I- 2 8 1 0 z 3 bI I t GAHLSBAD - AGEND /'I 7 DEP RECOMMENDED ACTION: The Planning Commission and staff are recommending that the City Coi Resolution No. 4 2 -93 approving the Negative Declaration issued by tt Director and adopt Resolution No. approving the Loci Management plan for Zone 16. ITEM EXPLANATION Zone 16 is the twentieth Local Facilities Management plan to be heard t Council. The zone is located in the Northeast Quadrant and is approximatelk in area. The General Plan land uses designated within the zone are Plannel and open space. There is no existing or approved development in the : projected buildout for purposes of this LFMP is approximately 3.6 millior planned industrial space. The plan is a regulatory document which analyzes all eleven public fi determine whether they conform with the adopted performance standard! facilities are identified as requiring upgrading in order to accommod development in the zone. Therefore, specific conditions of approval have be( in the plan to guarantee that all of the public facility standards will continue through buildout of the Zone. The plan is subject to change if circumstar from the underlying assumptions used to project facility thresholds. This plan includes a complete financing plan in compliance with Section 21. the Carlsbad Municipal Code. Therefore, it does not require a subsequeni plan. All facilities required to serve development in Zone 16 can be pi participation in Community Facilities District No. 1, by payment of normal and as conditions of approval on development permits. ENVIRONMENTAL REVIEW A Negative Declaration was issued by the Planning Director on January : indicating that the Local Facilities Management Plan for Zone 16 is not anti have any adverse impacts on the environment. The Negative Declar; recommended for approval by the Planning Commission on February 19, I! The Local Facilities Management Plan for Zone 16 will not cause any : environmental impacts. The plan is a public facilities planning document th 73 - $':/ I e m Page Two of Agenda Bill No. implements Carlsbad’s General Plan. The plan makes generalized projections as to t demand for and supply of public facilities and outlines provision of adequate put: facilities concurrent with the estimated demands. The plan recognizes that furtk environmental review pursuant to the California Environmental Quality Act will be requir prior to the development of any public or private project that is generally discussed in tl plan. FISCAL IMPACT Staff time has been utilized in the preparation of this plan. These costs will be recover through the processing fee established by the City Council. It is anticipated that furtk staff time will be necessary to monitor this plan and other zone plans on a yearly baz The implementation of this plan, however, should help future fiscal planning by estimati the timing of future public facilities and their costs. EXECUTIVESUMMARY The purpose of this document is to provide a plan for supplying the public faciiitier will be needed to accomodate development within the Zone 16 area of the Cii Carlsbad, in accordance with the City's Growth Management Program. The plar been prepared in accordance with Chapter 21.90 of the Carlsbad Municipal Code an Citywide Facilities and Improvements Plan of 1986. Exhibit 1 on page 4 indicates H Zone 16 is located within the City. Development Assumptions The first step in developing such a plan is to estimate the amount of development will be allowed in the zone. The types of land uses assumed for the zone are t shown in the Carlsbad General Plan. Exhibit 7 ,on Page 22, shows the location o open space as shown on Exhibit 8, on Page 23. There are no residential land proposed within the zone, so no residential density analysis has been included in zone plan. For determining the nonresidential development potential, it is assumed that buil coverage would be 30% of the net developable acreage. This method yields an'ultii nonresidential development estimate of approximately 3,6 15,9 16 square feet. Th only an estimate or assumption for facility planning purposes. Actual nonreside development may vary. The property ow are not required to adhere to this phasing, and it is intended for facility plani purposes only. The phasing schedules (Exhibits 11 through 13) also include projections for other zones with adopted Local Facilities Management Plans. schedules are used to determine approximate threshold years for constructing 1 0 0 * upgrading various public facilities to maintain compliance with the Performe Standards in the Growth Management Program. The threshold years arrived at in way are only projections for facility planning purposes. The actual thresholds mus monitored as development takes place in this zone. Facilities may be needed soone later than the threshold years shown in this plan, depending upon the actual timini development. The development, phasing and buildout years referred to in this document are used facility planning purposes only. The actual timing of development will depend u many outside factors, This zone plan assumes development phasing starts at the south and proceeds north \ regard to the provision of public facilities. Zone 16 Requirements for Public Facilities The development assumptions outlined above are used to estimate the demand for pu facilities generated by development in Zone 16 based on the eleven adopted Perform: Standards in the Growth Management Program. The following table (Exhibit 2 on g 5) shows the current status of each facility with respect to the Performance Stand given the existing amount of development in the zone. Because there is currentlj developed land in Zone 16 the public facility demands are presently minimal. Of eleven Performance Standards, five are currently being met (Wastewater, Pa Drainage, Fire and Open Space). The City Administrative, Library and Sch Performance Standards are not impacted by development in Zone 16 as they residentially based. There are no existing Sewer or Water facilities serving Zone Circulation facilities currently do not meet the adopted Performance Standard. In order to assure compliance with the Performance Standards as development occur the zone, the Plan contains specific conditions of approval which are listed in Exhibj on Page 6. Exhibit 4, on Page 8, contains the General Conditions which are applic; to all zones of the City. Exhibit 5 ,on Page 10, contains Special Conditions for Zone The Special Conditions state each facility that must be provided, whether it musl financed or constructed, and when it must be provided. The following is a list of the public facilities required to serve development in Zone This chart shows whether the facility would otherwise be provided as a condition approval of a development project, whether a special funding mechanism is nekded, whether the facility is funded by the Citywide Community Facilities District. 2 .. w 0 Citv Administrative Facilities - Combination of Public Facilities Fees (PFF) Citywide Mello-Roos Community Facilities District (CFD). Financing for Facilities Section 21.90.110(3) of the Municipal Code requires that Local Facilities Manage Plans contain a discussion of various methods of funding the facilities and improver identified in the plan. This plan for Zone 16 provides an estimated cost for each fa and one or more possible methods of funding. General Condition No. 10 states that annexation to, and participation in, the City CFD is necessary in order to find that development within the zone is consistent wit Public Facilties Element of the Carlsbad General Plan. All development within Zone 16 shall conform to the provisions of Section 21.90 o Carlsbad Municipal Code and to the provisions and conditions of this Local Faci Management Plan. All development within Zone 16 shall be required to pay a public facilities fee purs to the standards adopted by the City Council on July 28, 1987, and as amended j time to time and all other applicable fees. Development in Zone 16 shall alsc responsible for any additional fees to be incorporated into this Plan that are found t necessary to enable facilities to meet the adopted performance standard. The City of Carlsbad shall monitor all facilities in Zone 16 pursuant to Subsec 21.90.130(c), (d) and (e) of the Carlsbad Municipal Code. All development in Zone 16 shall be in conformance with the adopted Citywide Fa& and Improvements Plan as adopted by City Council Resolution 8797 on Septembei 1986. Periodic amendment to the Zone 16 Local Facilities Management Plan is anticipatt incorporate newly acquired data, to add conditions and upgrade standards as determ through the required monitoring program. Amendment to this Plan may be initiate action of the property owners, Planning Commission or City Council at any time. If a public facility or service is found not to be in conformance with an ado performance standard during the yearly monitoring, or at any other time, the matter be immediately brought before the City Council. If the City Council determines tl non-conformance does exist, then no future building or development permits, w would impact the facility, shall be issued unless an amendment to the Citywide Faci and Improvement Plan or the Local Facilities Improvement Plan for this Zon facilities into conformance with the adopted performance standards. After adoption of this Plan by the City Council, no building permits will be allc unless the performance standards are complied with. Approval of this Plan does not constitute prior discretionary review for projects w Zone 16. All future projects shall undergo review per Title 21 of the Carlsbad Munic Code. Approval of any discretionary permit within Zone 16 shall be contingent upon provision of adequate public facilities to satisfy the Public Facilities Element of General Plan. At this time, a Mello-Roos Community Facilities District has been for to finance the construction of several Citywide facilities necessary to serve development. If the Zone 16 property does not annex into the district, the req General Plan consistency finding cannot be made and no discretionary approvals, buil permits, grading permits, final maps, or development permits would be issue approved; therefore, the property is conditioned to annex into CFD No. 1 as a cond of the first discretionary approval. A Planned Community Master Plan or a Specific for the purpose of this Condition is not the first discretionary approval. 10. 9 1) w EXHIBIT 5 SPECIAL CONDITIONS FOR ZONE 16 LFMP 89-16 The following Special Conditions apply specifically to development in Zone 16 and mu: complied with in addition to the General Conditions for Zone 16. These conditions are listed separately under the analysis discussion of each facility. CITY ADMINISTRATION No special conditions are necessary at this time. LIBRARY No special conditions are necessary at this time. WASTEWATER TREATMENT CAPACITY No special conditions are necessary. However, the following action shall be pursued joint1 each sewer district to ensure adequate wastewater treatment capacity through the year 20C A. Monitor Encina Treatment plant flows on a monthly basis to determine actual flow and to have an early warning of capacity problems. PARKS A. A growth management park fee of $.40 per square foot of non-residential developmeni be collected at the time of building permit issuance, to be used for park facilities sei Zone 16. DRAINAGE A. All future development in Zone 16 will be required to construct any future storm I facilities identified in the current Drainage Master Plan and revised Drainage Master as determined by the City Engineer. Any facilities necessary to accommodate f development must be guaranteed prior to the recordation of any final map, issuance grading permit or building permit, for any development requiring future storm I facilities in Zone 16. Individual lot development plans will be required to address the removal of 1 pollutants from drainage waters consistent with the National Pollutant Disc1 Elimination System Permit. This will be pursuant to the San Diego Regional i Quality Control Board Order, No. 90-42, which may be in effect at the time of pi approval. B. 10 .. u C. Prior to the recordation of the first final map, issuance of grading permit or builc permit, whichever occurs first for any development within Zone 16, the developers of project are required to: 1. Pay the required drainage area fees established in the current Drainage Master 1 and; Prepare a hydrologic/hydraulic study addressing drainage inadequacies onsite downstream to the satisfaction of the City Engineer. 2. IMPROVEMENTS NEEDED BY 1993 The circulation analysis determines the needed public facilities to accomodate exiz development and future development according to an assumed developmental sceni Since Zone 16 is totally undeveloped, the improvements needed now are includec mitigation needed by 1993, to coincide with the first proposed development in Zone The first phase of this development; however, will most likely take longer to coml than its 1993 projection date, hence giving a conservative approach. 1. Palomar Airport Road between El Camino Real and East City Limit Palomar Airport Road from El Camino Real to the east city constructed to include the following: a. b. c. limit shal Complete grading to ultimate right-of-way width to prime arterial standa Construction of four travel lanes, two in each direction, with a median. Intersection improvements at the intersection of Palomar Airport Road an1 Camino Real to include signal modification and the addition of one eastbc through lane plus one additional left turn lane in the southbound westbound directions. Estimated Cost - $7,244,029 Completion Date - 1993 Note: The financing for Palomar Airport Road - East (PAR East) shall established prior to approval of the first discretionary development permit for 2 16. The financing for PAR East is currently guaranteed by Zone 5; however, City anticipates adoption of a PAR East Financing Plan for the long-term finan of this obligation. The PAR East Financing Plan may include Trans/Net an other sources of financing, and will establish the final proportionate share obligation for PAR East among Zone 17 and Zone 18, and Zone 16 (if any). PAR East Financing Plan shall also provide for appropriate reimbursement of expenditures undertaken by Zone 16, in the event Zone 16 must advance fundin1 construction of PAR East improvements. Adoption by the City of the PAR Financing Plan shall establish the final responsibilities for financing PAR East shall supercede and replace the language of the above condition. 12 w - 2. IMPROVEMENTS NEEDED BY 2010 (BUILDOUT) Intersection configurations for all improvements prior to buildout correlate with information provided within the traffic study located in Appendix A-3. Improvements to the intersection of Palomar Airport Road and El Fuerte St to construct full intersection to provide two northbound and southbo through lanes, three eastbound and westbound through lanes, a single left-t lane in the southbound direction, dual left-turn lanes in the northbou eastbound and westbound directions and a single right-turn lane in northbound and westbound directions. Estimated Cost - $lOO,OOO Completion Date - 2003 4. Palomar Airport Road/Melrose Avenue a. Improvements to the intersection of Palomar Airport Road and Melr Avenue to construct full intersection to include three through lanes in directions, dual left turn lanes in all directions and single right-turn lane: all directions, Estimated Cost - $350,000 Completion Date - 2005 5. Faraday Avenue/El Camino Real a. Improvements to the intersection of Faraday Avenue and El Camino Real construct full intersection to provide three northbound and southbound throl lanes, two eastbound and westbound through lanes, dual northbound i southbound left-turn lanes, single eastbound and westbound left-turn lanes i single southbound, eastbound and westbound right-turn lanes. SCHOOLS No special conditions are necessary at this time. SEWER COLLECTION SYSTEM A. Prior to the recordation of the first final map, issuance of grading permit, or buil permit, whichever occurs first for any development in Zone 16, a financing mechar guaranteeing the construction of the following sewer facilities must be provided: 1. The South Agua Hedionda Trunk & Interceptor System from SAHTlB to the \ Carlsbad Interceptor. (SAHTlB, SAHTlC, SAHTlD, SAHTIE, SAHTIG, SA SAH2, SAH Lift Station, SAH3 Force Main, and SAH4.) B. Prior to the issuance of a building permit for any development in Zone 16, the South A be constructed and operational. WATER DISTRIBUTION SYSTEM A. Hedionda Trunk and Interceptor System from SAHT 1B to Vista Carlsbad Interceptor r All development within Zone 16 shall pay a major facilities fee based on E.D.U.’s to Carlsbad Municipal Water District and a capacity charge to the San Diego County W Authority, In addition, all development in Zone 16 shall be required to provide any w reclamation facilities identified in the future Water Reclamation Master Plan as determi by the District Engineer. Any water reclamation facilities necessary to accommoc future development must be guaranteed prior to the recordation of a final map, issua of a grading permit or building permit, which ever occurs first for any project in Zone B. SERVICE AREA A 1. The following water facilities will be required as a condition to the approva future development within Service Area A to the satisfaction of CMWD: a. The proposed potable 16-inch water main in Melrose Avenue from Pal01 Airport Road to future Faraday Avenue, in future El Fuerte Street anc future Faraday Avenue. 17 . 0 w b. The following water facilities, to be financed as outlined on Page 164, wil required as a condition to the approval of future development within Service 1 C to the satisfaction of CMWD: a. The proposed potable 16-inch main in a future street north of future Far; Avenue. RECESS The Planning Commission recessed at 7:16 p.m. and reconvened at 7:24 p.m. 6) LFMP 16-LOCAL FACILITIES MANAGEMENT PLAN FOR ZONE 16 - Request for approval of a Local Facilities Management Plan for Zone 16, located in the northeast quadrant, ' adjacent to the City of Vista. 3on Rideout, Senior Management Analyst, Growth Management, reviewed the background of the request and stated that Zone 16 is located in tne northeastern quadrant of the City. It is approximately 414 acres in area and is under one ownership. There is no existing development in the zone. The General Plan designation is Planned Industrial with a lot of open apace. The zoning is PC which will require a Master Plan prior to any development occurring within the zone. Parks Mr. Rideout stated that this zone has the requirement for a parks fee which is similar to the parks fee for Zone 5. Because the development in this zone will be almost identical to the development in Zone 5, it has been determined that there is a need for park land. The parks fee has been set at 5.40 per s.f. on the industrial development that would occur in this zone. Buildout is estimated to be a maximum of 3.6 million 6.f. based on the - conetrainte analysis which is included in the plan. However, he noted that the actual amount of dEVelOplnEnt will probably be less than that. Circulation Steve Jantz, Associate Engineer, discussed circulation and stated that there are two circulation roadways which will bisect Zone 16. Faraday Avenue will be required to be constructed with future development from the existing terminus adjacent to the Safety Center and continue through to the Melrose Drive intersection in the City of Vieta. The other roadway required would be a continuation of El Puerte from Palomar Airport Road to the intersection of Paraday Avenue. As development occurs within the zone, the traffic generated from the zone impacts various road segments and intersections outside of the zone boundary. The widening of Palomar Airport Road will be required in the near future. Mitigation alternatives are also shown in this zone plan and will be required of future development within the zone. Sewer Mr. Jantz stated that Zone 16 is within the South Aqua required to construct the South Aqua Hedionda interceptor eyetem which includes that portion of the line from 1-5 to El Camino Real. In addition, it is also necessary to - Hedionda sewer basin. This sewer facility is estimated to coat $4.6 million and ie required to be over-sized. Since this development is at the upper end of the sewer basin, any construction required in the zone is required to be over-sized to handle other development within the Aqua Hedionda basin. Because of the over-size, the developer would be subject to some reimbursement from adjacent property owners who will ultimately use this line. The City has adopted a sewer benefit area fee structure which is a sewer reimbursement fee that all development will be that reimbursement schedule to reimburse this development for the cost of constructing the south Aqua Hedionda interceptor. Financing Proposals Mr. Rideout concluded the staff report by stating that this facilities plan contains within it a complete financing plan which is similar to the Zone 21 plan approved a few months ago. It is a departure from previous zone plana wherein separate financing plana were allowed. Staff now requires that all zone plana contain a financing plan which has been made possible by the Mello-Roo3 District formed a few months back. The major components of the financing plan for Zone 16 are annexation to the Mello-Roos District to occur with the first discretionary action within the zone (except for the Master Plan). All other facilities required by this zone will be entirely developer-funded either through the payment of normal fees or by direct developer-funding. Staff has thoroughly reviewed the facilities plan for Zone 16 and it complies completely with Proposition E and the Growth Kanagement Ordinance. Staff recommends approval. He noted that there are some old dates in the resolutions which need to be corrected. Chairman Erwin inquired if the date in Condition #I, page 2 of Resolution NO; 3247, should reflect the date of the zone plan or the approval date of the zone plan. Mr. Rideout replied that all dates will be tonight's date, February 19, 1992. Comissioner Holmes stated that he had spent a considerable time looking for the railroad tracks on the constraints map. Mr. Rideout replied that a standard legend was used which lists all of the constraints that might be found in a zone. However, there does not happen to be any railroad tracks in Zone 16. Chairman Erwin opened the public testimony and issued the invitation to speak. Ted Chang, 3765 Kenyon Street, San Diego, representing Paul Chang and Ted Gildred, owners of the property, addressed the required to pay within this one basin. The City will use Comieeion and stated that this property ie north of and contiguous to Zone 5 property which they also own. The facilities plan has been in process for three years and he commended staff on their cooperation. Chairman Erwin inquired about a reference on page 107 which states if any one of the three thresholds are met it will require construction of a fire station. Mr. Chang replied that this is his understanding as well. Mr. Chang replied that this would be addressed as part of the design of the roads. He has already been in contact with Teri Woods regarding the open space and he will give the 6' tunnels consideration. There being no other persons desiring to address the Commission on this topic, Chairman Erwin declared the public testimony closed and opened the item for discussion among the Commission members. Commissioner Schramm feels the plan is well done and she agrees with the park fee of 5.40 per s.f.
