As directed by the City Council at its meeting of February 4, an amendment to Chapter 5.12 entitled ttCardrooms'l of the Car Municipal Code had been drafted to permit the playing of under rules established by the City Manager at the Carlsbad S
Center. This amendment will permit the playing of cards a
Carlsbad Senior Center but will not alter the general prohik on the establishment of cardrooms in the City except for lawfully established prior to 1988. Under this amendment, thc Manager may establish rules to permit the playing of cards i Senior Center at the times and under conditions that he reasonable to accommodate the various programs, service opportunities that are offered.
FISCAL IMPACT
Minor but unknown expenditure of staff time drafting reas
rules and regulations monitoring the playing of cards.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD, CALIFORNIA, AMENDING TITLE 5, CHAPTER 5612
ESTABLISH REGULATIONS OF CARD GAMES IN PUBLIC
BUILDINGS
OF THE CARLSBAD MUNICIPAL
CODE BY THE ADDITION OF SECTION 5.12.025 TO
WHEREAS, seniors at the Carlsbad Senior Center desire
to play cards where nominal consideration is paid foi
confectioneries, an annual dinner and monetary prizes; and
WHEREAS, the seniors do not wish to violate th
provisions of Carlsbad Municipal Code Chapter 5.12 entitle
llCardroomsll ; and
WHEREAS, complaints have been received that th
playing of cards at the Carlsbad Senior Center COIlStitUtC
gambling; and
WHEREAS, the office of the district attorney hi
determined that such card games do not violate any state lat
and
WHEREAS, it is necessary to amend Chapter 5.12 of t
Carlsbad Municipal Code entitled llCardroomslv to provide
exception for the playing of cards at the Carlsbad Seni
Center; and
WHEREAS, this exception will not permit the playing
cards or cardrooms at any other place or location in the City
Carlsbad except where previously lawfully existing cardrooms
provided in that chapter,
NOW, THEREFORE, the City Council of the City
Carlsbad, California, does ordain as follows:

SECTION 1: That Title 5 , Chapter 5.12 of the Carlsbad
Municipal Code is amended by the addition of Section 5.12.025 to
read as follows:
"5.12.025 ExceDtions
"This chapter shall not apply to the lawful playing of card games at the Carlsbad Senior Center at such times and under such reasonable rules and regulations as established by the city manager."
EFFECTIVE DATE: This ordinance shall be effectivc
thirty days after its adoption, and the city clerk shall certif!
to the adoption of this ordinance and cause it to be publishec
at least Once in the Carlsbad Journal within fifteen days afte
its adoption.
INTRODUCED AND FIRST READ at a regular meeting of th
Carlsbad City Council on the 18th day of Februarv , 1992
and thereafter
PASSED AND ADOPTED at a regular meeting of the Cit
Council of the City of Carlsbad on the
1992, by the following vote, to wit:
