RECOMMENDED ACTION:
Adopt Resolution No.c/X-?S approving a consultant agreement for the Adams St Roadway Alignment Study, Project No. 3364.
ITEM EXPLANATION:
The City Council previously adopted Resolution No. 89-412 establishing a spe street standard for Adams Street between Harrison Street and Park Drive. At time, it was determined that the hillside nature of this segment of roa warranted a refined design to minimize potential grading impacts. Followi period in which staff worked with property owners, the Traffic Safety Commiss and the Planning Commission to review standards alternatives, the City Cou adopted a street standard consisting of a thirty-four foot wide roadway with lanes on both sides of the street, and sidewalk on the east side. In orde minimize grading impacts, this standard will be accomplished through a meande centerline within the full 60 foot right-of-way, which the City will continu acquire through dedications.

Nineteen (19) consulting engineering firms were recently solicited for desigi this project, and thirteen (13) proposals were received. Following a review of thirteen (13) proposals, the firm of Dudek & Associates was selected as the I qualified engineering consultant for this project.
The scope of work outlined in the attached consultant agreement between the I and Dudek & Associates identifies the following tasks:
Development of three (3) roadway a1 ignment alternatives, identif, potential environmental , geotechnical , right-of-way, grading, drainage, other associated construction impacts of each alternative.

Staff recommends approval of the attached consultant agreement between the City Dudek & Associates. Completion of the conceptual design plans and associ documents will require approximately thirty (30) weeks.
FISCAL IMPACT:
The attached consultant agreement provides for a lump sum fee of $78,188 for necessary design services. The City Council has previously appropriated $80 of General Capital Construction funds for this project in Account No. 300-820-1 3364. It is anticipated that these funds would be reimbursed by property ow either through an assessment district or fee levied at the time of developme

Staff recommends that $10,200 be appropriated to the project account from General Capital Construction Fund balance. In the future, additional funding be required to complete the detailed construction plans and specifications for improvements of the preferred alignment of Adams Street. An estimate of t design costs, as well as construction costs, will be determined as part of project. It is envisioned that the ultimate construction of the improvements be funded and accomplished by the abutting property owners along Adams Stree

AGREEMENT FOR
CONCEPT DESIGN SERVICES FOR
ADAh4S STREET ROADWAY ALIGNMENT STUDY
THIS AGREEMENT, made and entered into as of the day of
, 19, by and between the CITY OF CARLSBAD, a
municipal corporation, hereinafter referred to as "City", and DUDEK & ASSOCIATES,
INCORPORATED, hereinafter referred to as "Consultant".
RECITALS
City requires the services of a civil engineering consultant to provide the
necessary engineering design services for preparation of conceptual plans, studies,
and recommendations for the Adams Street Roadway Alignment Study; and
Consultant possesses the necessary skills and qualifications to provide the services
required by the City;
NOW, THEREFORE, in consideration of these recitals and the mutual
covenants contained herein, City and Consultant agree as follows:
1. CONSULTANT'S OBLIGATIONS
PHASE 1: PROJECT MANAGEMENT, DATA COLLECTION AND FIELD
RECONNAISSANCE
Obtain base information, review project and site history, and set
groundwork for project studies.
Purpose:

Task 1.1 - Proiect Mananement and Coordination
The Consultant will meet with City periodically throughout the project
duration to share in research findings and determine that alternative decisions are
consistent with the City's goals.
Attend City and public information workshops.
A maximum of 4 (total) meetings and/or workshops have been budgeted for
this task.
Perform in-house quality assurance review of all documents at completion of
Phase 3.
Task 1.2 - Research and Site Reconnaissance
Obtain relevant "as-built" street and right-of-way control plans to determine
location of existing utilities and horizontal control. "Potholing" of utilities is not
included in this task, but should be performed during final design. Perform site
visits to verify existing conditions.
Task 1.3 - Field Survey and Aerial TOPO~D hy
Perform field survey and office support calculations to set aerial pre-marks,
retrive centerline and pertinent boundary monumentation in order to establish
alignment control. Perform supplemental surveying to provide the following:
A. Locate critical cultural features such as blow-off valves, SDG&E vaults,
etc., that pose constraints to the alignment;
B. Cross-section at selected intervals, but no less than 50' stations except
at the hairpin curve area;
C. Existing superelevation sections of the roadway;

D. Profile existing intersections (Le., Hoover, Highland & Park) to verify
that any realignment of Adams Street provides smooth transitions to existing
improvements.
Provide digital based aerial topographic mapping at 1" = 40' scale horizontal
and 2-foot intervals. Provide color aerial photograph (1'' = 40') with existing lot
lines and right-of-way superimposed with additional enhancements.
Task 1.4 - Base Sheet Preparation
Utilizing the digital based aerial topography, prepare base sheets on standard
City D-sheets. These base sheets will reflect existing utilities, street right-of-ways,
and lot lines.

PHASE 2: ALTERNATIVE ANALYSIS - ENVIRONMENTAL RECONNAISSANCE
REPORT
City and Consultant will analyze three (3) alternatives and select a
desired alignment for final plan preparation.
Purpose:
Task 2.1 - Environmental Field Reconnaissance
Perform archaeological and paleontological record searches aid a biological
field reconnaissance. The biological reconnaissance is a cursory study and not a
typical field survey. Field surveys for archaeological, paleontological, and biological

resources would only be conducted if the initial research described zbove indicates
the need for follow-up survey. These activities are shown as additional services in
Phase 4 and would be undertaken only with City direction and approval.
Task 2.2 - Geotechnical Evaluation
Review geologic maps and literature pertaining to the site area including
steroscopic aerial photographs.
Perform reconnaissance of the site area.
Prepare a report summarizing the findings and conclusions regarding geologic
and geotechnical impacts which may affect the site.
Task 2.3 - Preliminary Alternatives
Incorporate the findings generated from the Environmental Field
Reconnaissance, Task 2.1, and prepare up to three (3) alternative alignment studies.
The alignments will utilize AutoCAD overlays depicting right-of-way limits, street
section location, and grading limits for each scenario. Consultant will follow the
design criteria and typical street section stipulated in the request for proposal dated
August 21, 1991.
Meet with City to review alternatives.
Based upon City reviews and comments, revise alternatives accordingly in
preparation for the report and selection process.

Task 2.4 - Proiect Report
Compile all supporting documentation, appropriate attachments,
environmental field reconnaissance findings, pro and con recommendations for each
alternative, and prepare design report.
Submit report for City review and comment. Incorporate comments and
feedback received from City review and prepare Final Report for the presentation
and selection process.
Task 2.5 - OwnershiD and Aliment Presentation Gra~hics
Mount the aerial photographs obtained in Task 1.3 on 0.125" foam board and
enhance with additional graphics and overlays to illustrate the three (3) alternatives
in preparation for presentations to the public and City Council.
The above photographs will depict existing lot lines and street right-of-ways.
In addition, tax accessor parcel numbers and property ownership will be represented
in a tabular format.
The Consultant proposes to use "see through' overlays mounted with Velcro
to illustrate each alternative alignment. This approach will allow the viewing of
multiple alternatives and the different impacts one alternative has relative to
another.

PHASE 3: FINAL ALIGNMENT DESIGN AND ENVIRONMENTAL ASSESSMENT
(EIA)
Obtain direction from City on the desired alignment and prepare final
concept design.
Purpose:
Task 3.1 - Final Aliment Desim
Incorporate input and direction received from Phase 2 and prepare final
concept design for the preferred alignment on standard City "D" sheets. Plans will
reflect the following: title sheet, typical street section, plan and profile sheets,
grading limits, and proposed retaining walls, if required.
Task 3.2 - Final Rinht-of-Way Plat (Horizontal Control Plan)
Prepare right-of-way drawing for the selected alignment depicting right-of-
way and slope easement "takes." This will be a comprehensive plat on standard City
"D" sheets with call outs for square foot area of each "take area" and the associated
property owner and tax parcel. Individual plats for each parcel are not anticipated.
Prepare Horizontal Control Plan for the entire alignment. The Horizontal
Control Plan will reflect the basis of bearing and control network used to establish
the project alignment and tie-ins to surrounding Maps of Records. Coordinate point
numbers will be set up at all boundary ties, centerline BC's and EC's, and other
pertinent control points. The point numbers with their corresponding northing and
easting coordinates will be plotted in tabular form.

Task 3.3 - HYdrolo~~ Bash MaDphg
Prepare hydrology map of the drainage basin and identify areas of concern
regarding pick-up and discharge locations and recommendations for proposed storm
drain facilities. The final concept plan will only show the location of proposed
storm drain facilities 36" in diameter or larger.
Task 3.4 - Estimate
Prepare engineeJs cost estimate and quantity take-off for earrhwork and all
project improvements.
Task 3.5 - Environmental Impact Assessment (EM]
Complete City of Carlsbad Environmental Impact Assessment (EIA) Form,
Part I, for the selected alternative.
The Consultant will submit the draft EIA for City review and comment. City
will process the document through the City Planning and/or Engineering
Department. The City will also be responsible for the public review and
distribution, if required.
The Consultant will revise the draft document and resubmit the final EIA
form to the City.
PHASE 3 - DELnrERABLES

PHASE 4: OPTIONAL SERVICES
Purpose:
Task 4.1 - Environmental Services
Provide additional services on an as-needed basis.
Perform field surveys for archaeological, paleontological, and biological
resources if required as a result of the reconnaissance performed with Task 2.1.
PROJECT ASSUMPTIONS:
The Environmental Documentation will be prepared based upon the following
assumptions:

The City shall be the Lead Agency for the environmental review.
Environmental review documentation shall include an Environmental
Impact Assessment for one preferred alignment, also referred to as an Environmental
Impact Assessment Form, Part I. This is equivalent to an Initial Study as described
in the CEQA Guidelines. An EIR shall not be required without revisions to the
Scope of Work and Cost Estimate.
C. All environmental issues listed in the Environmental Assessment shall
be addressed, with supplementary technical studies provided for the following
environmental issues: biological resources, archaeological resources, and
paleontological resources. The supplementary technical studies will be attached to
the Environmental Assessments as appendicies. If additional significant

environmental issues are identified during the environmental review process, the
Consultant will prepare a revision to the Scope of Work and Cost Estimate.
D. It is our understanding that the supplementary technical studies will
initially be used as part of the planning process to identify select environmental
constraints associated with three preliminary alternatives to aid the City and
Consultant in choosing a preferred alignment. Once a preferred alignment has been
selected, the technical studies will support the conclusions of the EIA.
E. The proposed scope of work does not include a Negative Declaration,
Mitigated Negative Declaration, Mitigation Monitoring Program, or Cost Estimates
for mi tigation measures.
F. It is our understanding that the discretionary action for which the
Environmental Impact Assessment is being completed is a Specific Alignment for
Adams Street, which requires approval by the City Council.

2. CITY OBLIGATIONS
The City shall provide blank mylar plan and plan/profile standard drawing
sheets.
3. PROGRESS AND COMPLETION
The work under this contract will begin within ten (10) days after receipt
of notification to proceed by the City and be completed within thirty (30) weeks of
that date in accordance with the Consultant's Scope of Work, attached hereto as
Exhibit "A", dated January 29, 1992. Extensions of time may be granted if
requested by the Consultant and agreed to in writing by the City Project Manager.
The City Project Manager will give allowance for documented and substantiated
unforeseeable and unavoidable delays not caused by a lack of foresight on the part
of the Consultant, or delays caused by City inaction or other agencies' lack of timely
action. .Exhibit "A" is hereby incorporated and made a part of this agreement.
4. FEES TO BE PAID TO CONSULTANT
The total shall not exceed the fee payable according to Paragraph 6, "Payment
of Fees," and shall be $78,188 in accordance with the Consultant's Fee Schedule,
attached hereto as Exhibit "B", dated January 29,1992. No other compensation for
services will be allowed except those items covered by supplemental agreements per
Paragraph 8, "Changes in Work." Exhibit "B" is hereby incorporated and made a
part of this agreement.

5. DURATION OF CONTRAm
This agreement shall extend for a period of one (1) year from date thereof.
The contract may be exiended for one (1) additional one (1) year periods or parts
thereof, based upon satisfactory performance and the City's needs.
6. PAYMENT OF FEES
Payment of fees shall be monthly based upon percentage of completion of the
work.
7. FINAL SUBMISSIONS
Within fifteen (1 5) days of completion of Phase 3, the Consultant shall deliver
to the City the following items:
a. Final concept design plans on standard City "D" sheets.
b. Right-of-way plat.
c. Hydrology basin mapping.
d. Engineer's cost estimate and earthwork quantity take-off.
e. City of Carlsbad Environmental Impact Assessment Form, Part I.
8. CHANGES IN WORK
If, in the course of the contract, changes seem merited by the Consultant or the
City, and informal consultations with the other party indicate that a change in the
conditions of the contract is warranted, the Consultant or the City may request a
change in contract. Such changes shall be processed by the City in the following

manner: A letter outlining the required changes shall be forwarded to the City by
Consultant to inform them of the proposed changes along with a statement of
estimated changes in charges or time schedule. A supplemental agreement shall be
prepared by the City and approved by the City according to the procedures
described in Carlsbad Municipal Code Section 3.28.1 72. Such supplemental
agreement shall not render ineffective or invalidate unaffected portions of the
agreement.
9. COVENANTS AGAINST CONTINGENT FEES
The Consultant warrants that their firm has not employed or retained any
company or person, other a bona fide employee working for the Consultant, to
solicit or secure this agreement, and that Consultant has not paid or agreed to pay
any company or person, other than a bona fide employee, any fee, commission,
percentage, brokerage fee, gift, or any other consideration contingent upon, or
resulting from, the award or making of this agreement. For breach or violation of
this warranty, the City shall have the right to annul this agreement without liability,
or, in its discretion, to deduct from the agreement price or consideration, or
otherwise recover, the full amount of such fee, commission, percentage, brokerage
fees, gift, or contingent fee.

10. NONDISCRIMINATION CLAUSE
The Consultant shall comply with the state and federal laws regarding
nondiscrimination.
11. TERMINATION OF CONTRACI'
In the event of the Consultant's failure to prosecute, deliver, or perform the
work as provided for in this contract, the City may terminate this contract for
nonperformance by notifying the Consultant by certified mail of the termination of
the Consultant. The Consultant, thereupon, has five (5) working days to deliver
said documents owned by the City and all work in progress to the City Project
Manager. The City Project Manager shall make a determination of fact based upon
the documents delivered to City of the percentage of work which the Consultant has
performed which is usable and of worth to the City in having the contract
completed. Based upon that finding as reported to the City Manager, the Manager
shall determine the final payment of the contract.
12. DISPUTES
If a dispute should arise regarding the performance of work under this
agreement, the following procedure shall be used to resolve any question of fact or
interpretation not otherwise settled by agreement between parties. Such questions,
if they become identified as a part of a dispute among persons operating under the
provisions of this contract, shall be reduced to writing by the principal of the
Consultant or the City Project Manager. A copy of such documented dispute shall

be forwarded to both parties involved along with recommended methods of
resolution which would be of benefit to both parties. The City Project Manager
or principal receiving the letter shall reply to the letter along with a recommended
method of resolution within ten (10) days. If the resolution thus obtained is
unsatisfactory to the aggrieved party, a letter outlining the dispute shall be
forwarded to the City Council for their resolution through the Office of the City
Manager. The City Council may then opt to consider the directed solution to the
problem. In such cases, the action of the City Council shall be binding upon the
parties involved, although nothing in this procedure shall prohibit the parties
seeking remedies available to them at law.
13. SUSPENSION OR TERMINATION OF SERVICES
This agreement may be terminated by either party upon tendering thirty (30)
days written notice to the other party. In the event of such suspension or
termination, upon request of the City, the Consultant shall assemble the work
product and put same in order for proper filing and closing and deliver said product
to City. In the event of termination, the Consultant shall be paid for work
performed to the termination date; however, the total shall not exceed the lump
sum fee payable under paragraph 4. The City shall make the final determination
as to the portions of tasks completed and the compensation to be made.

14. STATUS OF THE CONSULTANT
The Consultant shall perform the services provided for herein in Consultant’s
own way as an independent contractor and in pursuit of Consultant’s independent
calling, and not as an employee of the City. Consultant shall be under control of
the City only as to the result to be accomplished, but shall consult with the City as
provided for in the request for proposal.
The Consultant is an independent contractor of the City. The payment made to
the Consultant pursuant to the contract shall be the full and complete compensation
to which the Consultant is entitled. The City shall not make any federal or state tax
withholdings on behalf of the Consultant. The City shall not be required to pay any
workers’ compensation insurance on behalf of the Consultant. The Consultant
agrees to indemnify the City for any tax, retirement contribution, social security,
overtime payment, or workers’ compensation payment which the City may be
required to make on behalf of the Consultant or any employee of the Consultant for
work done under this agreement.
The Consultant shall be aware of the requirements of the Immigration Reform
and Control Act of 1986 and shall comply with those requirements, including, but
not limited to, verifying the eligibility for employment of all agents, employees,
subcontractors and consultants that are included in this agreement.

15. CONFORMITY TO LEGAL, REOUIREMENTS
The Consultant shall cause all drawings and specifications to conform to all
applicable requirements of law: federal, state and local. Consultant shall provide
all necessary supporting documents, to be filed with any agencies whose approval
is necessary.
The City will provide copies of the approved plans to any other agencies.
16. OWNERSHIP OF DOCUMENTS
All plans, studies, sketches, drawings, reports, and specifications as herein
required are the property of the City, whether the work for which they are made be
executed or not. In the event this contract is terminated, all documents, plans,
specifications, drawings, reports, and studies shall be delivered forthwith to the City.
Consultant shall have the right to make one (1) copy of the plans for his/her
records.
17. REPRODUCTION RIGHTS
The Consultant agrees that all copyrights which arise from creation of the
work pursuant to this contract shall be vested in City and hereby agrees to
relinquish all claims to such copyrights in favor of City.

18. HOLD HARMLESS AGREEMENT
The City, its officers, and employees shall not be liable for any claims,
liabilities, penalties, fines, or any damage to goods, properties, or effects of any
person whatever, nor for personal injuries or death caused by, orresulting from, any
intentional or negligent acts, errors or omissions of Consultant or Consultant’s
agents, employees, or representatives. Consultant agrees to defend, indemnify, and
save free and harmless the City and its officers and employees against any of the
foregoing claims, liabilities, penalties or fines, including liabilities or claims by
reason of alleged defects in any plans and specifications, and any cost, expense or
attorney’s fees which are incurred by the City on account of any of the foregoing.
19. ASSIGNMENT OF CONTRAC”
The Consultant shall not assign this contract or any part thereof x any monies
due thereunder without the prior written consent of the City.
20. SUBCONTRACIING
If the Consultant shall subcontract any of the work to be performed under this
contract by the Consultant, Consultant shall be fully responsible to the City for the
acts and omissions of Consultant’s subcontractor and of the persons either directly
or indirectly employed by the subcontractor, as Consultant is for the acts and
omissions of persons directly employed by consultant. Nothing cor,tained in this
contract shall create any contractual relationship between any subcontractor of
Consultant and the City. The Consultant shall bind every subcontractor and every

s subcontractor of a subcontractor by the terms of this contract applicable to
Consultant's work unless specifically noted to the contrary in the subcontract in
question approved in writing by the City.
21. PROHIBITED INTEREST
No official of the City who is authorized in such capacity on behalf of the City
to negotiate, make, accept, or approve, or take part in negotiating, making,
accepting, or approving of this agreement, shall become directly or indirectly
interested personally in this contract or in any part thereof. No officer or employee
of the City who is authorized in such capacity and on behalf of the City to exercise
any executive, supervisory, or similar functions in connection with the performance
of this contract shall become directly or indirectly interested personally in this
contract or any part thereof.
22. VERBAL AGREEMENT OR CONVERSATION
No verbal agreement or conversation with any officer, agent, or employee of
the City, either before, during or after the execution of this contract, shall affect or
modify any of the terms or obligations herein contained nor entitle ihe Consultant
to any additional payment whatsoever under the terms of this contract.
23. SUCCESSORS OR ASSIGNS
Subject to the provisions of Paragraph 18, "Hold Harmless Agreement," all
terms, conditions, and provisions hereof shall insure to and shall bind each of the

24. EFFECTIVEDATE
This agreement shall be effective on and from the day and year first above
written.
25. CONFLICT OF INTEREST
The Consultant shall file a Conflict of Interest Statement with the City Clerk in
accordance with the requirements of the City of Carlsbad Conflict of Interest Code.
The Consultant shall report investments or interests in real property.
26. INSURANCE
The Consultant shall obtain and maintain policies of general liability insurance,
automobile liability insurance, and a combined policy of worker's compensation and
employers liability insurance from an insurance company authorized to do business
in the State of California which meets the requirements of City Council Resolution
No. 91-403 in an insurable amount of not less than one million dollars
($1,000,000) each, unless a lower amount is approved by the City Attorney or the
City Manager. This insurance shall be in force during the life of this agreement and
shall not be canceled without thirty (30) days prior written notice to the City sent
by certified mail.

PHASE 1-PROJECT MGMNT, DATA COLLECTION AND FIELD RECONNAISSANCE
Pumose: Obtain base information, review project and site history, and set groundworl
for project studies.
Task 1.1 Project Management and Coordination
Dudek & Associates will meet with City staff periodically throughout th(
project duration to share in research findings and determine that alternativl
decisions are consistent with the City's goals.
Attend City staff and public information workshops.
A'maximum of 4 (total) meetings and/or workshops have been budgeted fo
this task.
Perform in-house quality assurance review of all documents at completion o
Phase 3.
Task 1.2 Research and Site Reconnaissance
Obtain relevant "as-built" street and right-of-way control plans to determinc
location of existing utilities and horizontal control. "Potholing" of utilities i!
not included in this task, but should be performed during final design
Perform site visits to verify existing conditions.
Task 1.3 Field Survey and Aerial Topography
Perform field survey and office support calculations to set aerial pre-marks
retrieve centerline and pertinent boundary monumentation in order tc
establish alignment control. Perform supplemental surveying to provide thc
following:
Locate critical cultural features such as blow-off valves, SDG&E vaults
etc. that pose constraints to the alignment;
Cross-section at selected intervals, but no less than 50' stations except ai
the hairpin curve area;
Existing superelevation sections of the roadway;
Profile existing intersections (i.e. Hoover, Highland & Park) to verifl
that any realignment of Adams provides smooth transitions to existing
improvements.
Provide digital based aerial topographic mapping at 1" = 40' scale horizontal
and 2-foot intervals. Provide color aerial photograph (1" =40') with existing lo1
lines and Right-of-way superimposed with additional enhancements.

Task 1.4 Base Sheet Preparation
Utilizing the digital based aerial topography, prepare base sheets on standara
City D-sheets. These base sheets will reflect existing utilities, street Right-of-
Ways, and lot lines.

PHASE 2-ALTERNATIVE ANALYSIS-ENVIRONMENTAL RECONNAISSANCE-RPT.
Purpose: City and Dudek will analyze three (3) alternatives and select a desired
alignment for final plan preparation.
Task 2.1 Environmental Field Reconnaissance
Perform archaeological and paleontological record searches and a biological
field reconnaissance. The biological reconnaissance is a cursory study and not
a typical field survey. Field surveys for archaeological, paleontological, and
biological resources would only be conducted if the initial research described
above indicates the need for follow-up survey. These activities are shown as
additional services in Phase 4 and would be undertaken only with City staff
direction and approval.
Task 2.2 Geotechnical Evaluation
Review geologic maps and literature pertaining to the site area including
stereoscopic aerial photographs.
Perform reconnaissance of the site area.
Prepare a report summarizing the findings and conclusions regarding geologic
and geotechnical impacts which may affect the site.
Task 23 Preliminary Alternatives
Incorporate the findings generated from the Environmental Field
Reconnaissance, Task 2.1, and prepare up to three (3) alternative alignment
studies. The alignments will utilize AutoCAD overlays depicting right-of-way
limits, street section location, and grading limits for each scenario. Consultant
will follow the design criteria and typical street section stipulated in the
request for proposal dated August 21,1991.
Meet with City staff to review alternatives.
Based upon City staff reviews and comments, revise alternatives accordingly in
preparation for the report and selection process.

Task 2.4 Project Report
Compile all supporting documentation, appropriate attachments
environmental field reconnaissance findings, pro and con recommendation
for each alternative, and prepare design report.
Submit report for City staff review and comment. Incorporate comments an.

Task 2.5 Ownership and Alignment Presentation Graphics
Mount the aerial photographs obtained in Task 1.3 on 0.125" foam board an
enhance with additional graphics and overlays to illustrate the three (3
alternatives in preparation for presentations to the public and City Council.
The above photographs will depict existing lot lines and street right-of-way
In addition, tax accessor parcel numbers and property ownership will b
represented in a tabular format.
The Consultant proposes to use "see through" overlays mounted with Velcro ti
illustrate each alternative alignment. This approach will allow the viewing o

PHASE 3-FINAL ALIGNMENT DESIGN & ENVIRONMENTAL ASSESSMENT (EIA)
Pumose: Obtain direction from City Staff on the desired alignment and prepare fina
concept design.
Task 3.1 Final Alignment Design
Incorporate input and direction received from Phase 2 and prepare fina
concept design for the preferred alignment on standard City "D sheets. Plan
will reflect the following: title sheet, typical street section, plan and profilc
sheets, grading limits, and proposed retaining walls, if required.
Task 3.2 Final Right-of-way Plat - Horizontal Control Plan
Prepare right-of-way drawing for the selected alignment depicting right-of-waJ
and slope easement "takes." This will be a comprehensive plat on standarc
City "D" sheets with call outs for square foot area of each "take area" and thc
associated property owner and tax parcel. Individual plats for each parcel arc
not anticipated.
Prepare Horizontal Control Plan for the entire alignment. The Horizontal
Control Plan will reflect the basis of bearing and control network used ta
establish the project alignment and tie-ins to surrounding Maps of Records,
Coordinate point numbers will be set at all boundary ties, centerline BC's and
EC's, and other pertinent control points. The point numbers with theii
corresponding northing and easting coordinates will be plotted in tabula1
form.
Task 33 Hydrology Basin Mapping
Prepare hydrology map of the drainage basin and identify areas of concern
regarding pick-up and discharge locations and recommendations for proposed
storm drain facilities. The final concept plan will only show the location of
proposed storm drain facilities 36" in diameter or larger.
Task 3.4 Estimate
Prepare engineer's cost estimate and quantity take-off for earthwork.
Task 3.5 Environmental Impact Assessment (EM)
Complete City of Carlsbad Environmental Impact Assessment (EIA) Form,
Part I, for the selected alternative.
Consultant will submit the draft EIA for City review and comment. City staff
will process the document through the City Planning and/or Engineering
Department. City will also be responsible for the public review and
distribution, if required.
Consultant will revise the draft document and resubmit the final EIA form to
the City.

* PROJECT ASSUMPTIONS
The Environmental Documentation will be prepared based upon the followin]
assumptions:
1. The City of Carlsbad shall be the Lead Agency for the environmental review.
2. Environmental review documentation shall include an Environmental Impac
Assessment for one preferred alignment, also referred to as an Environmental Impac
Assessment Form, Part I. This is equivalent to an Initial Study as described in thc
CEQA Guidelines. An EIR shall not be required without revisions to the Scope o
Work and Cost Estimate.
3. All environmental issued listed in the Environmental Assessment shall be addressec
with supplementary technical studies provided for the following environmental issue5
biological resources, archaeological resources, and paleontological resources. Th
supplementary technical studies will be attached to the Environmental Assessments a
appendicies. If additional significant environmental issues are identified during th
environmental review process, the Consultant will prepare a revision to the Scope c
Work and Cost Estimate.
4. It is our understanding that the supplementary technical studies will initially be used a
part of a planning process to identify select environmental constraints associated wit1
three preliminary alternatives to aid the City and Consultant in choosing a preferrec
alignment. Once a preferred alignment has been selected, the technical studies wil
support the conclusions of the EIA.
5. The proposed scope of work does not include a Negative Declaration, Mitigate(
Negative Declaration, Mitigation Monitoring Program, or Cost Estimates fo
mitigation measures.
6. It is our understanding that the discretionary action for which the Environmenta
Impact Assessment is being completed is a Specific Alignment for Adams Street, whicl
requires approval by the City Council.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA APPROVING A CONSULTANT AGREEMENT FOR THE ADAMS STREET ROADWAY ALIGNMENT STUDY, PROJECT NO. 3364
WHEREAS, the City of Carlsbad requires the services of a profes
engineering consultant to prepare a study evaluating various alternative r
alignments and recommend a specific alignment for Adams Street between Hz
Street and Park Drive; and
WHEREAS, a scope of work and consultant agreement has been pi
for said services; and
WHEREAS, the City Council hereby finds it necessary, desirai
in the public interest to approve said agreement.
NOW, THEREFORE, BE IT RESOLVED as follows:
1. That the above recitations are true and correct.
2. That the consultant agreement between Dudek & Associates, 11
the City of Carlsbad is hereby approved and the Mayor and City Clerk are
authorized and directed to execute said agreement.
