GRANTING OF ELECTRICAL
SDG&E FOR LA POSADA GUADALUPE DE CARLSBAD
RECOMMENDED ACTION:
granting an electrical distribution easement and
right of way to SDG&E for installation of electrical conduit to serve La Posada
Guadalupe de Carlsbad.
ITEM EXPLANATION
On December 4,1991, C.U.P 91-10, La Posada Guadalupe de Carlsbad was approved
by the Planning Commission. The project is co-sponsored by Catholic Charities of
San Diego and Caring Residents of Carlsbad and will provide emergency shelter for
up to 50 homeless men. The shelter will be located at 2469 Impala Drive, northwest
of the City’s Safety Center and adjacent to the Fleet Maintenance Facility.
SDG&E is requesting that the City grant them an easement and right of way, so that
they may construct and maintain the underground facilities required to provide
electrical service to the emergency shelter. Dedication consists of a six (6) foot by
fifty-five (55) foot strip of City property which will be used to install electrical
FISCAL IMPACT
There is no fiscal impact to the City associated with this request.

RESOLUTION OF,TEfE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, FOR THE CITY TO CONVEY AN EASEMENT AND RIGEIT
OF WAY TO SAN DIEGO GAS AND ELECTRIC FOR CONSTRUCTION
AND MAINTENANCE OF UNDERGROUND FACILITIES TO SERVE LA
POSADA GUADALUPE DE CARLSBAD C.U.P. 91-10
WHEREAS, the City Council of the City of Carlsbad has determined it
necessary, desirable and in the public interest to convey an easement and right-of-way
to San Diego Gas and Electric for the construction installation and maintenance of
underground electrical facilities to serve the La Posada Guadalupe de Carlsbad
Emergency Shelter C.U.P. 91-10,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Carlsbad, California, as follows:

That the above recitations are true and correct.
That the conveyance of an easement and right of way to San Diego
Gas and Electric to provide electrical service to La Posada Guadalupe
de Carlsbad incorporated by this reference, is approved.
That the Mayor and City Clerk are authorized execute the easement
which will be returned to the City Clerk and a copy forwarded to San
Diego Gas and Electric for recordkeeping.

EASEMENT
CITY OF CARLSBAD, A MUNICIPAL CORPORATION, (Grantor), grants to SAN DIEGO GAS &
ELECTRIC COMPANY, a corporation (Grantee), an easement and right of way in, upon, over, under and across the
lands hereinafter described, to erect, construct, change the size of, improve, reconstruct, relocate, repair, maintain
and use facilities consisting of:
1. Poles, wires, cables and appurtenances for the transmission and distribution of electricity.
2. Underground facilities and appurtenances for the transmission and distribution of electricity.
3. Pipelines and appurtenances for any and all purposes.
4. Communication facilities, overhead and/or underground and appurtenances.
The above facilities will be installed at such locations and elevations upon, along, over and under
the hereinafter described easement as Grantee may now or hereafter deem convenient or necessary. Grantee also
has the right of ingress and egress, to, from and along this easement in, upon, over and across the hereinafter
described lands. Grantee further has the right, but not the duty to clear and keep this easement clear from
explosives, buildings, structures and materials.
The property in which this easement and right of way is hereby granted is situated In the County
of San Diego, State of California, described as follows:
That portion of Lot “B” of Ranch0 Agua Hedionda, according to Map thereof No. 823 filed in the
Office of the County Recorder of said County of San Diego, described in a deed recorded June
30, 1982 at Recorder’s File/Page No. 82-201566 of Official Records of said County of San Diego.
The easement in the aforesaid lands shall be 6.00 feet in width, being 3.00 feet
measured at right angles, on each side of the following described center line:
Commencing at the most Southerly corner of Parcel Map No. 15247, filed May 25, 1988
at File No. 88-247094,in the Office of the County Recorder of said County of San Diego, said
corner bears South 78”14’55” East from a point on the arc of a curve of “IMPALA DRIVE” (culde-
sac); thence leaving said most Southerly corner, North 66’48’41” East, 64.95 feet to the TRUE

POINT OF BEGINNING of the centerline herein described; thence North 89”37’08’ West to a
point on the Westerly boundary of said lands of grantor, a distance of 55 feet more or less.
Grantor grants to Grantee the right to erect and maintain on Grantor’s property adjacent to this
easement such anchorage as may be necessary for Grantee’s purposes.
Grantor shall not erect, place or construct, nor permit to be erected, placed’or constructed, any
building or other structure, plant any tree, drill or dig any well, within this easement.
Grantor shall not Increase or decrease the ground surface elevations withln this easement after
installation of Grantee’s facilities, without prior written consent of Grantee, which consent shall not unreasonably be
withheld.
Grantor further grants to Grantee the right to assign any or all of the rights granted in this easement
in whole or in part to other companies providing utility or communication faciiities/services.
Grantee shall have the right but not the duty, to trim or remove trees and brush along or adjacent
to this easement and remove roots from within this easement whenever Grantee deems lt necessary. Said right shall
not relieve Grantor of the duty as owner to trim or remove trees and brush to prevent danger or hazard to property
or persons.
CONDUITS CARRY HIGH VOLTAGE ELECTRICAL CONDUCTORS, AND PIPELINES MAY CARRY
VOLATILE MATERIALS, therefore Grantor shall not make or allow any excavation or fill to be made within this
easement WITHOUT FIRST NOTIFYING SAN DIEGO GAS & ELECTRIC COMPANY BY CALLING 696-2000, AND
OBTAINING PERMISSION.

This easement shall be binding upon and inure to the benefit of successors, heirs, executors,
administrators, permittees, licensees, agents or assigns of Grantor and Grantee.

Re: Grant of Electrical Distribution Easement and Right-of-Way
The Carlsbad City Council, at its meeting of April 14, 1992, adopted Resolution
No. 92-104, approving the conveyance of an Easement and Right-of-Way to San Diego
Gas & Electric Co. for construction and maintenance of underground facilities to
serve La Posada de Guadalupe de Carlsbad (CUP 91-10).
The original Easement is enclosed so that-you can have it recorded with the
County Recorder. Also enclosed for your records is a copy of Resolution No. 92-
104.
