHEREAS, said easement was never utilized for the purpose for which it was g and is not now nor is it contemplated to be needed for the purpose of waterline instal and, WHEREAS, the City Council of the City of Carlsbad has determined it to be public interest to quitclaim said easements; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Car California, as foIIows: 1. 2.
