Adopt Resolution No. q 2 .- & 3 appropriating an additional $1 2,500 to U;
Maintenance Asphalt Repairs Account for the repair of defective street improv
CT 81 -1 6, Vista Santa Fe.
1 ITEM EXPLANATION:
On January 21, 1992 City of Carlsbad City Council accepted a settlement in
entitled Homes bv Polvaon vs Citv. The settlement required Homes by Polyg
to the City the sum of $12,500 to offset the cost of repairing defecti
improvements in CT 81-1 6, Vista Santa Fe. The Utilities and Maintenance Dt
recently awarded a contract to resurface various streets throughout the City an
be more cost effective to include these repairs in this contract rather than
separate contract.
1 FISCAL IMPACT:

The $12,500 was paid to the City by Homes by Polygon and has been te
deposited into the General Fund, These funds will be appropriated into the Uti
Maintenance Asphalt Repairs account to cover the cost of street repairs.

APPROVING AN ADDITIONAL APPROPRIATION OF $1 2,500.00 TO UTILITI
AND MAINTENANCE ACCOUNT NO. 00.1 -820-51 10-241 2.
WHEREAS, the City recently settled a lawsuit entitled Homes bv Polvaon vs

WHEREAS, a part of the settlement required Homes by Polygon to pay to tl
sum of $1 2,500.00 for the repair of defective street improvements in CT 81 -1 6, Vistz

8 WHEREAS, it is in the public interest to repair the defective street improb
